It is submitted that the unit was earlier granted consent to establish under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/RPN/2021/16773362 dated 13/10/2021 which was expired on 12/10/2022 for operation of Crushing and Washing of stone aggregates @ 8200 CFT/Day subject to the suitable conditions mentioned therein.                    Now, the unit has applied for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for operation of Screening-cum-Washing of Stone aggregates @ 8200 CFT/Day only due to some financial conditions as mentioned in the undertaking attached by the applicant. The unit has submitted an undertaking regarding code of practice, location plan, feasibility report, CLU, Jamabandi, compliance of NOC granted to the unit and consent fee.                    The unit has submitted the CA certificate, wherein the value of fixed assets of the industry as on 31.07.2022 is Rs. 45.40 lakhs with the value of plant and machinery Rs. 32.13 lakhs. The unit has deposited the fee under the Water Act, 1974 and the Air Act, 1981 and the detail is given as below: ·         Water Consent Fee Rs. 8700/- vide UTR No. YESOB22300027918 dated 18.08.2022. Rs. 5800/- vide UTR No. YESOB22630022426 dated 20.09.2022. ·         Air Consent Fee Rs. 8700/- vide UTR No. YESOB22300027865 dated 18.08.2022. Rs. 5800/- vide UTR No. YESOB22630022270 dated 20.09.2022.                    As such, after deducting 10% penalty, the fee deposited by the unit under the Water Act, 1974 and the Air Act, 1981 is adequate upto 31.08.2027 as per circular dated 29.10.2018.   Further, it is pertinent to mention here that the Executive Engineer, Deptt. of Irrigation-Cum-Mining, Rupnagar through e-mail dated 20.10.2022 and the Executive Engineer, Deptt. of Irrigation-cum-Mining, Sri Anandpur Sahib vide no. 1005/Crusher dated 18.10.2022 has informed that there are 04 no. gravel mining sites operational in District Rupnagar i.e. Bhallan, Kotbala & Aaspur, Bari Haveli and Rasidpur Jindapur for obtaining raw material. The unit has submitted the slips of obtaining raw material from the approved mining site of District Rupnagar i.e. Bhallan de-silting site.                           Further, the unit was visited by the AEE on 22.11.2022 and Sh. Kulveer Singh, Proprietor was contacted. During visit, it was observed as under: 1.    The unit i.e. screening-cum-washing plant has been installed and was not in operation. 2.    The unit has provided concrete re-circulation tanks for the re-circulation of wastewater alongwith re-circulation arrangements. 3.    The unit has stabilized movement area/ramp with the river bed material. 4.    The unit has provided fresh saplings along the boundaries. 5.    The unit has provided a DG set of capacity 125 KVA with canopy and stack of adequate height. 6.    The unit has not provided Environmental data board at the entrance wall. In view of the above facts and letter issued by the Executive Engineer, Deptt. of Irrigation-cum-Mining, Sri Anandpur Sahib and e-mail received from Executive Engineer, Deptt. of Irrigation-cum-Mining, Rupnagar, if approved, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.09.2023, subject to the suitable conditions as mentioned in the CTE granted to the unit and additional conditions as under: <p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-pagination: none; mso-list: l0 level1 lfo2; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 5.65pt .0001pt 59.0pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; letter-spacing: -.05pt; mso-font-width: 134%; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">1.   The Board vide letter no. 16536 dated 23.07.2021 has issued some instructions w.r.t stone crushers and vide said letter the instruction no. 2 is as under: <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-pagination: none; mso-list: l1 level1 lfo3; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 5.65pt .0001pt 59.0pt;">Ø  Obtain carrying capacity certificate of the area/stone crusher from Deptt. Mines & Geology, Department of Water Resources and act on basis of such certificates. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-pagination: none; mso-list: l1 level1 lfo3; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 5.65pt .0001pt 59.0pt;">Ø  The Executive Engineer, Water Resources-cum-Mining Department vide E-mail dated 20.10.2022 has mentioned that three number Gravel (GSB) Mining Sites are operational (i) Bhallan (ii) Kotbala & Aaspur (iii) Bari Haveli. If the crusher owner gives the source from these sites then that is a valid source. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-pagination: none; mso-list: l1 level1 lfo3; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 5.65pt .0001pt 59.0pt;">Ø  Thereafter, vide e-mail dated 11.11.2022 received from Executive Engineer, Water Resources-cum-Mining Department, Rupnagar has sent a letter for Legal Source of Raw Material issued by the Principal Secretary Mines and Geology addressed to the Chairman PPCB. No correspondence is received in this regard yet. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-pagination: none; mso-list: l1 level1 lfo3; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 5.65pt .0001pt 59.0pt;">Ø  Therefore, the consent is granted upto 30.09.2023 subject to the final decision in the matter by the PPCB.
