<p style="text-align: justify;">The agenda note and report / recommendations of AEE/EE, RO, may kindly be perused.</p>
<p style="text-align: justify;">The industry was granted ‘Consent to Establish’ /NOC for establishment of Bakery/Sweet Manufacturing Unit, valid upto 13.10.2017 for manufacturing of Biscuits @ 1 MTPD, Rusks @ 1 MTPD, Cake @ 0.200 MTPD, Bread @ 0.200 MTPD, Khoya Products (Burfi, Khoya Laddu, Coconut Laddu, Biscuits, Rusks, Bread (Bandd)) @ 0.500 MTPD, Cheese Products @ 0.200 MTPD & Namkeen Products @ 3 MTPD alongwith discharge of trade effluent @ 08 KLD onto land for plantation after treatment through ETP.</p>
<p style="text-align: justify;">The industry had applied for obtaining fresh ‘Consent to operate’ under the Water Act, 1974 and Air Act, 1981.</p>
<p style="text-align: justify;">The industry was visited by officer of the Board on 13.05.2022 and found violating the provisions of Water Act, 1974 and Air Act, 1981. Accordingly, the industry was opportunity of personal hearing before the SEE, Zonal Office-2, Ludhiana on 06.06.2022. However, no one from the industry attended the personal hearing on said date. As per the decision of the Competent Authority, the applications applied by the industry for consent to operate under the Water Act, 1974 and Act, 1981 were refused.</p>
<p style="text-align: justify;">The industry was visited by officer of the Board on 02.09.2022 and it was observed as under:</p>
<p style="text-align: justify;">1. The industry was in operation for production of sweets and namkeen.</p>
<p style="text-align: justify;">2. The industry has provided ETP in common with its sister concern unit namely M/s Layallpur Food Industries. The industry has not provided separate energy meter and also not provided flow meter at outlet to ETP. No record regarding operation of ETP has been maintained.</p>
<p style="text-align: justify;">3. During visit, ETP was not in operation and untreated effluent was directly bypassed onto land for stagnation. Also a trench of width 5 feet and depth 8 feet has been digged with JCB to discharge untreated water and untreated water was found stagnated in this trench. Condition of plantation in pocket-1 was extremely poor and wild grass was grown in pocket-1. Very strong smell was observed due to stagnation of untreated effluent. Stagnation of untreated water also observed in pocket- 2 (having area of about 3 kanals) of plantation area.</p>
<p style="text-align: justify;">4. The industry has installed one thermopack of capacity 08 Lac Kcal and has provided cyclone separator as APCD with the same. Wood is used as fuel in boiler section. However, no arrangement has been made for disposal of fuel ash generated from the boiler section and the same was found disposed of in open area adjacent to wall of the industry.</p>
<p style="text-align: justify;">5. General Solid waste was found dumped into open area. The industry has also burnt general solid waste in open area.</p>
<p style="text-align: justify;">The industry was violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Thus, the industry was a chronic violator and was violating the provisions of above said Acts since Feb, 2022. </p>
<p style="text-align: justify;">Accordingly, Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 were issued for disconnection of the electricity connection of the industry and imposition of Environmental Compensation to the industry. The PSPCL Authorities have disconnected the electricity connection of the industry vide TDCO No. 86/46449 dated 02.11.2022</p>
<p style="text-align: justify;">Now, the industry has applied for ‘Consent to Operate’ under the Water Act, 1974 & Air Act, 1981. The industry has deposited consent fee, which is adequate for period upto 30.09.2026 under both acts.</p>
<p style="text-align: justify;">The industry was again visited by AEE of RO on 18.11.2022 and it was observed as under:</p>
<p style="text-align: justify;">1. The industry was not in operation due to disconnection of power supply.</p>
<p style="text-align: justify;">2. The industry has provided ETP in common with its sister concern unit namely M/s Layallpur Snack Foods. ETP provided by the industry consists of Equalization tank, O & G trap, Mixing Channel, Flash Mixer, Primary Tube Settler, Aeration Tank, Secondary Tube Settler, Collection tank Multi grade filter, Activated carbon filter, Sludge drying Beds, outlet. The industry has done major repair of its ETP and has made new mechanical fittings. The industry has now provided separate energy meter with ETP and also provided new mechanical flow meter at outlet to ETP.</p>
<p style="text-align: justify;">3. The industry has developed three plantation areas adjacent to its premises. Plantation area – 1 consists of 1.5 acres and condition of plantation is good. The industry has now provided proper distribution network for discharge of treated trade effluent. The industry has provided new saplings in plantation area - 2 consisting of about 1.2 acres. The industry has now provided new distribution network in plantation area -3 consisting of 2.5 acres. Condition of plantation in plantation area – 3 is good.</p>
<p style="text-align: justify;">4. The industry has installed one thermopack of capacity 08 Lac Kcal and has provided cyclone separator as APCD with the same. Wood is used as fuel in boiler section.</p>
<p style="text-align: justify;">Thus, the industry is now complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.</p>
<p style="text-align: justify;">Keeping the above in view, it is recommended as under:</p>
<p style="text-align: justify;">1. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 may be issued to the PSPCL Authorities for temporarily restoration of electricity connection for six months.</p>
<p style="text-align: justify;">2. Suitable amount of EC be imposed to the industry for earlier violations.</p>
<p style="text-align: justify;">3. Application of the industry for renewal of ‘Consent to Operate’ under the Water Act, 1974 and Air Act, 1981 may be granted for six months subject to suitable conditions alongwith special condition that:</p>
<p style="text-align: justify;">a) The industry shall operate its ETP properly & regularly</p>
<p style="text-align: justify;">b) The industry shall maintain proper record regarding operation of ETP.</p>
<p style="text-align: justify;">c) The industry shall make agreement regarding disposal of Municipal Solid Waste.</p>
