Accordingly, the industry was issued a show cause notice for violations of provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, vide letter no. 4744 dated 02.11.2022, with the request to apply for ‘consent to operate’ under the provisions of Water (Prevention & Control of Pollution) Act and Air (Prevention & Control of Pollution) Act, 1981, within a period of 10 days.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">Now, the unit has applied for fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Electrical Control Panels Boxes and Enclosures @ 600 Number/Year as products, along with requisite document.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has deposited Rs. 40100/- vide UTR R. no. P322220203932751 dated 18.11.2022 (including NOC regularization fee Rs. 3600/-) under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 36000/- vide UTR R. no. P322220203939754 dated 18.11.2022 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 01.11.2026, considering the fact that the industry was made operational in December, 2019 (as per power bill issued by PSPCL) for both the Acts against the fixed assets of Rs. 69.96 Lacs on 31.10.2022.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has submitted a copy of building plan signed by Sh. Jasvir Singh, competent person under Punjab Factories Act, 1948. The industry has submitted a copy of proprietorship certificate (GST registration certificate). Further, the industry has submitted a copy of the registry executed between Sh. Rooplal Singla and M/s Kalyani Switchgear for land area bearing Khasra no. 50//6 (2-13), 7 (0-4) having area of 02 Bigha 17 Biswe.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; line-height: 24px;"><strong><u><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">Suitability of Site:</span></u></strong></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry is located within the limits of MC Derabassi as well as Master Plan of Derabassi. Alongwith online application, the industry has submitted a copy of its industrial building plan approved by MC Derabassi vide no. 3949 dated 26.05.2016, which shows that the site is suitable as per MC Derabassi.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';"> </span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">Further, the industry has also submitted an undertaking to the effect as under:</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 28.55pt 6pt 2cm; text-align: justify; line-height: 24px;"><em><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">“I Rakesh Sharma, proprietor of M/s Kalyani Switchgear, village saidpura, Barwala road, Derabassi, Distt. SAS Nagar, Punjab hereby undertake that my industry is established in 1/2 part of khasra no. 50//6(2-13) , 7(0-4) the total measuring 1425 sq. yards ( 1Bigha- 8 biswa- 10 Biswasi) which now fall in Derabassi Municipal Council. We have got approved our industrial drawing from municipal council, Derabassi mentioning the total area as 1425 sq. yards but khasra no. not mentioned on the drawing. As per the Derabassi master plan this land falls ion Existing Industry Zone where operation of our unit is allowed as per bye-laws.”</span></em></p>
<p class="MsoNoSpacing" style="margin: 0cm 28.55pt 6pt 0cm; text-align: justify; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';"> As per policy dated 30.04.2013 of the Board:</span></p>
<p class="MsoNormal" style="margin: 0cm 28.55pt 10pt 2cm; text-align: justify; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';"> <em>“PPCB will grant NOC to new industries of all categories, which are proposed to be located in the designated Industrial zone/areas of the notified/draft Master Plan on the basis of undertaking submitted by the entrepreneur to the effect that the proposed site of the project/industry is located in the designated Industrial zone/area of the notified Master Plan or draft Master Plan in which the establishment of such industry/project is permissible. A copy of the said NOC along with undertaking and location plan of the industry clearly indicating the category of industry (red/orange/green) would be sent by the concerned Senior Environmental Engineer/Environmental Engineer to the concerned District Town Planner of the Department of Town & Country Planning, Punjab/Local Body/Development Authority (also an intimation in this regard will be sent through e-mail) with the request to</em></span><span lang="EN-US"> </span><em><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">intimate the applicant (project proponent) under intimation to the Punjab Pollution Control Board within 15 days, if the said authority has any objection to the location of the project at proposed site. <p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has installed 01 no. powder coating section in its premises, which has been provided with cyclone separator as APCD.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has installed 01 no. electrically operated oven in its premises.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has installed 01 DG set of capacity 30 KVA, which is equipped with canopy and stack of adequate height.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has constructed a septic tank for passing of domestic effluent, after which the same is used for plantation of green area developed inside the premises of the unit.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry does not generate any kind of trade effluent from its premises.</span></p>

The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.</span></p>
