File Note: <p style="text-align: justify;">Detailed inspection-cum-agenda note generated.</p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">In reference to subject cited matter, it is intimated that the above project proponent was granted Consent to Establish (NOC) from pollution angle under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2019/11785117 dated 12.12.2019 which was valid upto 07.01.2021 for development of a group housing project consisting of 138 residential flats, 15 EWS flats, and 5 no. shops and a club house in a total area of 8534.77 sqm and built up area of 17781.56 sqm subject to suitable conditions mentioned therein. </span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent had proposed to develop a group housing project consisting of 138 residential flats, 15 EWS flats, and 5 no. shops and a 1 no. club house. The project proponent has proposed a total population of 775 persons in the group housing project. The project proponent has proposed that water consumption shall be to the tune of 104 KLD and the wastewater will be generated to the tune of 83 KLD which will be treated in an STP that shall meet with standards as prescribed by the Board.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent had proposed an STP of capacity of 100 KLD based on MBBR technology to treat the wastewater generated from STP and the treated wastewater shall be utilized for horticulture in an area of 1230.243 sqm and 27 KLD will be used for flushing and remaining will be discharged into MC, sewer. The unit has also proposed the components for the STP which includes Primary treatment (Screen Chamber, Oil &amp; Grease Chamber and Equalization tank), Secondary or biological treatment (MBBR Reactor, Secondary Tube settler), Tertiary treatment (Filter feed tank, Pressure sand filter, Activated Carbon filter, hypo-dosing system), Sludge Treatment (Filter Press, Sludge Holding tank, poly dosing).</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent had submitted letter obtained from MC, Zirakpur vide no. 3119 dated 28.11.2019 wherein it has been mentioned that the main sewer line of MC, Zirakpur is available in the area adjoining to M/s Shiva developers project namely Hazelwood and the project proponent can discharge its treated wastewater @ 100 KLD into the main sewer line after depositing the requisite charges and getting the permission/completion certificate from the various authorities. The project proponent had obtained permission from MC, Zirakpur vide letter no. 3118 dated 28.11.2019 disposal of Municipal Solid Waste and construction and demolition waste. </span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent had proposed that solid waste to the tune of 308 kg/day shall be generated and it will comply with provisions of Municipal Solid Waste Rules, 2016. The company shall also provide mechanical composter of capacity 150 kg/day for handling the organic solid waste. The in-organic waste shall be sold to authorized vendors and managed as per provisions of Solid Waste Management Rules, 2016.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The site of the subject cited project was earlier visited by AEE of this office on 26.02.2021 and it was observed that the site is located in the revenue estate of village Nabha. The promoter company has provided boundary wall around the site. The promoter company completed the construction of 50 flats having S+5 configuration and has also provided dual plumbing system in the same. The project proponent is carrying out construction of another 88 flats in 2 no. towers having S+11 configuration and civil work of the 2nd floor was being carried out during visit. The installation work of STP of capacity 100 KLD was carried out during visit. </span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the project proponent was granted extension in validity of consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 vide no. CTE/Ext/SAS/2021/15273997 dated 10.03.2021 which is valid upto 11.12.2022 subject to suitable conditions mentioned therein and one special condition as under:</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: normal;"><strong><em><span style="font-family: 'Tahoma','sans-serif';">&ldquo;The project proponent shall be bound to obtain consent to operate under the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981, before giving any occupancy in the project.&rdquo;</span></em></strong></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The site of the project was visited by AEE of this office 22.12.2021. During the visit, it was observed as under:</span></p> <p class="MsoListParagraphCxSpFirst" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The above residential project is located in the revenue estate of village Nabha.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent has given possession to approximate 50 flats and 5 no. commercial shops without any prior permission of the Board.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent has not installed STP / any treatment mechanism for the treatment of domestic waste and directly discharging its domestic effluent into sewer with the help of PVC pipe across the road.&nbsp;</span></p> <p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent has violated the various terms and conditions of the NOC granted by the Board. </span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">It is pertinent to mention here that the project proponent is violating the various provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974, Air (Prevention &amp; Control of Pollution) Act, 1981. The above violation was recommended to the Competent Authority of the Board through E-noting No. 17641671.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the project proponent was issued notice to issue directions u/s 33-A of the Water (Prevention &amp; Control of Pollution) Act, 1974 alongwith an opportunity to submit the reply within 15-days vide Board's letter no. 1171-72 dated 11.02.2022. The project proponent failed to submit any reply or failed to obtain consent to operate from the Board.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent was issued notice to issue directions u/s 33-A of the Water Act, 1974 alongwith an opportunity of personal hearing before the Chairman of the Board on 20.05.2022 vide Board's letter no. 2778-79 dated 10.05.2022.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent has given personal hearing before the worthy Chairman of the Board on 20.05.2022, wherein, it was decided as under:</span></p> <p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo6;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent shall apply for partial consent for the present investment in the project and wastewater discharge to operate within 15 days. </span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo6;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent shall submit the revised CA certificate along with the consent application.</span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo6;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent shall also develop the vermicomposting to manage the biodegradable solid waste. The total fee deposited by the project proponent is adequate upto 30.04.2024 (Rs. 2900/- extra / additional under both Acts) after adjusting late fee / penalty as well as NOC regularization fee due to increase in project cost against the total cost of the project Rs. 4223.32 lacs.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent has submitted manufacturing process of leather store.
