CTOA/Fresh/FGS/2017/6718841 dated 17/11/2017 both valid upto 30/09/2022 </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast;">for the manufacturing of Flat, Angles, Rounds, Squares etc. @ 25 T/day under <strong>Orange category</strong>.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast;">Now, the industry has applied for obtaining varied consent to operate under Water Act, 1974 and the Air Act, 1981 with requisite documents. The industry has already deposited of Rs. 25840/- vide R no.<span style="mso-spacerun: yes;"> </span>966561458 dated 01/11/2022 on account of Water consent fee and Rs. 39440/- vide R no. 425590002 dated 01/11/2022 on account of Air consent fee against the un-depreciated fixed assets of Rs. 413.1 Lacs as on 25/08/2022 as per CA certificate dated 02/09/2022 which is adequate upto <strong>30/09/2023</strong> as per Board's Office Order dated 29/10/2018 after deducting NOC regularization charges and penalty charges 10%. The industry has submitted detail of increase in fixed assets. From which, it is clear that the industry has added land in year 2017-19 and upgradation of rolling mill with new stands, shearing machine cooling bed etc leading to higher efficiency and increased capacity. Further, it has also increased its production capacity 5 times without even obtaining 'consent to establish' (NOC) from the Board. </span></p>

<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast;">Further, the industry has submitted that it has increased its production capacity 5 times by increasing the size of reheating furnace during conversion of fuel from Coal to PNG in the month of <strong>April 2022</strong>. </span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Calibri;">It is intimated that Hon’ble NGT while considering the issue of Polluting activities in Mandi Gobindgarh in the matter of OA no. 924/2019 titled as Neeraj Goyal Vs State of Punjab vide order dated 01-10-2020 has directed as under: </span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><strong><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Calibri;">“In the context of directions to shift rolling mills from coal to PNG we direct the State PCB to ensure that if such shifting does not take place, the non-compliant units be closed till compliance. This should apply not only to rolling mills but also to other similarly placed industries operating on coal. Wherever there is non compliance, the State PCB may take coercive measures, including closure, recovery of compensations and initiating prosecution, following due process of laws.” </span></em></strong></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Calibri;">Accordingly, Punjab Pollution Control Board has issued directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 to all the industrial units (not only Rolling Mills) operating on coal as fuel in Mandi Gobindgarh as under: </span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Calibri;">“That all the industrial units in Mandi Gobindgarh operating on coal as fuel in any form shall shift from coal to PNG on or before 31-12-2020.”</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Calibri;">As the industry had not submitted the compliance of above said directions, therefore it was issued show cause notice for cancellation consent to operate under Air Act, 1981 vide Zonal Office-II, Patiala letter no. <strong>502 dated 09/02/2021. But, in these cases, Competent Authorities has decided that RO is empowered to decide small scale green category CTOs/CTEs at its own level as per prevailing policy of the Board vide E-office file no. PPCB-AG023/1/2021-ENV ENGG FGS vide note dated 26/05/2021.<span style="mso-spacerun: yes;"> </span></strong></span></p>

<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 115%; margin: 12.0pt -.9pt 12.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">It is intimated that CPCB has already issued modified directions u/s 18(1)b of the Water Act, 1974 & the Air-Act, 1981 regarding Harmonization of Classification of Industrial sectors under Red/Orange/Green/White categories vide its letter no. B 29012/ESS/CPA/2015-16/85-84 dated 7.3.2016 alongwith the "Final document on revised classification of Industrial sectors under Red, Orange, Green & White categories" which also includes the consent period for which the consents are to be granted to Red, Orange and Green category industries for 5 years, 10 years and 15 years respectively. Further, Board vide Head Office letter no. SEE(HQ-2)/2018/ 9982-10003 dated 27/08/2018 has directed to strictly follow the consent validity criteria for Red, Orange and Green category industries as mentioned in the modified directions issued by CPCB u/s 18(1)b of the Water Act, 1974 & the Air Act, 1981 i.e. consent to Red, Orange and Green category industries may be granted for 5 years, 10 years and 15 years respectively. But, in the subject cited case, the industry has deposited consent fee only <strong>upto 30/09/2023.</strong></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 115%; margin: 12.0pt -.9pt 12.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">It is pertinent to mentioned here that a meeting was taken by the Hon'ble Chairman with the officers of the Board on 29/01/2021 at 11:00 AM in the Committee Room, Head Office, Patiala, wherein, it was decided that Consents to operate be issued to the industries for longer duration as per protocol laid down by the Board and more emphasis shall be laid on the monitoring.</span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Raavi;"><span style="mso-tab-count: 1;"> </span></span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify;"><strong><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Further, MoEF&CC has issued notification no. S.O. 3250(E) on 20.07.2022, which is reproduced as under:</span></strong></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">"Whereas, the Hon’ble National Green Tribunal vide its order, dated the 12th February, 2020, in Original Application No. 55/2019 (WZ), (Gajubha Jesar Jadeja vs Union of India &Ors.), has inter alia observed that Cold Rolled Stainless Steel Manufacturing Industries require prior environment clearance but, having regard to the fact that there were a large number of such mills operating on the strength of Consent to Establish (CTE) and Consent to Operate (CTO), the Hon’ble Tribunal has held that opportunity should be provided to such units to fall within the Environment Clearance regime by granting a period of at least one year to operate for the purpose.</span></em></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">And whereas, the Central Government, keeping in view the impact caused due to the Covid19 pandemic has taken a considered decision in line with the above said order of the Hon’ble National Green Tribunal, so as to provide a window period for such re-rolling or cold rolling units to obtain prior Environmental Clearance.</span></em></p>
<p class="MsoNormal" style="text-align: justify;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">And whereas, the Central Government is of the view that steel re-rolling operations fall under the purview of the secondary metallurgical processing industry and require Environment Clearance as per item 3(a), relating to Metallurgical Industries (Ferrous and Non-ferrous), of the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide notification number S.O. 1533 (E), dated the 14th September, 2006, mandating the requirement of prior environmental clearance for the projects covered in its Schedule (hereinafter referred to as the said notification), wherein all non–toxic secondary metallurgical processing units with capacities greater than 5000 tonnes/annum (TPA) fall under category B.</span></em></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Now, therefore, in exercise of the powers conferred by section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby directs that all the standalone re-rolling units or cold rolling units, which are in existence and in operation as on the date of this notification, with valid Consent to Establish (CTE) and Consent to Operate (CTO) from the concerned State Pollution Control Board or the Union territory Pollution Control Committee, as the case may be, shall apply online for grantof Terms of Reference (ToR) followed by Environment Clearance and the said units shall be granted Standard Terms of Reference as per item 3(a) of the said notification and shall be exempted from the requirement of public consultation:</span></em></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Provided that the application for the grant of ToR shall be made within a period of one year from the date of this notification. </span></em></p>
<p class="MsoNormal" style="text-align: justify;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">2. This notification shall come in to force from the date of its publication in the Official Gazette. "</span></em></p>

<p class="MsoListParagraph" style="text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo3; margin: 0in -.9pt 12.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">b.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Raavi;">Environmental Engineer, Regional Office, Fatehgarh Sahib/ SGR be directed to convey the aforesaid notification to all the re-rolling/cold rolling units to apply online for grant of Terms of Reference (ToR) followed by Environment Clearance and submit compliance at Regional Office.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 115%; margin: 12.0pt -.9pt 12.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Raavi;">And, Regional Office has been directed to grant 'consent to operate' in such cases <strong>upto 19.07.2023.</strong></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 115%; margin: 12.0pt -.9pt 12.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Raavi;">Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -4.5pt; line-height: 115%; margin: 0in 0in 12.0pt 4.5pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Raavi;"><span style="mso-tab-count: 3;"> </span><strong>The Board shall continue to grant consent to</strong> <strong>establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries</strong>.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Arial;">In view of above, it is therefore recommended that:</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><strong><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Arial;">1</span></strong><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Arial;">. The industry may be granted varied </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">consent to operate under the Water Act, 1974 & Air Act, 1981 <strong>upto 19/07/2023</strong><strong style="mso-bidi-font-weight: normal;"> </strong>to the industry with suitable conditions and special conditions that:</span></p>

<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-indent: -27.0pt; line-height: 115%; mso-pagination: widow-orphan; mso-list: l3 level1 lfo1; text-autospace: ideograph-numeric ideograph-other; margin: 0in 0in 12.0pt 27.0pt;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">k)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Calibri;">The industry shall depute skilled manpower to operate rolling mills based on PNG.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-indent: -27.0pt; line-height: 115%; mso-pagination: widow-orphan; mso-list: l3 level1 lfo1; text-autospace: ideograph-numeric ideograph-other; margin: 0in 0in 12.0pt 27.0pt;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">l)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Calibri;">The industry shall provide thick plantation of spreading crown varieties of evergreen trees all along the boundary wall of the industry.</span></p>
