<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; text-indent: 72pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">It is submitted that the industry was earlier granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/RPN/2020/12595790 dated 01/07/2020 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/RPN/2020/12595738 dated 01/07/2020, both of which were expired on 30/09/2021 for operation of crushing and stone crusher and screening cum washing of capacity @ 10,000 CFT/Day subject to the suitable conditions mentioned therein in the name of Sh. Andeep Singh Chahal, Proprietor. </span></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; text-indent: 72pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Thereafter, the unit has issued show cause notice for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. 994 dated 09.04.2021 with an opportunity of personal hearing on 19.04.2021, wherein, it was decided as under:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-bottom: 6pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The unit shall attend all the observations noted during the visit dated 18.12.2020 and shall submit compliance to this office within 10 days.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-bottom: 6pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">AEE to visit the unit in the 1<sup>st</sup> week of May, 2021 and to report the status of compliance w.r.t. code of practice from pollution angle for such units.</span></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; text-indent: 72pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Further, the unit was visited on 16.06.2021 and was found not complying with the code of practice stipulated for such units and consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 was revoked/cancelled vide letter no. 1631 dated 07.07.2021. Further, notice to issue directions u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 was issued vide ZO-I office letter endst no. 5308 dated 16.09.2021 to the unit with an opportunity of personal hearing on 28.09.2021, wherein, it was decided as under:</span></p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall take the following necessary measures:</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">a)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">Shall not operate its plant till adequate water and air pollution control measures are taken to comply with code of practice and the industry has valid consents of the Board under the Water Act, 1974 and the Air Act, 1981.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">b)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">Shall re-circulate the entire wastewater arising from the washing process.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">c)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">Shall ensure that the domestic effluent arising from its premises is discharged in plantation area after passing through septic tank.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">d)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">Shall ensure that the rubber chutes stand provided at the ends of the conveyer belts to control the dust emissions.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">e)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">Shall ensure that the water sprinkling system provided on the movement area and the ramp, is always operational to suppress the dust emissions.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">f)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">Shall ensure that the movement area is always stabilized with river bed material.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">g)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">Shall ensure to provide proper plantation along the boundary walls as per the norms mentioned in the code of practice.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">h)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">Shall apply for obtaining consent to operate of the Board under the Water Act, 1974 and the Air Act, 1981, alongwith requisite documents, within 07 days</span><span style="font-family: 'Bookman Old Style', 'serif';">.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">It was made clear to the representatives of the industry that if the unit is found in operation in violation of the provisions of the pollution control Acts/ Laws, during the visit at any time, legal action will be taken against the industry and the Environmental Compensation will be imposed, without giving any further notice/ opportunity</span><span style="font-family: 'Bookman Old Style', 'serif';">.</span></p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">EE, Regional Office, Rupnagar shall visit the industry to verify its contentions, various compliances, shall process the consent applications to be submitted by the industry and submit his detailed report with recommendations, keeping in view, the provisions of various pollution control Acts/Rules, within stipulated period.</span></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; text-indent: 72pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Now, the unit has applied for obtaining renewal of 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 in the name of Sh. Rajinder Pal, Partner (with change of proprietor ship documents) alongwith partnership deed, authorization letter, undertaking regarding code of practice and regarding legal mining, raw material slips from mining site Bhallan, compliance of previous consent and consent fee.</span></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; text-indent: 72pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">The unit has submitted an affidavit by Sh. Andeep Singh S/o Sh. Harbhajan Singh R/o Village Sanghwal, Kishangarh, Distt. Jalandhar, wherein, it has mentioned that Sh. Andeep Singh was not the proprietor of the unit and he was running the plant only. The unit has attached the patanama dated 26.12.2012 from which it is clear that the Sh. Rajinder Pal has taken the land on lease for 23.12.2032 on which the unit is established/running.</span></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; text-indent: 72pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">The unit has submitted the CA certificate dated 02.11.2022, wherein the value of fixed assets of the industry as on 31.03.2022 is of Rs. 47.69 Lakhs with the value of plant and machinery of Rs. 38.39 lakhs. As per record file, the fee deposited by the unit under the Water Act, 1974 and the Air Act, 1981 was adequate upto 30.09.2021. Now, the unit has deposited Rs. 11,600/- vide R No. 275054335 dated 10.11.2022 under the Water Act, 1974 and Rs. 11,600/- vide R No. 103394066 dated 10.11.2022 under the Air Act, 1981. As such, after deducting 200% penalty as late application fee, the fee deposited by the unit under the Water Act, 1974 and the Air Act, 1981 is adequate upto 30.09.2023 as per circular dated 29.10.2018. </span></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; text-indent: 72pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Further, it is pertinent to mention here that the Executive Engineer, Deptt. of Irrigation-Cum-Mining, Rupnagar through e-mail dated 20.10.2022 and the Executive Engineer, Deptt. of Irrigation-cum-Mining, Sri Anandpur Sahib vide no. 1005/Crusher dated 18.10.2022 has informed that there are 04 no. gravel mining sites operational in District Rupnagar i.e. Bhallan, Kotbala & Aaspur, Bari Haveli and Rasidpur Jindapur for obtaining raw material. The unit has submitted the slips of obtaining raw material from the approved mining site of District Rupnagar i.e. Bhallan de-silting site.</span></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; text-indent: 72pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">The unit was visited by the AEE on 22.11.2022 and Sh. Rajinderpal Singh, Partner<span style="color: red;"> </span>was contacted. During visit, it was observed as under:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-bottom: 6pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The unit is a Stone Crusher and Screening-cum-Washing Plant and was not in operation during visit. The unit has provided two no jaw crushers and two no. rotapactor for crushing and two no. screening washing plant. Further, the site conditions and un-availability of raw material also indicates that the unit has not been operated form quite some time.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 6pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The unit has provided foundation for installation of another rotapactor, however no conveyor belt has been connected to it. (Pic Attached in note)</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 6pt; text-align: justify; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';"> </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 6pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The Stone crusher machinery was covered with the tin sheets.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 6pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The unit has provided water re-circulation tanks for re-circulation of water for washing of aggregates.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 6pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The unit has provided rubber material chutes at the ends of the conveyor belts.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 6pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The unit has installed sprinklers on conveyor ends and the crushing machinery transfer points to stop the dust emissions.</span></p>

<p class="MsoBodyText" style="margin: 5.95pt 5.7pt 6pt 5pt; text-indent: 67pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">In view of the above facts and letter issued by the Executive Engineer, Deptt. of Irrigation-cum-Mining, Sri Anandpur Sahib and e-mail received from Executive Engineer, Deptt. of Irrigation-cum-Mining, Rupnagar, if approved, it is recommended that notice to issue directions u/s 31-A of the air Act and the 33-A of the water Act may be dropped and short term consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.03.2023, subject to the suitable conditions as mentioned in the previous consents granted to the unit and additional conditions as under:</span></p>

If the crusher owner gives the source from these sites then that is a valid source</span><span style="font-family: 'Bookman Old Style', 'serif';">.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0cm 5.65pt 0.0001pt 59pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span style="font-family: Wingdings;">Ø<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">Thereafter, vide e-mail dated 11.11.2022 received from Executive Engineer, Water Resources-cum-Mining Department, Rupnagar has sent a letter for Legal Source of Raw Material issued by the Principal Secretary Mines and Geology addressed to the Chairman PPCB. No correspondence is received in this regard yet</span><span style="font-family: 'Bookman Old Style', 'serif';">.</span></p>

If at any stage the unit engaged itself in illegal mining, the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 shall be revoked/cancelled without any opportunity of hearing.</span></p>
