Earlier the unit was operating at Sua Road, B/S Ravi Dharam Kanda, Dhandari Kalan Ludhiana and was granted Consent to Operate under Water Act,1974 and Air Act,1981 both valid upto 30.6.2021. Thereafter, the industry has closed the wet process at its earlier location and has shifted to the above location i.e. Hira Estate, Kanganwal , Industrial Area-C, Ludhiana.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman';"><span style="mso-tab-count: 2;"> </span>The industry had applied for fresh consent to operate under Water Act,1974 and Air Act,1981 for the new location Hira Estate, Kanganwal , Industrial Area-C, Ludhiana i.e. The industry had cancelled the earlier agreement and has made agreement with CETP operator for the shifted premises @12000 Ltrs./month. The industry had submitted Building plan by architect approved by Director of Factories, Punjab dated 16.10.2022. The industry had submitted a copy of registry dated 5.11.2018 <span style="mso-spacerun: yes;"> </span>as a proof of date of commissioning. The industry had deposited consent fees valid upto 30.06.2024. </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman';"><span style="mso-tab-count: 2;"> </span><span style="text-transform: uppercase;">a</span>ccording, the industry was granted consent to operate under Air Act, 1981 vide no. CTOA/Fresh/LDH2/2022/20140397 dated 15/11/2022 valid upto 30/06/2024. Application for consent to operate under Water Act, 1974 was refused due to the reasons that the industry has cancelled earlier agreement made with CETP Operator for lifting of trade effluent @ 4000 Ltr/month and has now made agreement with CETP operator for lifting of trade effluent @ 12000 Ltrs./month. </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman';"><span style="mso-tab-count: 1;"> </span>“M/s JBR Technologies Limited, D-260-61, Phase-8, Focal Point, Ludhiana was given personal hearing before Chairman of the Board on 11.09.2020 and proceedings of hearing were issued vide Board’s letter no. 9078 dated 19.10.2020, wherein the CETP operator was directed that no new/ revised agreements will be made without Consent to Establish/ Consent to Operate of the Board and Ludhiana Effluent Treatment Society (LETS) shall issue letter of intent to the new members/ existing members which seek revision in agreements clearly delineating the balance capacity available with the CETP, which will form the basis for issuance of Consent to Establish/ Consent to Operate to the electroplating/surface coating units by the Board. The Board has yet not allowed operator of the CETP to make new/ revised agreements for the collection of untreated effluent”. </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman';"><span style="mso-tab-count: 1;"> </span><span style="mso-tab-count: 1;"> </span>Now, the industry has re-applied the consent to operate under Water Act, 1974 through OCMMS for generation of trade effluent @ 4000 Ltr/month. The industry has submitted written undertaking stating that </span></p>
<p class="MsoNormal" style="text-align: justify;"><strong><em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman';">“1. We earlier had a unit i.e m/s babbu exports, sua road, b/s ravi dharam kanda , dhandari kalan, ludhiana and we have completely closed its plating process in the industry due to lack of demand in the market during covid times.</span></em></strong></p>
<p class="MsoNormal" style="text-align: justify;"><strong><em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman';">2. Our earelier unit has made agreement with m/s jbr cetp @4000ltr / month. </span></em></strong></p>
<p class="MsoNormal" style="text-align: justify;"><strong><em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman';">3. When we shifted to our new location at kanganwal, we went to the cetp operator and made an agreeemnt with jbr@12000 ltr/ month considering the future scope of expansion. </span></em></strong></p>
<p class="MsoNormal" style="text-align: justify;"><strong><em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman';">4.When we went to jbr tech for shifting of agreement , we were not told by anyone there that we can not make agreeemnt of more capacity. we were not aware of the fact that. we can not make agreement of more quantity with jbr. </span></em></strong></p>
<p class="MsoNormal" style="text-align: justify;"><strong><em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman';">5. Our effluent generation is currently lass than 4000ltr/ month and we have also shown record to your officer during the visit . we have only transferred the same tanks for plating process from our earlier industry and have not added any new machinery. </span></em></strong></p>
<p class="MsoNormal" style="text-align: justify;"><strong><em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman';">6. However , we made agreement of mopre capacity based on future expansion . if jbr would have told us that we are not eligible for agreement of more effluent , we have never made it. sir , as our effluent is well within 4000 ltr / month it is requested to kindly grant us consent for 4000 ltr/ month only”</span></em></strong></p>
