<span style="font-size: 11pt; font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">It is submitted as under:- 1.     <span style="font-size: 11pt; font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The brick kiln obtained CTO under the Air Act, 1981 on 16.12.2016 (valid up to 30.09.2026) with FCBTK technology and this consent was cancelled vide no. 641 dated 29.1.2020 due to non-adoption of induced draft zig zag technology as well as not depositing environmental compensation. 2.     <span style="font-size: 11pt; font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The brick kiln was issued show cause notice vide letter no. 1950 dated 26.5.2021 due to non-adoption of induced draft zig-zag technology. But, the brick kiln failed to submit any reply in the matter. 3.     <span style="font-size: 11pt; font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The brick kiln was visited by officer of the Board on 18.5.2022 and it was observed that the brick kiln has adopted induced draft zig-zag technology, was in operation and agricultural waste along with crushed coal was being used as fuel in the kiln. During visit, the representative of the industry was advised to apply for consent to operate of the Board under the Water Act, 1974 and the Air Act, 1981 and to deposit environment compensation to the Board. But the brick kiln failed to do the needful. 4.     <span style="font-size: 11pt; font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">Notice u/s 31-A of the Air Act, 1981 was issued vide Board's letter nos. 2596 dated 1.6.2022 to file reply / objections (if any) on the proposed directions. But the brick kiln failed to submit any reply in the matter as well as failed to apply for obtaining 'consent to operate' under the Air Act, 1981. T<span style="background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">he brick kiln was afforded an opportunity of personal hearing on 7.7.2022 before the CEE (B). But neither any representative of the brick kiln attended the hearing on 7.7.2022 nor submitted any reply in the matter. During the said hearing, CEE (B) observed that the brick kiln is in operation without obtaining consent of the Board under the Air Act, 1981 as well as using unauthorized fuel alongwith crushed coal in the kiln. Therefore, in such circumstances, the brick kiln cannot be allowed to operate. <span style="background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">As such, vide Board’s letter nos. 3728-30 dated 26.07.2022, directions u/s 31-A of the Air Act, 1981 were issued to the brick kiln for its closure and simultaneously, directions were also issued to DFSC for immediately cancellation of license of the brick kiln with a copy to Director, Food, Civil Supplies & Consumer Affairs. 5.     Now, the brick kiln has applied for obtaining fresh consent to operate under the Water Act, 1974 and varied consent to operate under the Air Act, 1981 along with completion certificate dated 09.06.2022 via drawing no. 21/034 issued by M/s CSIR-CBRI, Roorkee. The brick kiln is on lease till 14.09.2030 and has submitted a new partnership deed. The brick kiln has submitted an declaration that it operated with FCBTK technology for months of February 2019 and March 2019 and has not fired after 31.03.2019 along with that the brick kiln used agro fuels /bio mass products. The undertaking is attested by a C.A. 6.      The kiln has deposited Rs. 50,000/- as EC vide R. No. 92/5446 dated 17.11.2022 for the period of its operation for the month of February 2019 to March 2019. 7.     The consent fee deposited by the brick kiln is adequate for period up to 30.09.2030 & 30.09.2031 under the Water Act, 1974 and the Air Act, 1981 respectively along with    directions u/s 31-A of the Air Act, 1981 to DFSC authorities for restoration of license of the brick kiln.        Recommended as proposed by EE,RO, Faridkot.   Competency:- CEE
