<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">It is intimated that the stone crusher was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/HSP/2021/17617618 dated 28.12.2021 valid upto 30.09.2023 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/HSP/2022/17255593 dated 28.12.2021, valid upto 30.09.2023 with conditions mentioned therein. </span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">It is further intimated the Mining Officer, Pathankot vide his office letter no. 466 dated 22.04.2022 informed this office that since the auctioned mining sites have been suspended by the Govt. of Punjab, so the stone crusher do not have legal source of raw material.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Accordingly, show cause notice for revocation of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981<span style="mso-spacerun: yes;"> </span>was issued to the stone crusher vide Board's letter no. 801 dated 25.04.2022 alongwith opportunity of personal hearing before the Environmental Engineer on 29.04.2022, wherein it was decided that:</span></p>

If found operational, action u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 will be initiated against the stone crusher for its closure without any further opportunity / Notice. </span></em></strong></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%; margin: 0in 1.35pt .0001pt 4.5pt;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Further, an FIR has also been lodged against the stone crusher for indulging in illegal mining.<span style="mso-spacerun: yes;"> </span>The copy of the FIR has been received in this office from SHO, Talwara vide letter dated 04.05.2022. </span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;"> </span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Thereafter, the consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981<span style="mso-spacerun: yes;"> </span>were revoked/cancelled vide no. 1146 dated 25.05.2022 and 1148 dated 25.05.2022 respectively and case was sent to Higher Authority to initiate action u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Accordingly, Competent Authority issued directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 that the Authorities concerned shall disconnect the supply of electricity available in the premises of the subject cited industry with immediate effect. In compliance of the directions the PSPCL Authorities disconnect the electric connection available in the industry vide TDCO 23 Dated<span style="mso-spacerun: yes;"> </span>07.09.2022.</span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Now, the stone crusher has applied for Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with requisite documents. The industry has already deposited Rs. 18900/- Ch. no. 006504 dated 07.12.2018 under Air Act, Rs. 18900/- Ch. no 006505 dated 07.12.2018 under Water Act, Rs. 1800/- Ch. No. 0006506 dated 07.12.2018 penalty fees and Rs. 500/- vide receipt No. 006507 dated 07.12.2018 as an application fee and Rs. 30000/- vide cheque no. 000397 dated 11.12.2020 under Air Act, Rs. 30000/- vide cheque no. 000398 dated 11.12.2020 under Water Act and Rs. 8400/- vide cheque no. 000399 dated 11.12.2020 as NOC Regularization fee and Now deposited Rs. Rs. 8400/- vide Cheque dated 23.12.2021 as NOC Regularization fee. The fee submitted by the industry is adequate upto 31.12.2023. The industry has uploaded latest C.A certificate, compliance of earlier granted CTO under both Acts, copy of Mining Registration, which is valid upto 16.11.2023.</span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; mso-ansi-language: EN-IN;">Thereafter, the stone crusher was visited by officer of this office on 25.11.2022 and observed that the stone crusher was not in operation and lying closed due to disconnecting of the electric connection.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="margin-right: 1.35pt; text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">In view of above, if approved, it is recommended that the application may be sent to Zonal Office, Jalandhar with the following recommendations: </span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-right: 1.35pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-IN;"><span style="mso-list: Ignore;">1)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">Grant of consent to operate under Water Act and Air Act for six months with the condition that the stone crusher shall comply with the complete code of practice before commissioning of the operation of the stone crusher. </span></p>
