<p style="text-align: justify;">It is submitted that the subject cited industry is a member of 50 MLD CETP. The tentative shares allotment of the member units was submitted by PDA vide its letter dated 22.07.2022, which was under consideration of the Board. The Competent Authority of the Board has directed to take interim actions as per e-noting no. 19582356. The application is being processed in light of directions given in the above said e-noting.</p>
<p style="text-align: justify;">The industry is small scale dyeing unit and was granted ‘Consent to Operate’ under Water Act, 1974 & under the Air Act, 1981 both valid upto 12.07.2022 for dyeing of acrylic yarn @ 1 TPD with trade effluent @ 90 KLD into sewer after passing through ETP & domestic effluent @ 0.5 KLD into sewer. The direction u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 was restored temporarily upto 12.07.2022.</p>
<p style="text-align: justify;">Thereafter, direction u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 was issued vide Board's letter no. 5852 dated 14.09.2022 to the PSPCL authorities to disconnect electricity supply of the industry after the expiry of temporarily restoration i.e. 12.07.2022.</p>
<p style="text-align: justify;">Now, the industry has applied varied ‘Consent to Operate’ under the Water Act 1974 and under the Air Act, 1981 for dyeing of acrylic yarn @ 3360 Kg/day with trade effluent @ 339.5 KLD & domestic effluent @ 0.5 KLD into conveyance system of CETP 50 MLD alongwith boiler of 03 TPH & DG set of 60 KVA. The industry has deposited consent fee, which is adequate upto 31.03.2030 under both acts.</p>
<p style="text-align: justify;">The industry was visited by AEE of RO on 17.10.2022 and observed that:-</p>
<p style="text-align: justify;">1. The industry was in operation.</p>
<p style="text-align: justify;">2. The industry has installed 11 cabinet machines of capacities (2 x 180 Kg, 8 x 60 Kg & 1 x 120 Kg in its premises. However, two cabinet machines of 60 Kg each are lying dismantled and without motors.</p>
<p style="text-align: justify;">3. The industry has also sister concern unit i.e. M/s New Amba Dyeing Unit-II, just located near to it. The study of effluent generation has been done by the Guru Nanak Dev Engineering College (GNE) combined for its both units i.e. M/s New Amba Dyeing & M/s New Amba Dyeing Unit-II. As per the combined GNE report of both the units, total effluent generation from its total 25 chamber of soft flow & 15 cabinet machines (60 Kg X 8, 120 Kg X 1, 180 Kg X 5) is 1066.4 KLD. However this unit has installed only 11 cabinet machines of capacities (2 x 180 Kg, 8 x 60 Kg & 1 x 120 Kg in its premises, out of which two cabinet machines of 60 Kg each are lying dismantled and without motors. Hence, net effluent generation from the balance 09 cabinet machines i.e. (2 x 180 Kg, 6 x 60 Kg & 1 x 120 Kg) will be 336 KLD as per GNE calculations.</p>
<p style="text-align: justify;">4. The total 822 KLD share of CETP 50 MLD has been granted to the both units under the name of M/s New Amba Dyeing by the PDA, Tajpur Road, Ludhiana on 22.07.2022.</p>
<p style="text-align: justify;">5. The total discharge of the industry from both of the unit was 1066.4 KLD as per GNE 2022 report against the allotted shares 822 KLD of CETP 50 MLD. Hence, there was excess discharge 244.4 KLD. Earlier, the 50% of total machinery of both the unit were already sealed by the Board. As per the share allotted to the industries as comparison its discharge 23% dyeing machinery of the industry was required to be sealed and remaining machinery was required to be de-sealed. On the basis of the request of the industry, the de-sealing of all the cabinet machine has been done on 17.10.2022 in this unit and only 01 soft flow machine of capacity 200 Kg was de-sealed in unit-II and 03 soft flow of capacity 200 Kg each, 01 soft flow of 400 kg & 02 cabinet of 100 Kg each are still sealed as observed during visit.</p>
<p style="text-align: justify;">6. The industry is connected with the conveyance system of CETP 50 MLD, Tajpur Road, Ludhiana for discharge its effluent. The industry has provided the flow meter at its final outlet leading to CETP. The industry was also advised to provide the flow meter at inlet water supply.</p>
<p style="text-align: justify;">7. The industry has installed one boiler of capacity 03 TPH with cyclone as APCD in which rice husk/ agro waste was being used as fuel and adequate stack has been provided.</p>
<p style="text-align: justify;">8. The industry has got analyzed its stack emission samples from Private lab on 08.11.2022 and as per the analysis report results are within limit.</p>
<p style="text-align: justify;">9. The industry has also installed one DG sets of capacity 60 KVA with canopy and adequate height.</p>
<p style="text-align: justify;">10. Further, some units have made the complaint regarding in judicial allotment of the shares by the PDA, Tajpur Road, Ludhiana, which is under process at Board and at Govt. Level.</p>
<p style="text-align: justify;">The CETP 50 MLD has been in continuous operation since February, 2022. Presently, the industry is discharging its effluent into CETP 50 MLD through dedicated conveyance system.</p>
<p style="text-align: justify;">A complaint had been received against the dyeing industries located at Tajpur Road, Ludhiana on 20.05.2022 and 21.05.2022 regarding stagnation of untreated effluent in different area at Tajpur Road. A lot of hue and cry is being caused among the general public due to stagnation of untreated effluent.</p>
<p style="text-align: justify;">The matter was considered by the Competent Authority of the Board and it was decided to issue following directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974:</p>
<p style="text-align: justify;">"That the industry to operate only at 50% of the consented production capacity, till the dedicated conveyance line leading to CETP, 50 MLD is cleared and no stagnation occurs in the area. 50 % of dyeing machinery of the industry be sealed."</p>
<p style="text-align: justify;">50 % of dyeing machinery of the industry was sealed by the Board.</p>
<p style="text-align: justify;">M/s Punjab Dyer Association (SPV),Tajpur Road Module, Ludhiana vide its letter dated 22.07.2022 had submitted the letter regarding intimidation of the tentative share of the CETP, 50 MLD, Tajpur Road, Ludhiana amongst the dyeing members of Tajpur Road, Ludhiana. As per the list, the industry has been temporarily allotted shares of 822 KLD. These shares are temporary/tentative and their finalization is under the consideration of the Board.</p>
<p style="text-align: justify;">M/s Punjab Dyer Association (SPV),Tajpur Road Module, Ludhiana vide its email dated 04.08.2022 has submitted the latest report conducted by the Guru Nanak DevEngg College (GNE), regarding effluent discharge quantity of dyeing units of Tajpur Road, Ludhiana. This study was done by the GNE on entire existing dyeing machinery (Sealed and un-sealed) installed inside the dyeing units, by physically inspecting the site of each unit. As per the GNE report 2022, the industry has installed machinery for discharge of 1066.4 KLD.</p>
<p style="text-align: justify;">The shares allotment is under consideration of the Board and to regulate the quantum of effluent reaching the CETP, the Competent Authority of the Board had decided to temporarily restrict the quantum of effluent discharged from the industries, to the lesser quantum out of GNE report 2022 and tentative shares intimated by PDA vide its letter dated 22.07.2022. As such, the quantum of effluent discharge from the industry is temporarily required to be restricted to 822 KLD.</p>
<p style="text-align: justify;">Accordingly, following directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 were issued to the industry to operate only at 77 % of the machinery as per GNE report -2022. As the 50% dyeing machinery of the industry is already sealed, accordingly 27 % of dyeing machinery of the industry be de-sealed. Further, if any new machinery has been installed by industry after GNE report 2022 be sealed.</p>
<p style="text-align: justify;">Earlier the directions were issued u/s 33-A of the Water Act, 1974 & u/s 31-A of the Air Act, 1981 for disconnection of the electric connection of the industry due to non-achievement of the prescribed standards of treated effluent & air emission.</p>
<p style="text-align: justify;">In-compliance the electric connection of the industry was disconnected by the PSPCL authorities. Thereafter, the electric connection of the industry has been restored temporarily 04 times for six months and industry was found complying during last 05 visits i.e. 24.06.20219, 27.10.2020, 20.11.2020, 05.05.2021 & 17.10.2022. Further, the air emission samples collected on visit 24.06.2019 & effluent samples collected on 27.10.2020 were found within limits. The industry now has joined the CETP 50 MLD.</p>
<p style="text-align: justify;"> </p>
<p style="text-align: justify;">Keeping in view of tentative allotment of shares by PDA. It is recommended that :-</p>
<p style="text-align: justify;">A. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 & u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 be issued to PSPCL authorities for permanent restoration of electricity connection of the industry.</p>
<p style="text-align: justify;">B. The industry be directed to remove its two dismantled cabinet machines of 60 Kg each from its premises.</p>
<p style="text-align: justify;">C. Consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be granted for one year.</p>
<p style="text-align: justify;">D. Consent to operate under the Water Act, 1974 may be granted to the industry temporarily for 3 months for discharge of trade effluent & domestic effluent @ 336 KLD into CETP 50 MLD as an interim arrangements so as to check the discharges from Members industries and the efficiency of the CETP subject to suitable conditions and with special conditions that:-</p>
<p style="text-align: justify;">1. The consent is an interim arrangements so as to check the discharges from Members industry and the efficiency of the CETP.</p>
<p style="text-align: justify;">2. The consent is based on tentative intimidation of the shares by PDA dated 22.7.2022 and GNE report of 2022, as such, it is a temporary arrangement, it will not convey any right to the industry to tentative shares intimated by SPV vide letter dated 22.7.2022.</p>
<p style="text-align: justify;">3. The member industry shall install effluent measuring devices at the outlet of the industry leading to conveyance system of CETP within the validity of consent for verification of the discharges.</p>
<p style="text-align: justify;">4. The industry shall ensure that no new machinery is installed without prior permission of the Board.</p>
<p style="text-align: justify;">5. The consent is an interim measure in-accordance to tentative shares intimated by PDA to the Board vide its letter dated 22.07.2022. These shares are temporarily considered and their finalization is under the consideration of the Board.</p>
<p style="text-align: justify;">6. The member units and PDA shall ensure that total effluent intake into the CETP, Tajpur Road, Ludhiana from the existing units will never be exceed 40 MLD.</p>
<p style="text-align: justify;">7. The industry as well as M/s Punjab Dyer Association (SPV), Tajpur Road Module, Ludhiana will comply with the undertaking submitted by SPV dated 22.09.2022.</p>
<p style="text-align: justify;">8. The PDA shall ensure the working of Inlet and outlet online flow-meters at CETP and shall also provide standby flow meters for the same to ensure their regular working at CETP site.</p>
<p style="text-align: justify;">9. The online flow meters at the inlet water source of all member units shall be installed within 4 months. The online connectivity of these flow meters of all units shall be ensured so as to check the discharge allowed by the Board.</p>
<p style="text-align: justify;">10. The member industry and M/s Punjab Dyer Association (SPV),Tajpur Road Module, Ludhiana shall provide online meters at the outlet of all the dyeing units and to check, update / calibrate this online system so as to provide the regular and exact data of effluent discharge by individual units and in consonance to the effluent received at CETP within 1 week. </p>
<p style="text-align: justify;">11. The PDA, Tajpur Road, Ludhiana shall ensure that no overflow of effluent will takes place from the conveyance system at any time and if such things happen, immediately the concerned industries discharging effluent in that line will be closed.</p>
<p style="text-align: justify;">12. All member units shall have only one outlet jointly for domestic and trade effluent for discharge into the conveyance system of CETP, 50 MLD Tajpur Road, Ludhiana. There shall be no bypass from any dyeing unit.</p>
<p style="text-align: justify;">13. M/s Punjab Dyer Association (SPV),Tajpur Road Module, Ludhiana or individual industry shall not to execute any trading/ transfer of CETP's shares without prior permission of the Competent Authority of the Board. The PDA or the individual industry will be responsible for any loss due to trading of shares.</p>
<p style="text-align: justify;">14. The PDA, Tajpur Road, Ludhiana and individual member unit shall be liable to pay Environmental Compensation for any lapse in undertaking submitted by SPV dated 22.09.2022.</p>
<p style="text-align: justify;">15. It is made clear that in case of failure of commitment made by PDA vide its undertaking dated 22.09.2022, the Board shall be constraint to take strict action in accordance to law, on SPV as well as individual members without any further notice.</p>
<p style="text-align: justify;">16. The PDA is again directed to ensure that it achieves the prescribed standards at the outlet of CETP within one month, failing which the Board shall be constrained to order the closure of all the member industries attached with the CETP.</p>
