<p class="MsoNormal" style="text-align: justify; text-indent: 62.15pt; line-height: 150%;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 150%;">It is submitted that the industry was earlier granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/SGR/2018/7849745 dated 26/07/2018 and under the Air Act, 1981 vide no. CTOA/Renewal/SGR/2018/7849474 dated 26/07/2018 both valid upto 31/12/2022 for manufacturing of Patti @ 5 MTD by using MS Patra @ 5 MTD as raw material. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 62.15pt; line-height: 150%;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 150%;">Now, the industry has applied for renewal consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 under green category for manufacturing of Patti @ 5 MTD by using MS Patra @ 5 MTD as raw material.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 62.15pt; line-height: 150%;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 150%;">Earlier, the value of CA certificate of the industry was Rs. 2.34 lacs and now the value of CA certificate is 4.64 lacs. The industry has submitted that it has replaced its old machinery with new ones and because of the same the value of CA certificate has increased. In its request letter the industry has also mentioned that there is no change in production capacity or manufacturing product of the industry. Accordinlgy, the industry has deposited Rs. 4700/- (Rs. 4000/- Water CTO fee + Rs. 700/- NOC fee) Vide. R.No. 712564061 dated 03.12.2022 under the Water Act, 1974 and Rs. 4500/-(Rs. 4000/- Air CTO fee + Rs. 500/- application fee) Vide. R.No. 55007111 dated 03.12.2022 under the Air Act, 1981, which is adequate up to 31/12/2028 as per C.A certificate of fixed assets of Rs. 04.64 lacs dated 31.10.2022. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 62.15pt; line-height: 150%;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 150%;">It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. Further, it is intimated that there is no change in the underappreciated value of the fixed assets.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 62.15pt; line-height: 150%;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 150%;">No complaint is pending against the industry. The industry was found complying with consent conditions during last visit and consents were granted thereafter.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 62.15pt; line-height: 150%;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 150%;">The industry is situated within MC limits of Malerkotla. It is further submitted that the Board vide office order no. 21 dated 08/06/2018 has decided that the existing industrial units/ other establishments, which were established before the notification of the Master Plan of the respective cities shall be allowed consents/extension under the provisions of Water Act, 1974, Air Act, 1981 and authorization under the provisions of Hazardous Waste Management Rules, 2016 for a period of 15 years from the date of the notification of Master Plan after taking the concrete documentary proof regarding the date of commissioning of such units. No separate approval from local bodies/ other authorities is required to be obtained. It is further submitted that the Master Plan of Malerkotla has been notified on 29/06/2015 i.e. after establishment of the industry. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 62.15pt; line-height: 150%;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 150%;">In view of above, it is recommended that:- 1. The validity of consent to operate granted to the industry under the Water Act, 1974 and the Air Act, 1981 under green category may be further extended upto 31/12/2028 for manufacturing of Patti @ 5 MTD by using MS Patra @ 5 MTD as raw material with same conditions and special condition that the industry shall comply with the guidelines issued by Punjab Water Regulation and Development Authority (PWDRA), from time to time.
