It is submitted that the BKO was  granted Consent to Operate under the Air Act, 1981 vide no. CTOW/Varied/PTA/2022/19044963 dated 06/08/2022 under the Water (Prevention & Control of Pollution) Act, 1974 and vide no. CTOA/Varied/PTA/2022/19044961 dated 03/08/2022, both are valid upto 30/09/2026, for manufacturing of Bricks & Tiles @ 40000 Nos./day subject to certain conditions as mentioned therein.  The industry has submitted letter in which it has been mentioned that earlier the fee deposited by the industry is adequate upto 30.09.2030, however consent for granted upto 30.09.2026 and prayed this office to expend in the validity of consents. Now, the BKO has applied for obtaining renewal consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the under the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Bricks/ Tiles @ 40000 Nos./day by using Soil @ 10 Metric Tonnes/Day, Coal @ 3.0 Metric Tonnes/Day as raw material under orange category along with requisite documents. The industry had already deposited Rs. 18000/- vide Receipt No. SBIN421351082896 dated 17.12.2021 under the Water (Prevention & Control of Pollution) Act, 1974, Rs. 3600/- vide Receipt No. SBIN421351083858 dated 17.12.2021 penalty fee and Rs. 18000/- vide Receipt No. SBIN421351081433 dated 17.12.2021 as consent fee under the Air (Prevention & Control of Pollution) Act, 1981, Rs. 3600/- vide Receipt No. SBIN421351083648 dated 17.12.2021 penalty fee & Rs. 700/- vide Receipt No. SBIN421351083411 dated 17.12.2021 NOC regulation fee, which is adequate upto 30.09.2029, against the investment of Rs. 24.94 lakh as on 28.06.2022 as per CA certificate submitted by it. The industry has also submitted lease deed from 10.07.2021 to 09.07.2031.   The kiln has also submitted compliance report of consent conditions earlier granted to it under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along with requisite documents. It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry.   Punjab Pollution Control Board vide office order SEE(HQ-2)/2018/606 dated 18.12.2018 has issued directions as under: 1. The brick kilns which have adopted induced / high draft zig-zag technology certified by Punjab State Council for Science & Technology (PSCST) or other technology provider approved by the Punjab Pollution Control Board are allowed to operate their brick kilns in the State of Punjab. (Category – I). 2. The brick kilns which have adopted induced / high draft zig-zag technology but yet to obtain the completion / adequacy certificate from Punjab State Council for Science & Technology (PSCST) or other technology provider approved by the Punjab Pollution Control Board or to whom the provisional certificate has been given by the technology provider for making corrective measures, are allowed to operate their brick kilns in the State of Punjab, (Category – II). 3. The consent to operate to above brick kiln owners / brick kiln shall be granted with the following special condition: - a) Regular consent shall be granted to Category – I brick kilns and consent for shorter period of one year with condition to submit the final completion / adequacy certificate within three months shall be granted to Category-II brick kilns as mentioned above. b) The consent is subject to the orders passed by the Hon’ble High Court for the States of Punjab & Haryana/Hon’ble National Green Tribunal or other Judicial Authority in the cases pending or being filed with regard to the subject matter of the office order. c) The consent is subject to the performance evaluation of new technology adopted by the brick kilns. As the industry is complying with the provisions of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 as observed during previous visit. Keeping in view of the above, it is recommended that the renewal of  Consent to Operate may be granted to industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 upto 30.09.2029 for manufacturing of Bricks/ Tiles @ 40000 Nos./day by using Soil @ 10 Metric Tonnes/Day, Coal @ 3.0 Metric Tonnes/Day as raw material under orange category subject to the suitable conditions along with following special condition that: a)       The consent is subject to the orders passed by the Hon’ble High Court for the States of Punjab & Haryana / Hon’ble National Green Tribunal or other Judicial Authority in the cases pending or being filed with regard to the subject matter of the office order. b)       The consent is subject to the performance evaluation of new technology adopted by the brick kilns. c)       The brick kiln will pave moving area around the main brick kiln with the bricks to minimize the fugitive dust emissions. d)       The kiln shall provide sampling arrangement within one month, so that air emission sample may be collected by the Board.
