The industry is a packaged drinking water & soda unit which was granted consent to operate under Water Act, 1974 & Air Act, 1981 valid upto 30.09.2021.   The industry was visited on surprise basis on 10.08.2022 in order to verify compliance w.r.t. the manufacturing of single use plastic and other provisions of Water Act, 1974 & Air Act, 1981. During visit, following observations were made :- 1.     The industry was in operation as observed from outside of the industry. 2.     Inspite of repeatedly knocking outside the gate of the industry, the industry has not opened the gate deliberately. 3.     A lot of plastic glasses were found adjoining the industry which clearly signifies that the industry is either engaged in the manufacturing of banned single use plastic cups/glasses or filling of mineral water in the plastic cups.  The matter was also enquired from the nearby residents and they informed that the industry is engaged in the business of mineral water plastic cups under the brand name of “Oxy-g”   As such, the industry was engaged in the business of banned single use plastic and had deliberately restricted the entry of the officers of the Board during the visit.   Accordingly, the directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 were issued for closure of unit and the PSPCL authority have also been directed to disconnect electric connection of the industry.   Now, the industry has applied for consent to operate under Water Act, 1974 with a request to restore the electric supply of the industry. The industry has submitted written undertaking stating that the industry has completely dismantled the machinery for manufacturing of glasses and shall be manufacturing only bottled water in its premises from now onwards.    The site of industry was visited by the officer of the Board on 21.11.2022 and it was observed as under :- 1.    The industry was not in operation due to disconnection of electric supply. The electric connection of the industry has been disconnected vide TDCO no. 30/1693 dated 15.11.2022. 2.    The industry has completely dismantled the machinery for manufacturing of mineral water glasses and only bottled water machinery is there. 3.    The industry has installed two RO systems and RO permeate water and carbonated water (soda) being filled into plastic bottles. 4.    The consent to operate under Water Act, 1974 was earlier obtained by industry for discharge of RO reject onto land for irrigations (2100 Sq meter area). The land for irrigation provided by the industry is approx.. 2100 sq. meter which is adequate for holding discharge of RO reject waste water @ 15 KLD. 5.    Domestic effluent is discharged onto land for plantation through septic tank. 6.    The industry has installed submersible pump in its premises and was granted NOC from Central Ground Water Authority for ground water withdrawal, vide no. 21-4(344)/NWR/CGWA/2010-218 dated 10.03.2011. 7.    The industry has installed D.G set, in its premises, which is with canopy and adequate stack height. 8.    The industry has already submitted approved building plans from the approved person of the Directors of Factories, Punjab. 9.    The industry has already submitted the CLU issued by STP, Ludhiana vide no.715 dated 17.02.2011 which states that the site of the industry falls in Industrial Zone. 10. The industry has installed one no wood fired baby boiler of 500 kg/hr capacity alongwith cyclone seperator as APCD and stack of adequate height <span style="font-size: 12.0pt; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: #5d5d5d; mso-fareast-language: EN-IN; mso-bidi-language: PA;">  In view of above, it is recommended that :-   1.     Consent to operate under Air Act, 1981 may be granted to the industry for six months with special condition that the industry shall not manufacture single use plastic items banned by the Ministry of Environment Forest & Climate Change, Government of India. 2.     Directions u/s 31-A of Water Act, 1974 may be issued to PSPCL for restoration of electric supply to the industry temporary for six months. 3.     Environmental Compensation of suitable amount on best judgement assessment may be imposed on the industry as deemed fit by the competent authority.   Competency – Chairman of the Board
