Accordingly, the report was sent to Zonal office-1, Patiala through e-office.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">Accordingly, the competent authority of the Board has issued a directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 for disconnection of the electricity vide letter no. 4479 dated 11.10.2022 as under:</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><strong><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">“That the authorities concerned shall disconnect the electricity supply available to subject cited industry, with immediate effect”.</span></strong></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">In compliance, to said decisions, disconnection of the electric connection of the industry was done by PSPCL vide TDCO no. 2147 dated 17.10.2022. a report in this regard was also sent to Zonal Office-1, Patiala vide letter no. 5052 dated 18.11.2022.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">Now, the industry has applied for obtaining fresh ‘consent to operate’ under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Plastic Packaging Material @ 800 Kgs/day as products, subject to certain conditions mentioned therein.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">It is submitted that the industry has uploaded a copy of electricity bill issued by PSPCL, wherein, it has been mentioned that the electric connation was released to the industry on 24.08.2001. as such, the unit is being operated since last 21 years without having valid ‘consent to operate’ of the Board. Now, the industry has applied ‘consent to operate’ under VDS scheme issued by the Board vide OM dated 21.11.2022.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has deposited Rs. 34,600/- vide UTR R. no. INDBN09119505216 dated 09.11.2022 (including NOC regularization fee Rs. 1800/- and late fee for Rs. 14,400/-) under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 33,300/- vide UTR R. no. INDBN09119501987 dated 09.11.2022 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 30.09.2035 (considering one time VDS fees of Rs. 10,000/-) for both the Acts against the fixed assets of Rs. 10.93 Lacs on 28.10.2022.</span></p>
<p class="MsoNormal" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has submitted a letter issued by Municipal Council, Derabassi vide letter no. 4030 dated 23.11.2022, wherein it has mentioned as under:</span></p>

<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has submitted a copy of building plan signed by Sh. </span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">Rajinish Kumar Singla,</span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';"> competent person under Punjab Factories Act, 1948. Further, the industry has submitted a copy of lease deed executed between Sh. Ashok Lamba s/o Sh. Om Nath Lamba and M/s Shiv Polymers, for lease of land upto 31.03.2032.</span></p>
<p class="MsoNoSpacing" style="margin-top: 12pt; text-align: justify; line-height: 24px;"><strong><u><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">Applicability of EIA notification dated 14.09.2006:</span></u></strong></p>
<p class="MsoNoSpacing" style="margin-top: 12pt; text-align: justify; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry is not covered under the ambit of EIA notification dated 14.09.2006.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif'; color: red;"> </span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">Accordingly, the industry was visited by AEE of this office on 01.12.2022 </span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">during visit, </span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">it was observed as under:</span></p>

<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has installed 05 no. of blower machines and 04 no. cutting machines in its premises.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The representative of the industry informed that now they shall not manufacture any kind of carry bags in its premise and shall manufacture only industrial packaging material. The industry has also submitted an undertaking in this regard with its online application form, which is reproduced as under:</span></p>

The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.</span></p>
