<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';"> It was brought out that the institute was granted consents to operate under the Water Act, 1974 and Air Act, 1981 on 13.04.2018 (valid upto 30/09/2022).</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';"> The institute has applied for renewal of consents to operate under the Water Act, 1974 & Air Act, 1981.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';"> The applications of the institute were examined and site visit was done by officer of the Board on 04.11.2022 and it has been observed as under:-</span></p>
<p class="MsoPlainText" style="margin-left: .25in; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12pt; line-height: 150%; font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12pt; line-height: 150%; font-family: Tahoma, 'sans-serif';">The institut</span><span style="font-size: 12pt; line-height: 150%; font-family: Tahoma, 'sans-serif';">e had obtained letter issued by DTP, Faridkot, Department of Town & Country Planning, Punjab vide no. 99 dated 19.01.2018 that in case of expansion of the site area of the institute or there is any construction of new building in the existing premises of the institute, the institute will be bound to obtain approval from their department. However, the institute had not clarified whether any new building has been constructed by it after the issuance of last consents to operate granted to it.</span></p>
<p class="MsoPlainText" style="margin-left: .25in; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12pt; line-height: 150%; font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-size: 12pt; line-height: 150%; font-family: Tahoma, 'sans-serif';">The institute is generating bio-medical waste and was required to comply with the provisions of the Bio-Medical Waste Management Rules, 2016 as amended from time to time as per the condition of consents to operate granted to it i.e. the institute was required to obtain authorization under the said Rules from the Board and ensure proper disposal and treatment to authorized recycler / Common Bio-Medical Waste Treatment Facility, however, no compliance has been submitted by the institute.</span></p>
<p class="MsoPlainText" style="margin-left: .25in; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12pt; line-height: 150%; font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12pt; line-height: 150%; font-family: Tahoma, 'sans-serif';">The institute has laboratories and animal house for medicine testing and animals testing respectively. However, the institute has not submitted the wastewater treatment details of the laboratory wastewater and disposal details of animals carcass generated from the animal house. </span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';"> In view of above, t<span style="background: white;">he industry has been issued show cause notice before refusal of renewal of consents to operate under the provisions of Water Act, 1974 & Air Act, 1981 with an opportunity of personal hearing on </span>29.11.2022, which was postponed to 30.11.2022.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;"> </span><span style="font-family: 'Tahoma','sans-serif'; background: white;">During hearing, </span><span style="font-family: 'Tahoma','sans-serif';">Sh. Parveen Garg, Chairman of the Institute's Trust submitted a written reply to the show cause notice issued to the institute, which has been taken on record. He stated that no building expansion has been carried out after the year 2018 and submitted an undertaking in this regard. He further stated that the institute has made an agreement with Common Bio-medical Waste Treatment Facility (CBWTF) and agreed to apply for authorization under the Bio-medical Waste Management Rules, 2016 within 15 days. He also stated that there is no incinerator installed in the institute. However as per the Board's record, there was incinerator in the institute in the past for burning / incineration of animal carcass generated from the animal house, which is required to be verified. </span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><strong><span style="font-family: 'Tahoma','sans-serif'; background: white;"> </span></strong><span style="font-family: 'Tahoma','sans-serif'; background: white;"> From the perusal of the balance sheet submitted by the institute during the hearing, it has been observed that the fixed assets of the institute has been increased from Rs. 1.75 Cr to Rs. 5.45 Cr in the period 2018 to 31.03.2022. Whereas, as per the report of Regional Office of the Board, the institute has deposited consent fee in accordance with the consent fee slab prescribed by the Board for Rs. 1.0 Cr to Rs. 2.0 Cr. Therefore, the institute is required to deposit accordingly consent fee in accordance with the slab of Rs. 5.0 Cr to Rs. 10.0 Cr.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><strong><span style="font-family: 'Tahoma','sans-serif'; background: white;"> </span></strong><span style="font-family: 'Tahoma','sans-serif'; background: white;">After hearing the Chairman of the institute's trust as well as officer of the Board, it has been decided that:-</span></p>
<p class="MsoNormal" style="margin-left: 27.0pt; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-style: italic;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Tahoma','sans-serif'; background: white; mso-bidi-font-style: italic;">The institute shall deposit adequate consent fee / NOC regularization fee in consultation with Regional Office, Faridkot of the Board, within one week.</span></p>
<p class="MsoNormal" style="margin-left: 27.0pt; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-style: italic;">2.</span><span style="font-family: 'Tahoma','sans-serif'; background: white; mso-bidi-font-style: italic;">Regional Office, Faridkot shall immediately visit the institute to verify the submissions made by the institute and thereafter submit his comments on purpose of the increase in fixed assets of the building of the institute alongwith adequacy of CTO fee within one week.</span></p>
