CTOW/Renewal/RPN/2020/13107919 dated 11/08/2020 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/RPN/2020/13107757 dated 11/08/2020, both of which were expired on 30/06/2022 for operation of Screening-cum-Washing plant only @ 7,000 CFT/day subject to the suitable conditions mentioned therein in the name of Sh. Gurdeep Singh, Proprietor.<span style="mso-tab-count: 1;"> </span></span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">Thereafter, the unit has issued show cause notice for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. 246 dated 03.02.2022 with an opportunity of personal hearing on 14.02.2022, wherein, it was decided as under:</span></p>

<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">Now, the unit has applied for obtaining renewal of 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 in the name of Sh. Baljit Singh, Proprietor (with change of proprietor ship documents) alongwith undertaking regarding code of practice and regarding legal mining, raw material slips from mining site Bhallan, compliance of previous consent and consent fee. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">The unit has submitted an affidavit (Halfia Biyan) by Sh. Jagdeep Singh S/o Sh. Sukhdev Singh R/o Village Madho Majra, Tehsil & Distt. Rupnagar, wherein, it has mentioned that Sh. Jagdeep Singh has purchased the screening plant on 25.03.2019 from Sh. Gurdeep Singh S/o Sh. Hardev Singh, previous owner of the unit and the documents like sale deed (Ikrarnama) has been lost. The unit has attached sale deed (Ikrarnama) executed between Sh. Jagdeep Singh and Sh. Rajinder Singh S/o Sh. Dilbag Singh on 30.09.2020 from which it is clear that the screening plant has been sold to Sh. Rajinder Singh.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">Further, the unit has also attached the copy of sale deed (Ikrarnama) executed between Sh. Rajinder Singh and Sh. Baljit Singh S/o Sh. Jasbir Singh R/o #205, Arjan Singh Nagar, Jalandhar on 12.05.2022, wherein, it has mentioned that the Sh. Rajinder Singh has sold the screening plant to Sh. Baljit Singh. Further, the unit has also attached ikrarnama with the land owner Sh. Avtar Singh that the lease deed will be extended shortly.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">The unit has submitted the CA certificate dated 23.06.2022, wherein the value of fixed assets of the industry as on 31.05.2022 is of Rs. 24.53 Lakhs with the value of plant and machinery of Rs. 20.41 lakhs. Now, the unit has deposited Rs. 14,500/- vide UTR No. AXSK221850001816 dated 04.07.2022 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 14,500/- vide UTR No. AXSK221850001733 dated 04.07.2022 under the Air (Prevention & Control of Pollution) Act, 1981. As such, after deducting 25% penalty as late application fee, the fee deposited by the unit under the Water Act, 1974 and the Air Act, 1981 is adequate upto 31.03.2030 as per circular dated 29.10.2018.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">Further, it is pertinent to mention here that the Executive Engineer, Deptt. of Irrigation-Cum-Mining, Rupnagar through e-mail dated 20.10.2022 and the Executive Engineer, Deptt. of Irrigation-cum-Mining, Sri Anandpur Sahib vide no. 1005/Crusher dated 18.10.2022 has informed that there are 04 no. gravel mining sites operational in District Rupnagar i.e. Bhallan, Kotbala & Aaspur, Bari Haveli and Rasidpur Jindapur for obtaining raw material. The unit has submitted the slips of obtaining raw material from the approved mining site of District Rupnagar i.e. Bhallan de-silting site. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">The unit was visited by the AEE of this office on 17.11.2022 and Sh. Baljit Singh, Proprietor was contacted. During visit, it was observed as under:</span></p>

<p class="MsoBodyText" style="margin: 5.95pt 5.7pt 6pt 5pt; text-indent: 67pt; line-height: 150%; text-align: justify;"><span style="font-family: 'Bookman Old Style','serif'; mso-font-width: 110%; mso-bidi-language: AR-SA;">In view of the above facts and letter issued by the Executive Engineer, Deptt. of Irrigation-cum-Mining, Sri Anandpur Sahib and e-mail received from Executive Engineer, Deptt. of Irrigation-cum-Mining, Rupnagar, if approved, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.09.2023, subject to the suitable conditions as mentioned in the previous consents granted to the unit and additional conditions as under:</span></p>
