<p><span lang="EN-US">RO has reported that </span><span lang="EN-US">the above industry is a Service Station (Mohindra Make) established and commissioned without obtaining NOC/Consents of the Board and falls under Orange Category of the categorization of the industries. The subject cited service station was visited by the officer of this Board on 27/04/2021 and observed that the service station was in operation during the visit and engaged in sale, servicing and washing of four wheelers vehicles. The service station has provided ETP for treatment of washing effluent. However, during visit, same was not in operational condition. The untreated effluent from the service station was found discharged outside into the drain along the road. The domestic effluent generated is discharged into septic tank. The service station has installed one no. D.G. set with canopy. The report in this regard has been sent to Zonal Office, Amritsar through e-noting-(16742756).</span></p>
<p><span lang="EN-US"> The service station was given opportunity of the personal hearing held before the Senior Environmental Engineer at Amritsar on 27/10/2021, in reference to Show Cause Notice for violations of consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, it was decided that :-</span></p>
<p>1. A Bank Guarantee of Rs. 50,000/- has been imposed as an assurance to comply with the Environment Pollution Control Laws. The industry shall submit the same within 07 days period.</p>
<p>2. The Auto service station shall apply for the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and submit their compliance before reopening of the plant & machinery.</p>
<p>3. EE, RO shall collect treated waste water sample and get it analysed from Board’s Lab and submit its compliance report after 01 month period. </p>
<p><span lang="EN-US"> Now the service station has applied for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 for the operation of Service Station. The case has been scrutinized and following clarification was sought:-</span></p>
<p><span lang="EN-US">1. </span>Approved Building Plan endorsed by approved architect under Factory Act, 1948.</p>
<p><span lang="EN-US">2. </span>Land Documents such as registry/jamabandi.</p>
<p><span lang="EN-US">3. </span>Land use certificate issued by MC, Pathankot for establishment of orange category industry.</p>
<p><span lang="EN-US">4. </span>Completion Certificate of ETP.</p>
<p><span lang="EN-US">5. </span>Plan of recirculation of effluent. If effluent is discharged after treatment, then permission for discharged into sewer from MC or plantation area plan.</p>
<p><span lang="EN-US">6. </span>The consent fee are only adequate upto 30/09/2022 after deducting previous year fee and penalty. Also NOC regularization fee is required.</p>
<p>But no reply has been submitted by the service station.</p>
<p><span lang="EN-US"> The industry has deposited Rs. 1,63,800/- vide UTR No. 010116927911 dated 14/09/2022 & Rs. 1,63,800/- vide UTR No. 010116927912 dated 14/09/2022 as consent to operate fee under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 which is adequate upto 31/12/2022 including Rs. 500/- as Form downloading fee against total gross value of fixed assets worth Rs. 3,72,35,755/- as on 31/07/2021. The consent fee are adequate upto 30/09/2022 only.</span></p>
<p><span lang="EN-US"> The project proponent has submitted documents, which are enclosed along with the application, which may kindly be perused. The industry has submitted a copy of issued from PSPCL Bill issued by Punjab State Power Corporation, Pathankot, according to which the Service Station is running since May-2011, however, the service station has not attached any approved Building Plan for the MC, Pathankot.</span></p>
<p><span lang="EN-US"> The industry was visited by AEE of this office on 27/10/2022 and observed as under:-</span></p>
<p><span lang="EN-US">1. </span><span lang="EN-US">The industry was in operation during the visit and is engaged in the process of sale, service & repair of four wheelers.</span></p>
<p><span lang="EN-US">2. </span><span lang="EN-US">Washing of vehicles was being carried out during the visit.</span></p>
<p><span lang="EN-US">3. </span><span lang="EN-US">The effluent was being collected in collection tank.</span></p>
<p><span lang="EN-US">4. </span><span lang="EN-US">However, no discharge was found being made outside the premises during the visit.</span></p>
<p><span lang="EN-US">5. </span><span lang="EN-US">The service station has installed ETP based on physiochemical treatment. The approach to the ETP was blocked by scrap and vehicles (Picture Enclosed).</span></p>
<p><span lang="EN-US">6. </span><span lang="EN-US">The condition of the ETP indicated that it is not operated regularly.</span></p>
<p><span lang="EN-US">7. </span><span lang="EN-US">No sludge was found drained in collection pit below the tube settler. Further indicating that ETP is not operated.</span></p>
<p><span lang="EN-US">8. </span><span lang="EN-US">No flow meter and energy meter is provided on the ETP.</span></p>
<p><span lang="EN-US">9. </span><span lang="EN-US">A lot of waste oil and waste oil filters were found stored with general waste in open (Picture Enclosed).</span></p>
<p><span lang="EN-US">10. </span><span lang="EN-US">As per the representative waste and waste oil filters are sold off to unauthorized persons.</span></p>
<p><span lang="EN-US">11. </span><span lang="EN-US">The service station has also painting facility. The representative could not explain the fate of paint sludge.</span></p>
<p><span lang="EN-US">12. </span><span lang="EN-US">The service station has not deposit the Bank Guarantee of Rs. 50,000/-.</span></p>
<p><span lang="EN-US">13.</span> <span lang="EN-US">The report regarding above violations was sent to E-noting no. 16742756. (Agenda note is also attached herewith).</span></p>
<p><span lang="EN-US"><span lang="EN-US">RO has recommended that show cause notice for refusal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be issued to the service station along with the opportunity of personal hearing before the competent authority . </span></span></p>
<p><span lang="EN-US"><span lang="EN-US">May if approved, SCN for refusal of CTO under WA and AA be issued for 07-days, please. </span><span lang="EN-US"> </span></span></p> |
