It is submitted that the industry is a medium-scale orange category unit. Earlier the industry was granted 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 for production of Edible Crude Oil @ 15 TPD & de-oiled cake @ 80 TPD and for disposal of 20 KLD of effluent in 1 acre and for operation of Boiler @ 5 TPH vide dated 05.02.2021 valid up to 30.09.2021 with suitable conditions, please. The industry has now applied for obtaining Consent to Establish along with requisite documents. The industry was visited by undersigned on 11.02.2022 and it was observed as under: - 1.    The industry was in operation during visit and engaged in the production of Edible Crude Oil & De-oiled cake by using Rice Bran. 2.    The industry has already installed one Boiler of capacity 5 TPH (as per consents) and thermopack with multi cyclone as APCD. However, the air emission sampling was not done due to non-availability of Lab staff. 3.    The industry has already installed a Boiler of 12 TPH with multi cyclone as APCD for Refinery plant. 4.    The machinery of Refinery plant was under installation during visit and is almost complete. 5.    The industry has just started the installation of ETP at site and the same in not in commensuration with the rest of project. Accordingly, application of the industry was refused. The industry was again visited by undersigned on 01.09.2022 and it was observed as under:- 1.    The industry was in operation during visit and engaged in the production of Edible Crude oil. The refinery plant was in operation but the solvent plant was not in operation. 2.    The waste effluent from the refinery plant was being discharged onto land without any treatment. 3.    The industry has not installed any ETP for treatment of effluent generated from the refinery process. The ETP was under installation during visit and only civil work was completed. 4.    The stagnation was observed in the open area and it appears that the untreated effluent is discharged from few months. 5.    The effluent samples were collected from the outlet of the industry and sent to Zonal Lab, Ludhiana for analysis. Thereafter the industry has been issued directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 for closure of unit and the PSPCL authority have also been directed to disconnect electric connection of the industry vide Board letter no. 4721-22 dated 19.10.2022 and orders to disconnect the electric supply of the industry vide Board's letter no. 4717-18 dated 19.10.2022. In compliance to the direction issued by the Board for disconnection of electricity, the PSPCL authorities has disconnected the supply w.e.f. 10.11.2022 vide letter dated 10.11.2022. The industry has again applied for Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with request to restore the electric connection of the industry. The industry has deposited Rs. 338400/- vide UTR. no. HDFCR52022110357576083 dated 03.11.2022 under Water Act, 197, Rs. 338400/- vide no. HDFCR52022110357565178 dated 03.11.2022 under Air Act, 1981 which is adequate upto 30.09.2027 as per previous agenda note. To verify the facts, the industry was visited by AEE-1 of this office on 11.11.2022 & observed that:- 1.    The industry was not in operation during visit and electric connection was found disconnected. 2.    The industry presently proposed to operate only its spent recovery unit and has made it in operational condition. The refinery unit is yet not made in operational condition. Hence, the industry will manufacture only edible crude oil from the rice brain & presently further refining of edible crude oil will not done at this location. 3.    The industry has already installed ETP for treatment of effluent generated from its existing unit of solvent extraction plant. The treated effluent will be disposed off onto land for plantation & has adequate area for it's disposal. The component of ETP is Graded Screen-Oil and grease separator- Raw Waste water collection-cum-reaction tank-Primary Clarifier- Up-flow anaerobic bio-filter-Aeration tank (MBBR)- Secondary clarifier-Filter feed sump- Multi-grade pressure depth filter- primary/secondary sludge handling. 4.    The industry has installed a rice husk fired FBC boiler of capacity 5 TPH with trima cyclone as APCD and adequate stack height. 5.    The industry has also installed one thermopac along-with multi-cyclone as APCD. 6.    Domestic effluent @ 2 KLD will be discharged onto land for plantation after septic tank. 7.    The industry has one D.G. set of capacity 320 KVA with canopy and adequate stack height. However, Sh. Mehar Chand Singla, Director of the industry attended the office of Senior Environmental Engineer, Ludhiana on 18.11.2022 and he represented that the industry was earlier running with name of M/s HCS Foods Limited and it has obtained site clearance for production of 15 TPD solvent plant with refinery. He further submitted that said industry has also obtained consent to operate for production of refined oil @ 15 TPD and de-oiled cake @ 80 TPD. Now, the industry has applied for fresh consents to produce Edible Crude Oil @ 30 TPD, De-oiled cake @ 170 TPD and Edible Oil @ 175 Ltr/day. He requested that the present application applied by the industry for increased capacity may be returned and the industry will apply for consents for production of refined oil @ 15 TPD and de-oiled cake @ 80 TPD. He also assured that the industry will not increase its production without obtaining site clearance and NOC. Accordingly, the application of the industry was returned. Now, the industry has again applied for fresh Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along with requisite documents and fees for production of Edible Crude Oil @ 15 TPD, Edible Oil @ 300 TPD & de-oiled cake @ 80 TPD. In view of above, if approved:- 1.    Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for short term period upto 30/06/2023 subject to suitable conditions and additional conditions as under:- a.    The applicant will submit the documents regarding transfer of industry from M/s HCS Foods limited to M/s Ahar Foods & Fats Pvt. Ltd within 15 days. b.    The applicant will submit the CA Attested details of increase in Fixed assets from previous consent i.e Rs 5.1 crores to till date i.e. Rs 46.04 crores within 15 days. c.     The applicant will submit the proof of scale of the industry as well as Document regarding Land use classification within 15 days. d.    The industry will submit the effluent sample report from Board’s lab within 1 month. 2.    Environmental Compensation may be imposed to the industry w.e.f. 11.02.2022 (from the starting of Refinery plant) to 11.11.2022 (till date of compliance observed by officer of the Board) for violation of Water (Prevention & Control of Pollution) Act, 1974. 3.    Directions issued u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 and 31-A of Air (Prevention & Control of Pollution) Act, 1981 may be dropped temporarily for six months subject to deposition of Environmental Compensation. 4.    Decision regarding the additional machinery, which is installed without obtaining permission from the Board may be taken.     Comp: worthy Chairman of the Board (Agenda Auto-generated)
