The industry was granted varied consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/FGS/2018/7838521dated 30/07/2018, valid upto 30/09/2022 and under the Air Act, 1981 vide no. CTOA/Renewal/FGS/2020/13833191 dated 10/10/2020 valid upto 30/9/2024 for the manufacturing of Steel Ingots & Casting @ 54 T/day with suitable conditions.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; line-height: 115%; mso-pagination: widow-orphan; text-autospace: ideograph-numeric ideograph-other;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-weight: bold;"> The industry has applied for obtaining renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 with the requisite documents. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; line-height: 115%; mso-pagination: widow-orphan; text-autospace: ideograph-numeric ideograph-other;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-weight: bold;"> The industry has deposited consent fee of Rs. 22680/- under against total fixed assets of Rs. 348.02 Lakhs as on 05/08/2022 under the Water (Prevention & Control of Pollution) Act, 1974. The total consent fee is adequate upto 30/09/2024 after deducting penalty of 10%, as per the office order dated 29/10/2018.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; line-height: 115%; mso-pagination: widow-orphan; text-autospace: ideograph-numeric ideograph-other;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-weight: bold;"> There is an increase in cost of fixed assets by approx. Rs. 63 lakhs and the industry has deposited Rs. 2900/- as NOC Regularization fee which is adequate. The industry has submitted details of increase in the cost of fixed assets and has requested to grant consents upto 30/09/2024. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">It is further submitted that as per circular no. CEE (HQ)/F.No./957/2016/59 dated 02/02/2016, the case for renewal of NOC/Consent to operate for Orange & Green category industries is to be processed based on self-certification submitted by the industry to the effect that it is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">The industry has submitted compliance report of previous conditions of CTO granted to it under the said Act and has agreed that all the conditions imposed for code of practice notified by Govt. Notification no. 10/48/2004-STE (4) /932 dated. 15/10/2013 are being complied with.</span></p>
<p class="MsoNoSpacing" style="margin-bottom: 10.0pt; text-align: justify; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';"> Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoBodyText" style="line-height: 115%; margin: .15pt 35.65pt 12.0pt 70.9pt;"><strong><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">"The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."</span></strong></p>
<p class="MsoNoSpacing" style="margin-bottom: 10.0pt; text-align: justify; text-indent: -9.0pt; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-language: AR-SA;"> </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Cambria; mso-font-width: 115%;"> </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Further, PPCB has issued office order no. 443 dated 09.08.2021 with subject Auto 'Acknowledgement-cum- Renewal Certificate' for regulatory clearances has mentioned that in suppression of Board's office order no. SEE(HQ)/F. No. 957/2016/59 dated 02.02.2016 and to provide ease of doing business to the entrepreneurs, the Board in its 185th meeting held on 07.01.2021 has decided to extend the facility for auto generated renewal to all categories of small scale industries / projects, without inspection / physical verification of the environmental parameters at the time of submission of such application(s) subject to the certain stipulations.</span></p>
<p><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Cambria; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;"> </span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA; mso-bidi-font-weight: bold;">In view of above mentioned facts, if approved, Senior Environmental Engineer Zonal Office – II, Patiala may be recommended that the validity of the consent granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 may be renewed upto 30/09/2024 subject to suitable conditions and </span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Cambria; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;">special condition that t</span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;">his consent (if granted) granted to the to the industry based on the compliance report submitted by the industry, therefore, in case during the visit to the industry in future, the entire contents of the compliance report or any part of the said compliance report is found false and action shall be taken to revoke/ cancel this consent without issuance of any further notice/opportunity</span></p> |
