<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">It was brought out that the industry (earlier name - M/s Gursewak Oil Industry, D-5P, Industrial Focal Point, Abohar, District Fazilka) was granted consents to operate under the Water Act, 1974 and Air Act, 1981 on 18/10/2017 (valid upto 30/06/2021) for manufacturing of Refined Lubricant oil @ 3.5 KL/day and Light Diesel oil @ 1.5 Kl/day by using waste/used oil @ 5 KLD, subject to certain conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Now the industry has applied for obtaining varied consents to operate under the Water Act, 1974 and the Air Act, 1981 in the name of M/s Gursewak Oil Industries, D-5P, Industrial Focal Point, Abohar, District Fazilka for manufacturing of Refined Lubricant oil @ 3.5 KL/day and Light Diesel oil @ 1.5 Kl/day by using waste/used oil @ 5 KLD.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The applications of the industry were examined and it was observed that:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">As per the C.A. certificate submitted by the industry during last CTO applications, the industry had fixed assets of Rs. 74.26 lacs as on 31.08.2017. But now, as per the latest C.A. certificate, there has been increase in fixed assets of Rs. 2 lacs on a/c on land and about Rs. 5 lacs on a/c of machinery. However, the industry has not clarified the details regarding land & machinery increased.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><span style="font-family: 'Tahoma','sans-serif';">The industry has still not obtained PLI cover under Public Liability Insurance Act, 1991, which is mandatory for the unit in case of any accident / mishappening due to the industry.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry has not submitted compliance of the Standard Operating Procedures (SOP) framed by CPCB for utilization of used / waste oil procured by the industry.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">In view of above, t<span style="background: white;">he industry has been issued show cause notice refusal of 'consents to operate' under the provisions of Water Act, 1974 & Air Act, 1981 with an opportunity of personal hearing on </span><span style="mso-bidi-font-weight: bold;">29.11.2022, which was postponed to 30.11.2022.</span></span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; background: white;"><span style="mso-tab-count: 2;"> </span>During hearing, <span style="font-family: 'Tahoma','sans-serif';">Sh. Gurpreet Singh & Sh. Lalit Mohan Bansal, Partners of the industry attended the hearing and stated that the increase in fixed assets on account of land was due to the pending installment to PSIEC authorities, which has now been paid and the increase in fixed assets of account of machinery was due to repair work only and no addition in land / building has been done by the industry. They submitted a copy of the draft submitted to PSIEC authorities and bills of machinery repaired. They further submitted a copy of PLI cover of Rs. 4 Cr obtained by the industry and compliance report of standard operating procedure framed by CPCB for utilization of used / waste oil to be procured by the industry and requested for grant of consents to the industry.</span><strong><span style="font-family: 'Tahoma','sans-serif';"> </span></strong></span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; color: red; background: white;"><span style="mso-tab-count: 1;"> </span></span><span style="font-family: 'Tahoma','sans-serif'; background: white;"><span style="mso-tab-count: 1;"> </span>After hearing the partners of the industry as well as officer of the Board, it has been decided that:-</span></p>
<p class="MsoNormal" style="margin-left: .25in; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-style: italic;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; background: white; mso-bidi-font-style: italic;">Consents to operate under the Water Act, 1974 & Air Act, 1981 be granted to the industry for a period up to 30.06.2023 so as to enable the industry to obtain authorization as well as registration-cum-passbook under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.</span></p>
<p class="MsoNormal" style="margin-left: .25in; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-style: italic;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; background: white; mso-bidi-font-style: italic;">The industry shall not procure and process used oil / waste oil until the industry obtains authorization and registration-cum-passbook under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.</span></p>
