<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">It is intimated that the stone crusher was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/HSP/2022/17255597 dated 07.01.2022 valid upto 30.09.2023 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/HSP/2022/17255593 dated 07.01.2022, valid upto 30.09.2023 with conditions mentioned therein. </span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">It is further intimated the Mining Officer, Pathankot vide his office letter no. 466 dated 22.04.2022 informed this office that since the auctioned mining sites have been suspended by the Govt. of Punjab, so the stone crusher do not have legal source of raw material.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Accordingly, show cause notice for revocation of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981<span style="mso-spacerun: yes;"> </span>was issued to the stone crusher vide Board's letter no. 808 dated 25.04.2022 alongwith opportunity of personal hearing before the Environmental Engineer on 29.04.2022, wherein it was decided that:</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-pagination: none; mso-list: l0 level1 lfo1; mso-layout-grid-align: none; punctuation-wrap: simple; text-autospace: none; margin: 0in 6.0pt .0001pt 22.5pt;"><!-- [if !supportLists]--><strong style="mso-bidi-font-weight: normal;"><em><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span></em></strong><!--[endif]--><strong style="mso-bidi-font-weight: normal;"><em><span style="font-family: 'Tahoma','sans-serif';">The consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 to the stone crusher be revoked/ cancelled. </span></em></strong></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-pagination: none; mso-list: l0 level1 lfo1; mso-layout-grid-align: none; punctuation-wrap: simple; text-autospace: none; margin: 0in 6.0pt .0001pt 22.5pt;"><!-- [if !supportLists]--><strong style="mso-bidi-font-weight: normal;"><em><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span></em></strong><!--[endif]--><strong style="mso-bidi-font-weight: normal;"><em><span style="font-family: 'Tahoma','sans-serif';">The stone crusher shall not operate without obtaining consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and without having legal source of raw material. If found operational, action u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 will be initiated against the stone crusher for its closure without any further opportunity / Notice. </span></em></strong></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%; margin: 0in 1.35pt .0001pt 4.5pt;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Further, an FIR has also been lodged against the stone crusher for indulging in illegal mining.<span style="mso-spacerun: yes;"> </span>The copy of the FIR has been received in this office from SHO, Talwara vide letter dated 04.05.2022. </span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;"> </span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Thereafter, the consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981<span style="mso-spacerun: yes;"> </span>were revoked/cancelled vide no. 1140 dated 25.05.2022 and 1138 dated 25.05.2022 respectively and case was sent to Higher Authority to initiate action u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Accordingly, Competent Authority issued directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 that the Authorities concerned shall disconnect the supply of electricity available in the premises of the subject cited industry with immediate effect. In compliance of the directions the PSPCL Authorities disconnect the electric connection available in the industry vide TDCO 100019372308 Dated 28.09.2022.</span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Thereafter, the stone crusher was visited by officer of this office on 14.11.2022 and observed that the stone crusher was not in operation and lying closed to disconnect the electric connection. </span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Now, the stone crusher has applied for Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with requisite documents. The stone crusher has already deposited Rs. 14400/- vide Cheque no. 260772 dated 31.07.2020 under Air Act and Rs. 14400/- vide Cheque no. 260773 dated 31.07.2020 under Water Act. The fee deposited by the industry is adequate upto 30.09.2024 under both Acts after deducting NOC regularization fee. The industry has uploaded latest C.A certificate, compliance of earlier granted CTO under both Acts, copy of Mining Registration, which is valid upto 11.11.2023.</span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">In view of above, if approved, it is recommended that the application may be sent to Zonal Office, Jalandhar for getting the approval for: </span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-right: 1.35pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-IN;"><span style="mso-list: Ignore;">1)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Grant of consent to operate under Water Act and Air Act for six months with the condition that the stone crusher shall comply with the complete code of practice before commissioning of the operation of the stone crusher. </span></p>
