<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">It is submitted that the project proponent had earlier applied for fresh consent to establish (NOC) from pollution angle under orange category under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the establishment of commercial plots (plotting only) 63 in an area of 14932.9 sq.mt. under the name and style of “LA-MER” being developed by M/s K.S. Infracon Pvt. Ltd. alongwith requisite documents which may kindly be perused.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent had submitted a CLU letter issued by Regional Deputy Director-cum-Competent Authority, Local Govt., Patiala vide no. CLU/DDLG/PTL/2019/29462 dated 17.12.2019 change of land use for commercial project<span style="mso-spacerun: yes;"> </span>to K.S. Infracon Pvt. Ltd., Village Singhpura (Hadbast No. 43), Zirakpur subject to certain terms and conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent had submitted a copy of letter issued by Competent Authority-cum-Additional Deputy Commissioner (Urban Development), SAS Nagar vide no. LDC/CA-ADC(UD)/2021/03 dated 27.10.2021 to M/s K. S. Infracon Pvt. Ltd., Office SCO 235, Sec.-20, First Floor, Panchkula (Village Singhpura, PR-7, Zirakpur, Distt. S.A.S. Nagar) Colony at Village Singhpura, Zirakpur, Distt. S.A.S. Nagar (PB) (H.B. No. 43) for developing land as Commercial Colony in the name and style of Colony name “LA-MER” at Village Singhpura, Zirakpur (Total Area 17 Bigha 17 Biswa measuring 3.69 Acres) subject to certain terms and conditions mentioned therein and one special condition as under:</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; margin: 0in .25in 10.0pt .5in;"><strong><em><span style="font-family: 'Tahoma','sans-serif';">“The license granted under sub section (3), shall be valid for a period of five years and on such terms and conditions, as may be specified by the Competent Authority. This license is valid for a period of Five years commencing from 27.10.2021 & ending with 26.10.2026 and the license shall complete the development works within that period.”</span></em></strong></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent had submitted feasibility report of the project. As per feasibility report, the project proponent has proposed to install STP of capacity 60 KLD based on MBBR Technology. The proposed STP comprises of Bar Screen, Oil and grease trap, Collection-cum-equalization tank, MBBR Reactor, Settling Section, Chlorination, Multi Grade Sand Filter (MGSF) & Activated Carbon Filter (ACF). The project proponent has proposed to use treated domestic effluent / wastewater for gardening and for flushing recycling. The project proponent has submitted site plan of the project approved by competent authority.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the project proponent was granted consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2022/17329745 dated 05.01.2022 which is valid upto 11.11.2022 for establishment of Commercial Plotting Area Development Project for 63 Plots in an area of 14932.9 sqm under the name and style of “LA-MER” being developed by M/s K.S. Infracon Pvt. Ltd. subject to certain terms and conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent applied for obtaining fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for Commercial Plotting Area for 63 Plots in an area of 14932.9 sqm under the name and style of “LA-MER” being developed by M/s K.S. Infracon Pvt. Ltd. alongwith requisite documents which may kindly be perused.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent had submitted analysis report of the effluent samples (STP outlet), carried out NABL approved laboratory i.e M/s Interstellar Testing Centre Pvt. Ltd. on 04.06.2022, the conc. of the parameters was within the prescribed limits of the Board as tabulated below:</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">(STP Outlet)</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent had submitted completion certificate issued by M/s Shri Laxmi Engg. Works regarding installation and commissioning of STP of capacity 75 KLD to M/s LA-Mer by KS Group, Near D-Mart, PR-7, Airport Road, Zirakpur, Punjab. The project proponent had submitted dimensional drawing of the STP as well as feasibility report of the same.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent had submitted certificate/ ad interim permission granted by Punjab Water Regulation and Development Authority vide permission no. PWRDA/01/2022/L1/298 dated 17.01.2022 regarding permission of abstraction of ground water @ 20m<sup>3</sup>/day / 600m<sup>3</sup>/month subject to suitable terms and conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent has submitted an undertaking in which mentioned that:</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: normal;"><strong><em><span style="font-family: 'Tahoma','sans-serif';">“It is to be undertaken hat development work at Project site has just been completed. Since there is no occupancy at site at present, and that Solid waste will be generated only after that occupancy will take place in Project. Initially, bins will be provided in suitable count within the Project as per occupancy, due to very less strength in the beginning, as usual. It is assured that when substantial size of occupancy is in the Project, Mechanical Composter will be installed in the Project and all the Solid Waste of the project will be managed within the Project itself.”</span></em></strong></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the project proponent was issued show cause notice for refusal of consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 andthe Air (Prevention & Control of Pollution) Act, 1981 alongwith an opportunity to submit the reply within 7-days vide Board's letter no. 6231-32 dated 12.10.2022. The project proponent failed to submit the reply to the show cause notice issued.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 was refused vide Board’s letter no. CTOW/Fresh/SAS/2022/19982594 dated 27.10.2022 and under Air (Prevention & Control of Pollution) Act, 1981 was refused vide Board’s letter no. CTOA/Fresh/SAS/2022/19982560 dated 27.10.2022 due to various observations mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Now, the project proponent has applied for obtaining partial fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for Commercial Plotting Area for 35 Plots under the name and style of “LA-MER” being developed by M/s K.S. Infracon Pvt. Ltd. alongwith requisite documents which may kindly be perused</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent has deposited Rs. 282000/- vide UTR No. JAKAR52022081700084579 dated 17.08.2022 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 282500/- vide UTR No. JAKAR52022081700084320 dated 17.08.2022 under Air (Prevention & Control of Pollution) Act, 1981 including Rs. 500/- as FDF. The fee deposited by the project proponent is adequate for five years upto 22.09.2027 against the total cost of the project Rs. 4723.90 lacs as per latest CA certificate submitted by the project proponent.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry has submitted compliance report of the previous granted consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The site of the project as shown by the representative was visited by AEE of this office on 29.11.2022. During the visit, it was observed as under:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The site of the project proponent falls on L.H.S. of PR-7 Road (Zirakpur-Mohali).</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The civil construction work on numbers of plots is under progress. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">No occupancy / no commercial showroom completed till date. The project proponent has installed a STP based on bio-logical treatment on the back side entry of the project. No sewer is available in the vicinity of the project as on date. The project proponent has provided the fresh plantation in the form of Karnal Technology.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent advised to provide / instruct various commercial plot holders to provide dual plumbing system for reuse of treated effluent.</span></p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent has developed adequate plantation area in consonance to the partial consent applied for the discharge of treated effluent for plantation @ 14.5 KLD and for reuse for flushing purpose @ 15 KLD (Total 29.5 KLD).</span></p>
<p class="MsoNormal" style="margin-top: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">In view of the above, it is recommended that partial consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted 30.09.2026 subject to the suitable conditions and following additional conditions:</span></p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent shall use the treated effluent for onto land for plantation within its premises and shall partially use for flushing purpose by adopting dual plumbing provision in its project. The project proponent shall develop the plantation as per Karnal Technology in consonance to the occupancy of the project.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem on the nearby residential area.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter 305 kg/day) to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.</span></p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.</span></p> |
