CTOW/Renewal/RPN/2019/11519749 dated 26/11/2019 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/RPN/2019/11519705 dated 26/11/2019, both are valid upto 30/06/2024<span style="color: black; mso-themecolor: text1;"> </span>for operation of screening cum washing plant for aggregates of different sizes @ 8000 CFT/Day and Sand @ 2000 CFT/Day subject to the suitable conditions mentioned therein.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Thereafter, the unit was issued show cause notice for the violations under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. 586 dated 17.03.2022 with an opportunity of personal hearing on 28.03.2022; however, no one on behalf of the unit attended the hearing and the unit was given an another opportunity of personal hearing on 13.04.2022.</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: 67.5pt; line-height: 150%; mso-pagination: none; mso-layout-grid-align: none; punctuation-wrap: simple; text-autospace: none; margin: 0cm 6.0pt 10.0pt 4.5pt;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">Further, the Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act 1981 was revoked/cancelled vide no. 1102 dated 27.04.2022 due to the non-submission of the mining certificate as per the decision no. 02 of the personal hearing held on 31.08.2021 in light of the instructions issued by the Board vide letter no. 16536 dated 23.07.2021 for processing the CTE/CTO applications for stone crushers/screening/washing plants.</span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: 72.0pt; line-height: 150%; mso-pagination: none; mso-layout-grid-align: none; punctuation-wrap: simple; text-autospace: none; margin: 0cm 6.0pt 10.0pt 4.5pt;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">Now, the unit has applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. </span><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">The industry has submitted the compliance report of previous consent granted to the unit, undertaking regarding code of practice & regarding legal mining and CA certificate dated 02.11.2022, wherein, the value of fixed assets of the industry as on 31.03.2022 is of Rs. 24.73 Lakhs with the value of plant and machinery of Rs. 19.57 lakhs. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">As per record file, the fee deposited by the unit was adequate upto 30.06.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. Now, the unit has deposited Rs. 9,000/- vide UTR No. YESIB23080014227 dated 04.11.2022 under the Water Act, 1974 and Rs. 9,000/- vide UTR No. YESIB23080014132 dated 04.11.2022 under the Air Act, 1981. As such, after deducting 50% penalty as late application fee, the fee is now adequate upto 31.12.2028 under the Water Act, 1974 and the Air Act, 1981 as per circular dated 29.10.2018.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">Further, it is pertinent to mention here that the Executive Engineer, Deptt. of Irrigation-Cum-Mining, Rupnagar through e-mail dated 20.10.2022 and the Executive Engineer, Deptt. of Irrigation-cum-Mining, Sri Anandpur Sahib vide no. 1005/Crusher dated 18.10.2022 has informed that there are 04 no. gravel mining sites operational in District Rupnagar i.e. Bhallan, Kotbala & Aaspur, Bari Haveli and Rasidpur Jindapur for obtaining raw material. The unit has submitted the slips of obtaining raw material from the approved mining site of District Rupnagar i.e. Bari Haveli de-silting site.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">The unit was visited by the AEE of this office on 25.11.2022 and Sh. Beant Singh, representative was contacted. During visit, it was observed as under:</span></p>

<p class="MsoBodyText" style="margin: 5.95pt 5.7pt 6pt 5pt; text-indent: 67pt; line-height: 150%; text-align: justify;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Tahoma;">In view of the above facts and letter issued by the Executive Engineer, Deptt. of Irrigation-cum-Mining, Sri Anandpur Sahib and e-mail received from Executive Engineer, Deptt. of Irrigation-cum-Mining, Rupnagar, if approved, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.09.2023, subject to the suitable conditions as mentioned in the previous consents granted to the unit and additional conditions as under:</span></p>

If the crusher owner gives the source from these sites then that is a valid source.</span></p>

No correspondence is received in this regard yet.</span></p>
