It is submitted that the industry is an existing unit and it has obtained varied consents to operate of the Board under the Water Act, 1974 <a name="OLE_LINK1"></a>vide no. CTOW/Varied/FZR/2021/16885572 dated 12/11/2021 and the Air Act, 1981 vide no.  CTOA/Varied/FZR/2021/16885533 dated 12/11/2021, both valid upto 31/12/2022 for the operation of the unit for production of Animal feed Supplement /Cattle Feed/Poultry Feed @ 140 MTD, Cogeneration plant @ 12 MW, Grain Based Anhydrous Denatured Ethanol/EN A/RS/Industrial Alcohol Plant @ 100 KLD & Grain Based Anhydrous Denatured Ethanol Plant @ 180 KLD by using Nakku (Grain unfit for human consumption) / Bajra/Maize/Sorghum @ 650 MTD as raw material.                    Now, the industry has applied for renewal of obtaining consent to operate of the Board under the Water Act, 1974 and the Air Act, 1981 for the operation of the unit for production of Cogeneration plant @ 12 MW, Grain Based Anhydrous Denatured Ethanol/EN A/RS/Industrial Alcohol Plant @ 100 KLD & Grain Based Anhydrous Denatured Ethanol Plant @ 180 KLD as product and Co2 @ 125 MTD & Animal feed Supplement /Cattle Feed/Poultry Feed @ 140 MTD  as by product, by using Nakku (Grain unfit for human consumption) / Bajra/Maize/Sorghum @ 650 MTD as raw material, with requisite documents and adequate consents fees. The detail of the case is as under: ·         The industry has submitted CA certificate dated 09.11.2022, showing value of gross fixed assets of Rs. 26338.32 Lakhs as on 31.03.2022. Accordingly, the industry has already deposited  Rs. 5,64,000/- vide  UTR/Ref. No. 76575168 dated 13.03.2021 & Rs. 6,27,000/- vide UTR/Ref. No. 231199082 dated 17.09.2021 under the Water Act, 1974 and Rs. 5,64,000/- vide  UTR/Ref. No. 750861355 dated 29.01.2021 & Rs. 6,05,000/- vide  UTR/Ref. No. 354647781 dated 17.09.2021 under the Air Act, 1981, which is adequate for a period upto 31.03.2026 under both Acts, as per the Board’s consent fee order 29.10.2018. The industry has also deposited Rs. 72000/- vide R. No. 379917390 dated 14.11.2022 as NOC fee, which is adequate. The revised adequacy of consent to operate fee is 31.12.2024. For increase in the value of fixed assets, the industry has submitted as under:- 1.    When we applied for obtaining varied consent to operate under the Water Act, 1974 and Air Act, 1981 for production of 180 KLD of ethanol in the existing premises of the 100 KLD distillery unit, we had submitted a CA certificate mentioning the value of fixed assets Rs. 128 crores as on 31.03.2021. 2.    It is mentioned here that as on 31.03.2021, partial machinery of the 180 KLD capacity ethanol plant had arrived at the site of the unit, therefore, the value of that machinery was accounted for in the CA certificate showing the value of fixed assets as on 31.03.2021. 3.    However, main machinery and equipment of 180 KLD capacity ethanol plant was purchased and installed after 31.03.2021 and 11.63 acre of land was added in 2022 after obtaining revised environmental clearance from MoEF. The said ethanol plant was commissioned in the month of January, 2022. Therefore, the value of machinery of 180 KLD capacity ethanol plant purchased after 31.03.2021, was not included in the CA certificate showing the value of fixed assets as on 31.03.2021. Thus, the increase in the value of fixed assets from Rs. 128 crores as mentioned in CA certificate dated 31.03.2021 to Rs. 263.28 crores as mentioned in CA certificate dated 31.03.2022 is due to this fact. 4.    The industry has submitted Public Liability Insurance issued by Tata AIG General Insurance Company Ltd. in the name of MALBROS INTERNATIONAL PVT LTD at VILLAGE MANSOORWAL, TEHSIL ZIRA, DISTRICT FEROZEPUR, which is valid for a period upto 16.08.2023. 5.    The industry has also obtained Environmental Clearance (EC) from the MoEF&CC, Govt. of India on dated 15.01.2018 for expansion of grain based distillery from 100 KLPD to 600 KLPD & Co-Generation Power Plant of 40 MW by M/s Malbros International Pvt Ltd at Village Mansoorwal, Tehsil Zira, District Ferozepur. 6.    The industry has compliance reports of conditions of consents granted to it under the Water Act, 1974 and the Air Act, 1981. 7.    The industry was visited by officer of the Board on 18.09.2022 and found that the industry was not in operation due to agitation by the farmers at the main gate of the industry. The industry is still lying closed.                      It is further submitted that earlier, a complaint was received on 18.07.2022 against contamination of ground water in Vill. Mahian Wala Kalan, Teh. Zira, Distt. Ferozepur. It was alleged in the complaint that during the drilling of borewell in the premises of Gurudwara Samadhi Bhagat Dunni Chand Ji in Vill. Mahian Wala Kalan, polluted water was observed. It was further alleged that the liquor factory i.e. M/s Malbros International Pvt. Ltd., Mansoorwal Kalan, Teh. Zira, District Ferozepur has polluted the ground water in surrounding villages by discharging polluted water through borewell. The NGT Monitoring Committee visited the area on 18.09.2022 and visited by the officers of PPCB alongwith farmers on 19.09.2022, as per the report of NGT Monitoring Committee no ground water contamination due to industrial effluent discharge was found. Also, Public Action Committee was filled a application in the Hon’ble NGT and the Joint Committee constituted by the Hon’ble NGT has prepared the reply of the same has been sent to the Hon’ble NGT, New Delhi vide this office letter no. 6304 dated 21.10.2022.                    Keeping in view of above, it is recommended that consent  to operate under the Water Act, 1974 & Air Act, 1981 may be granted to the industry for a period of one year for the operation of the unit for production of Cogeneration plant @ 12 MW, Grain Based Anhydrous Denatured Ethanol/EN A/RS/Industrial Alcohol Plant @ 100 KLD & Grain Based Anhydrous Denatured Ethanol Plant @ 180 KLD as product and Co2 @ 125 MTD & Animal feed Supplement /Cattle Feed/Poultry Feed @ 140 MTD  as by product, by using Nakku (Grain unfit for human consumption) / Bajra/Maize/Sorghum @ 650 MTD as raw material, with suitable conditions as per the policy of the Board, please
