<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: 21.75pt; background: white;"><span style="font-size: 11.0pt; font-family: 'Calibri','sans-serif'; color: #5d5d5d; mso-bidi-language: PA;">It is submitted that the HCF was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/NWS/2018/7223246 dated 15.03.2018 <span style="mso-spacerun: yes;"> </span>valid upto 31.03.2022 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/NWS/2018/7223243 dated 15.03.2018 valid upto 31.03.2022, subject to the conditions mentioned therein. </span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: 21.75pt; background: white;"><span style="font-size: 11.0pt; font-family: 'Calibri','sans-serif'; color: #5d5d5d; mso-bidi-language: PA;">Now, the HCF has applied under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981) along with requisite documents. <span style="mso-spacerun: yes;"> </span>The HCF has deposited Rs. 12500/- vide UTR No. N307222189584397 dated 03.11.2022 under both Acts.<span style="mso-spacerun: yes;"> </span>The fee deposited by the HCF is adequate upto 31.12.2026. As per the new Bio Medical Waste Management Rules, 2016, the HCFs are not required to deposit authorization fees w.e.f. the date of issuance of the said rules i.e. 28.03.2016. The HCF has entered into an agreement with CBWTF. No action is pending against the HCE under the Bio-Medical Waste Management Rules, 2016. It is pertinent to mention here that a meeting of Core Committee was taken by the Hon’ble Chairman, PPCB on 19.03.2018 in the Committee Room, Head Office, Patiala and proceedings of the same have been received in this office through e-mail . In the said meeting, with regard to grant of authorization under BMW Rules, 2016 to the HCEs, it was decided as under: i) The Healthcare facilities upto 20 beds/ dental chairs, the documents to be obtained for getting authorization under the BMW Rules should be bare minimum i.e. location plan, agreement with CBWTF, self-declaration (To be specified by PPCB), copy of last month's manifests etc. ii) The fresh/renewal applications of HCFs' be processed online within one week without any prior inspection subject to submission of requisite documents by the HCFs'.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: 21.75pt; background: white;"><span style="font-size: 11.0pt; font-family: 'Calibri','sans-serif'; color: #5d5d5d; mso-bidi-language: PA;">The Regional Office will also ensure that no action regarding violation of the provisions of BMW Rules is pending against the HCF. Further, the competent authority of the Board has clarified vide no. HQ-3/EPA/2022/393-408 dated 06.06.2022 that bedded HCFs are required to comply with the standards prescribed under schedule-ll of the BMW Rules, 2016. In case, wastewater is discharged into a public sewer connected to the terminal STP, the bedded HCFs are required to meet general standards as notified under Environment (Protection) Act, 1986 </span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: 21.75pt; background: white;"><span style="font-size: 11.0pt; font-family: 'Calibri','sans-serif'; color: #5d5d5d; mso-bidi-language: PA;">The said HCF falls under the Jurisdiction of M.C Nawanshahr where terminal STP has already been installed and the HCF has submitted analysis report of wastewater issued by M/s NOIDA TESTING LABORATORIES, Mohali. As per which the parameters are meet up with the general standards as notified under Environment (Protection) Act, 1986 </span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: 21.75pt; background: white;"><span style="font-size: 11.0pt; font-family: 'Calibri','sans-serif'; color: #5d5d5d; mso-bidi-language: PA;"><span style="mso-spacerun: yes;"> </span> Keeping above in view, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 <span style="mso-spacerun: yes;"> </span>may be granted to the HCF upto 31.12.2026 subject to suitable conditions and specific conditions as under: -</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; mso-line-height-alt: 1.0pt; background: white;"><span style="font-size: 11.0pt; font-family: 'Calibri','sans-serif'; color: #5d5d5d; mso-bidi-language: PA;">1. The authorization is valid for 10 beds only.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; mso-line-height-alt: 1.0pt; background: white;"><span style="font-size: 11.0pt; font-family: 'Calibri','sans-serif'; color: #5d5d5d; mso-bidi-language: PA;">2. The HCF shall renew the agreement with the CBWTF well before its expiry.</span></p> |
