<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">It was brought out that the agency is a service station and has been installed & commissioned without obtaining NOC / consents to operate of the Board under the provisions of the Water Act, 1974 & Air Act, 1981. </span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">The agency was found violating the provisions of the Water Act, 1974 & Air Act, 1981 and was afforded no. of opportunities by way of issuing show cause notices / affording opportunities of personal hearings, however the agency failed to make the ETP operational and also failed to provide proper arrangements for utilization of treated effluent onto land for plantation. </span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">Direction u/s 33-A of the Water Act, 1974 was issued to the agency vide Board’s letter no. 4499 dated 19.11.2018 to the effect that the agency shall not operate the washing section without the prior consent to operate of the Board under the Water Act, 1974. </span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">The agency was visited by officer of the Board on 01.02.2022 and it was observed that the washing of vehicles was being carried out in violation of the directions issued 33-A of the Water Act, 1974 vide Board’s letter no. 4499 dated 19.11.2018 as well as without obtaining consent under the Water Act, 1974 and moreover effluent treatment plant was not in operation.</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">Notice for violations of directions issued u/s 33-A of Water Act, 1974 was issued to the agency along with an opportunity of personal hearing on 03.03.2022, wherein it was decided that:</span></p>
<p class="MsoNormalCxSpFirst" style="margin-left: .5in; mso-add-space: auto; text-align: justify; text-indent: -.5in; line-height: 125%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 125%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 125%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-family: 'Times New Roman'; background: white; mso-bidi-language: PA;">The agency shall not operate its washing section without obtaining prior consent to operate of the Board under the Water Act, 1974.</span></p>
<p class="MsoNormalCxSpMiddle" style="margin-left: .5in; mso-add-space: auto; text-align: justify; text-indent: -.5in; line-height: 125%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 125%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><span style="font-size: 11.0pt; line-height: 125%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-family: 'Times New Roman'; background: white; mso-bidi-language: PA;">Environmental Engineer, Regional Office, Bathinda shall seal the washing section of the agency with immediate effect and shall report compliance.</span></p>
<p class="MsoNormalCxSpLast" style="margin-left: .5in; mso-add-space: auto; text-align: justify; text-indent: -.5in; line-height: 125%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 125%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 125%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-family: 'Times New Roman'; background: white; mso-bidi-language: PA;">EE, RO, Bathinda shall also submit clear cut comments regarding suitability of site of the agency to carryout operations at the present location viz-a-viz applicability of zoning regulations of Master Plan of Bathinda and shall ensure submission of requisite comments/report within one week.</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">The agency was visited by the officer of the Board on 11.05.2022 and the washing section of the agency was sealed.</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">The agency has applied for obtaining fresh consents to operate of the Board under the Water Act, 1974 & Air Act, 1981. From the perusal of the documents submitted by the agency it was found that the agency has failed to submit certificate from the authorities concerned (Department of Town & Country Planning/Local Body) to the effect that the activities of the agency are permissible at the present location in accordance with the Zoning regulations of the Master Plan, Bathinda. </span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">The agency was visited by the officer of the Board on 26.10.2022 and observed that the hazardous waste of category 5.1 is stored in the scrap room and no specific area has been provided for the storage of the hazardous waste. Also, the agency has not applied/obtained authorization as required under the HOWM Rules, 2016.</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">In view of above, the agency has been issued show cause notice before refusal of consents to operate under the provisions of Water Act, 1974 and Air Act, 1981 with an opportunity of personal hearing on 01.12.2022.</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">During hearing, the representative of the industry requested for grant of 10 days time for getting requisite site suitability certificate from the authorities concerned (Department of Town & Country Planning / Local Body) and to make compliance under the Hazardous & Other Wastes (Management & Transboundary Movement) Rules 2016.</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">After hearing the representative of the industry and officer of the Board, the Chief Environmental Engineer (B) has decided that:</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: -.5in; margin: 0in 0in 6.0pt .5in;"><span style="font-size: 11.0pt; font-family: 'Tahoma','sans-serif'; font-style: normal;">a)<span style="mso-tab-count: 1;"> </span>The industry shall submit requisite site suitability certificate from the authorities concerned (Department of Town & Country Planning / Local Body) and to make compliance under the Hazardous & Other Wastes (Management & Transboundary Movement) Rules 2016, within 10 days.</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: -.5in; margin: 0in 0in 6.0pt .5in;"><span style="font-size: 11.0pt; font-family: 'Tahoma','sans-serif'; font-style: normal;">b)<span style="mso-tab-count: 1;"> </span>Regional Office shall visit the industry immediately after 10 days to verify the compliance and thereafter, send afresh report / recommendations for disposal of pending consent applications.</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: -.5in; margin: 0in 0in 6.0pt .5in;"><span style="font-size: 11.0pt; font-family: 'Tahoma','sans-serif'; font-style: normal;">c)<span style="mso-tab-count: 1;"> </span>The industry shall apply for obtaining authorization under the Hazardous & Other Wastes (Management & Transboundary Movement) Rules 2016 within one week immediately after making compliances under the said Rules, within 10 days as per decision no. (a) above.</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: -.5in; margin: 0in 0in 6.0pt .5in;"><span style="font-size: 11.0pt; font-family: 'Tahoma','sans-serif'; font-style: normal;">d)<span style="mso-tab-count: 1;"> </span>During hearing, representative of the industry was made clear that in case of non-compliance of above decisions within stipulated time, no further opportunity shall be given to the industry and further action as deemed fit would be taken in the matter.</span></p>
