<p style="text-align: justify;"> </p>
<p style="text-align: justify;">The agenda note and report / recommendations of AEE/EE, RO, may kindly be perused.</p>
<p style="text-align: justify;">The SPV was granted consents to operate under Water Act, 1974 and Air Act, 1981, both valid upto 04.01.2023 and 31.03.2023 respectively with special conditions including that the SPV shall complete the up-gradation and stabilize the upgraded CETP by 31.07.2022 under any circumstances and no further time will be given.</p>
<p style="text-align: justify;">Now, the SPV has applied for renewal of consent to operate under Water Act, 1974 and Air Act, 1981. The industry has deposited consent fee, which are adequate upto 31.03.2024 under both Acts.</p>
<p style="text-align: justify;">The CETP of capacity 15 MLD installed at Bahadurke Road, Ludhiana for the treatment of effluent generated from the dyeing industries of Bahadurke cluster is fully operational since July 2020 and CETP is being regularly monitored by the Board on monthly basis and it has been observed that the CETP is not achieving the prescribed standards since its commissioning. </p>
<p style="text-align: justify;">The SPV was given personal hearing before the Hon’ble Chairman of the Board on 19.04.2022 for violations u/s 25/26 of the Water act, 1974 and imposition of Environmental Compensation to SPV of 15 MLD CETP, wherein it was decided as under:-</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->1. <!--[endif]-->Environmental Compensation of the period from 25.09.2021 to 19.04.2022 be imposed against the SPV for non-compliance.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->2. <!--[endif]-->Environmental Engineer, Regional Office-3, Ludhiana shall calculate EC and submit alongwith details, within one week.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->3. <!--[endif]-->SPV shall get its bank guarantee amounting to Rs. 2.40 Cr., extended and submit the same in the office of Environmental Engineer, Regional Office-3, Ludhiana, within one week.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->4. <!--[endif]-->SPV shall complete the work of up-gradation of CETP as given in its reply by 30.06.2022, positively. </p>
<p style="text-align: justify;"><!-- [if !supportLists]-->5. <!--[endif]-->SPV shall get its flow meter installed at inlet of CETP and get it connected with Board's server, within 15 days.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->6. <!--[endif]-->SPV shall install OCEMS at the final outlet i.e. in the collection tank of treated effluent and get it connected with Board's server, within 15 days.</p>
<p style="text-align: justify;">Accordingly, Environmental compensation (EC) of Rs. 77,62,500/- has been imposed upon the SPV BKTKA vide board’s orders dated 04.10.2022. But the SPV has not deposited the EC amount in the Board inspite of the various reminder.</p>
<p style="text-align: justify;"> Now, the SPV has added the DAF system with the existing components of the CETP and effluent sample from the CETP was again collected by the officers of the Board on 06.10.2022 after the installation of the DAF system.</p>
<p style="text-align: justify;">Thereafter on the request of the SPV, BKTKA again effluent sampling of the CETP was again carried out on 09.11.2022. During the visit 03 sets of the effluent samples were collected and the same were sent to 03 different labs for analysis i.e. Sophisticated Analytical Instrument Laboratories, Patiala, Zonal Lab, Ludhiana and Punjab Biotechnology Incubator, SAS Nagar, Mohali. Analysis report has been received from Board's lab only and the details of analysis report from Board's lab of sampling carried out on 06.10.2022 & 09.11.2022 is as under:-</p>

<p style="text-align: justify;">The above mentioned results reveal that the CETP is not achieving the effluent standards prescribed by the Board even after the installation of the DAF system.</p>
<p style="text-align: justify;">SPV, BKTKA has now added 01 wood fired boiler of capacity 01TPH with cyclone separator as an APCD for the installation of steam paddler drier but the same has not been made operational till date.</p>
<p style="text-align: justify;">Further the SPV has not installed OCEMMS at the final outlet of the CETP before outfall into Budha Nallah till date.</p>
<p style="text-align: justify;">It is pertinent to mention here that in the first instance, the Environmental Clearance was issued by the MoEF on 08.12.2014 to M/s Bahadurke Textile & Knitwear Association (BKTKA) on dated 8.12.2014 for the establishment of Common Effluent Treatment Plant (CETP) of 15 MLD based on ZLD scheme. However, vide another letter dated 18.03.2016, the Government of India, Ministry of Environment, Forest and Climate Change while examining the new proposal of CETP had recommended and approved the proposal of M/s Bahadurke Textile and Knitwear Association to initiate the CETP based on conventional treatment system in Phase-1 with adoption of ZLD in Phase-2, for which the Association will apply to the MoEF&CC at a later stage as an up-gradation case. But the SPV has not started any work for the 2nd phase of the CETP to adopt the ZLD scheme till date in compliance of the MoEF letter dated 18.03.2016 vide which the minutes of the Appraisal Committee Meeting on CETPs held on 03.03.2016 under the Chairmanship of Dr. Manoranjan Hota, Adviser (CP), MoEF&CC were conveyed to the SPV, BKTKA.</p>
<p style="text-align: justify;">In view of above, it is recommended that:-</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->1. <!--[endif]-->Show cause notice for refusal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be issued to the SPV, BKTKA with an opportunity of personal hearing before the Competent Authority of the Board.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->2. <!--[endif]-->Consent to operate under Air (Prevention & Control of Pollution) Act, 1981 may be granted to the SPV upto 31.03.2024.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->3. <!--[endif]-->The SPV, Bahadurke Textile and Knitwear Association may be directed to adopt the ZLD scheme after getting necessary permissions/approval from MoEF&CC, in compliance of the MoEF letter dated 18.03.2016 vide which the minutes of the Appraisal Committee Meeting on CETPs held on 03.03.2016 under the Chairmanship of Dr. Manoranjan Hota, Adviser (CP), MoEF&CC were conveyed to the SPV, BKTKA.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->4. <!--[endif]-->SPV be directed to submit the compliance w.r.t implementation of ZLD based scheme as mentioned above alongwith PERT chart immediately please. </p>
