CTOA/Renewal/SGR/2017/5363180 dated 17/04/2017, valid up to 30/09/2026&nbsp;for manufacture of Bricks / Tiles @ 25000 Nos/day, with certain conditions mentioned therein.</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-size: 13.5pt; font-family: Verdana, 'sans-serif'; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">&nbsp;Central Pollution Control Board, New Delhi vide its letter no. 489 dated 28.06.2017 has issued following directions under section 18 (1b) of the Air Act, 1981 to Punjab Pollution Control Board for improving the quality of ambient air: - i. All the brick kilns operating without permission and valid consent from SPCBs, not meeting/prescribed norms and siting guidelines be closed down with immediate effect. ii. Provide status on conversion of natural draft to induced draft brick kiln (with rectangular kiln shape and zigzag brick setting). iii. Enforce strictly the siting criteria guideline for brick kiln. iv. All the moving area around the main brick kiln should be paved with the bricks to minimize the fugitive dust emissions from the brick kiln operations. This condition on should be incorporated in the consent condition, while granting the consent by the respective State Boards. v. Ensure that fine dust not to accumulate all around the brick kiln. Further the Head Office vide letter no. SEE(HQ-2)/2017/1043 dated 08.11.2017 has decided that: - &ldquo;Whereas, the Central Pollution Control Board (CPCB) vide its letter No. IPC V (SSI)/Brick kiln/2017/4897 dtd. June 27, 2017 has issued directions u/s 18(1)(b) of the Air (Prevention &amp; Control of Pollution) Act, 1981 to the Punjab Pollution Control Board regarding conversion of the brick kilns working on natural draft to induced draft with rectangular kiln shape and zig-zag brick setting, so as to have effective control over the air pollution caused by the brick kilns. The Punjab State Council for Science &amp; Technology (PSCST) has developed an Induced Draft Technology with zig- zag firing for the brick kilns which has been approved by the Board vide its letter no. SEE (HQ - 2)/2017/34596 dated 24.8.2017. The Board vide its order no. 6383 dt. 26.02.2018 has also authorized M/s Team Energy Systems to provide the CBRI, Roorkee developed high draft technology with zig-zag firing to the brick kilns in the state of Punjab subject to the condition that completion cum adequacy certificate shall be issued by CBIR, Roorkee for the purpose of issuance of Consent to Operate under Air Act, 1981 by the Board to the Brick kilns. In pursuance to order dated 30.11.2018 passed by the learned Appellate Authority constituted by the State Government under the provisions of Air (Prevention &amp; Control of Pollution) Act, 1981 has passed the order that the BKO which have adopted induced / high draft zigzag technology certified by Punjab State Council for Science &amp; Technology or other technology provider approved by the PPCB are allowed to operate their brick kilns in the State of Punjab (Category-I). Now, as per Board&rsquo;s office order no. SEE (HQ-2)/2018/606 dated 18.12.2018, the Board has partially amended the directions issued earlier as following: - 1. The brick kilns which have adopted induced / high draft zig-zag technology certified by Punjab State Council for Science &amp; Technology (PSCST) or other technology provider approved by the Punjab Pollution Control Board are allowed to operate their brick kilns in the State of Punjab. (Category-I) 2. The brick kilns which have adopted induced / high draft zig-zag technology but have yet to obtain the completion / adequacy certificate from Punjab State Council for Science &amp; Technology (PSCST) or other technology provider approved by the Punjab Pollution Control Board OR to whom the provisional certificate has been given by the technology provider for making corrective measures, are allowed to operate their brick kilns in the State of Punjab. (Category-II) 3. The consent to operate to above brick kiln owners / brick kiln shall be granted with following special condition: - a) Regular consent shall be granted to Category-I brick kilns and consent for shorter period of one year with condition to submit the final completion / adequacy certificate within three months shall be granted to Category-II brick kilns as mentioned above. b) The consent is subject to the orders passed by the Hon&rsquo;ble High Court for the States of Punjab &amp; Haryana / Hon&rsquo;ble National Green Tribunal or other Judicial Authority in the cases pending or being filed with regard to the subject matter of the office order. c) The consent is subject to the performance evaluation of new technology adopted by the brick kilns. In recent time, the proceedings of the meeting was taken by the Chairman of the Board with the Punjab Brick Kiln Association were conveyed vide Board's letter no. PPCB/SEE(HQ-2)/2020/ 6676-77 dated 27.02.2020, wherein, it was decided as under: (1) The Regional Office of the Board are required to impose charge environmental compensation from the brick kiln owners from 01.02.2019 to 30.09.2019 for the period for which the brick Kilns are actually operated (without converting to the induced draught technology) (2) In case brick in is not operated after 30.06.2019 due to rainy but the same brick kiln started its operations later on but without converting to induced draught technology, then environmental compensation will be levied for full period till the adoption of zig-zag&nbsp;technology. Since the Brick kilns are generating and discharging very nominal quantity of domestic effluent and are of small scale, as such, the request of the association for exemption of fee for consent under the Water (Prevention &amp; Control of Pollution) Act, 1974 be accepted and may be made applicable w.e.f 1.11.2018, subject to the ex-post facto approval of the Board. Following document shall be obtained from the BKOs to ascertain the actual period of operation of the kiln a) The Coal Register duly signed by the BKOS and getting an undertaking to the effect that the entries made in the Coal Register are true &amp; correct may be taken as a documentary evidence The documents as mentioned above are to be authenticated by the Chartered Accountant.</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-size: 13.5pt; font-family: Verdana, 'sans-serif'; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Now, the brick kiln has applied for varied consent to operate under the Air (Prevention &amp; Control of Pollution) Act, 1981 and fresh Consent to operate under Water Act, 1974 under Orange category for manufacturing of Bricks / Tiles @ 25,000 Numbers/Day. The brick kiln has submitted compliance report of the conditions of the consent earlier granted to it under the Air (Prevention &amp; Control of Pollution) Act, 1981, latest CA certificate, CA report regarding non-operation of kiln along with coal/production record. The kiln has submitted the feasibility report of CBRI,&nbsp;Roorkee&nbsp;and completion certificate issued dated 30/12/2019. The BKO was not operated during the period 01.02.2019 to 30/12/2019 and attached the certified copies for stock of coal from Chartered Accountant for the period 01.02.2019 to 30/12/2019.&nbsp;&nbsp;Accordingly, the brick kiln was visited by undersigned on&nbsp;28/11/2022&nbsp;and it was observed as under:-</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-size: 13.5pt; font-family: Verdana, 'sans-serif'; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">1. The brick kiln was not in operation.</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-size: 13.5pt; font-family: Verdana, 'sans-serif'; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">2. The Brick kiln has adopted induced draft technology for the manufacturing of bricks and has submitted completion certificate issued by CBRI</span><span style="font-size: 13.5pt; font-family: Raavi, 'sans-serif'; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">,</span><span style="font-size: 13.5pt; font-family: Verdana, 'sans-serif'; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">&nbsp;Roorkee&nbsp;dated 30/12/2019. The length of island is less than 245 feet.</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-size: 13.5pt; font-family: Verdana, 'sans-serif'; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">3. The brick kiln has provided puccakeri road for the movement of the vehicles.</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-size: 13.5pt; font-family: Verdana, 'sans-serif'; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">4. The industry has planted sapling of trees along the boundary.</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-size: 13.5pt; font-family: Verdana, 'sans-serif'; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">5. The industry has provided ladder with the stack for carry out emission sampling of the kiln.</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-size: 13.5pt; font-family: Verdana, 'sans-serif'; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">6. No authorized fuel was found at the site.</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-size: 13.5pt; font-family: Verdana, 'sans-serif'; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">7. The industry has provided septic tank for the treatment of domestic effluent and discharge of treated effluent onto plantation. The industry has deposited Rs. 18700/-(Rs. 13200/- as Water Consent fee + Rs. 5500/- as penalty) through online vide R No.&nbsp;&nbsp;241858507 dated 28/11/2022 under Water Act, 1974 (including penalty fee, for failure to apply for consent to operate within 3 months to 6 month from date of proceedings of the meeting taken by the Chairman of the Board with the Punjab Brick Kiln Association and conveyed vide Board's letter no. PPCB/SEE(HQ-2)/2020/ 6676-77 dated 27.02.2020), valid upto&nbsp;30.09.2030.&nbsp;Under Air Act: consent fee of Rs. 11100/- (Rs. 9900/- as Air Consent fee +&nbsp; Rs. 700/- as NOC regularization fee + Rs. 500/- Application form fee) deposited online vide R. No. 400693431 dated 28/11/2022 against the fixed assets of Rs. 9.22&nbsp;lacs as on 26/11/2022, the fee is adequate upto&nbsp;30/09/2030, in view of latest fee structure laid down by the Board.&nbsp;</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-size: 13.5pt; font-family: Verdana, 'sans-serif'; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">8. No action is pending u/s 31-A of Air Act, 1981 against the brick Kiln.</span></p> <p><span style="font-size: 13.5pt; line-height: 115%; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: #5d5d5d; background: white; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Keeping in the view of above, it is recommended that fresh Consent to operate under Water Act, 1974 may be granted to BKO for manufacturing of Bricks / Tiles @ 25,000 Numbers/Day for a period upto 30.09.2030 &amp; varied consent under the Air Act, 1981 may be granted to BKO for manufacturing of Bricks / Tiles @ 25,000 Numbers/Day for a period upto 30.09.2030, with suitable conditions as per policy of the Board.</span></p>
