<p><span lang="EN-US">RO has reported that the subject cited industry was visited surprisingly by the officers of this office on 13/05/2022 and observed that the industry was manufacturing plastic carry bags and violating the provisions of Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974, without having valid consents from the Board.:</span></p>
<p><span lang="EN-US">Accordingly, directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 & u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 were issued by Zonal Office letter no. 2779 dated 26/08/2022 as under:</span></p>
<p><span lang="EN-US">1. </span><span lang="EN-US">That the industry shall stop operating industrial plant & stop forth with discharging any emissions/effluent from its Industrial premises into atmosphere.</span></p>
<p><span lang="EN-US">2. </span><span lang="EN-US">That Industry shall not restart any process/plant for manufacturing of banned Single Use Plastic (SUP) Items and banned plastic carry bags.</span></p>
<p><span lang="EN-US">3. </span><span lang="EN-US">That the industry shall not restart discharging emission/effluent until it obtains the consent of the Board to operate u/s 21 of the Air (Prevention & Control of Pollution) Act, 1981 and u/s 25/26 of the Water (Prevention & Control of Pollution) Act 1974.</span></p>
<p><span lang="EN-US">4. </span><span lang="EN-US">That Punjab State Power Corporation Ltd. will disconnect the supply of electricity available to industry.</span></p>
<p><span lang="EN-US">5. </span><span lang="EN-US">That Industry shall submit Environmental Compensation amounting Rs. 2.0 Lakh to Punjab Pollution Control Board, Regional Office, Amritsar, Immediately.</span></p>
<p><span lang="EN-US">Further, electric connection of the industry was disconnected vide TDCO no. 100011607254 dated 04/10/2022.</span></p>
<p><span lang="EN-US">Thereafter, the industry approached this office and submitted a request letter to waive off its penalty, which was forwarded to Competent Authority of the Board. As per reference received vide E-office Computer No. 109782, the Competent Authority has decided that the industry shall submit Environmental Compensation of Rs 2.0 Lakhs in 04 equal installments.</span></p>
<p><span lang="EN-US">Now, the industry has applied for obtaining fresh consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 for manufacturing of industrial packaging material @ 400 kgs/day by using Poly Propelene/virgin granules.</span></p>
<p><span lang="EN-US">Details of the application is as under:</span></p>
<p><span lang="EN-US">1. </span><span lang="EN-US">The industry has submitted CA Certificate with gross value of block of fixed assets is Rs 30,12,746/-. The industry has deposited Rs 25,800/- (Rs 15,800/- vide R. No. 35/4574 dated 30/10/2018 and Rs 10,000/- vide UTR No. N286222161648102 dated 13/10/2022) and Rs 25,800/- (Rs 15,800/- vide R. No. 38/4574 dated 30/10/2018 and Rs 10,000/- vide UTR No. N286222161649073 dated 13/10/2022) as consent fee under Air Act, 1981 and Water Act, 1974. The industry has commissioned in the year 2008 and considering it under the Voluntary disclosure scheme (VDS), the consent fee deposited it adequate for a period upto 31/12/2023 after deducting penalty of 400% of one year of consent fee as applicable. The industry has also deposited Rs 1800/- vide R. No. 37/4574 dated 30/10/2018 as NOC regularization fee.</span></p>
<p><span lang="EN-US">2. </span><span lang="EN-US">The industry has submitted land classification from department of Town and Country Planning bearing memo no. 790 dated 22/05/2018, wherein it has been mentioned that the industry has been operating at the site bearing Khasra No. 5//15/1, 15/2, 15/3, 5//17/1 in the revenue estate of Vill. Jhita Kalan since 2008 for manufacturing of plastic packaging material and permitted to operate at the site as the industrial plant falls under green category. Since, the industry has been operating since 2008 (before the notification of Master plan) as such CLU is not required in this case.</span></p>
<p><span lang="EN-US">3. </span><span lang="EN-US">The industry has submitted site plan cum location plan.</span></p>
<p><span lang="EN-US">4. </span><span lang="EN-US">The industry has submitted registry of the land area, wherein area of 1250 yards (where industry is established) from above mentioned khasra nos. is to name of Prop. Sh. Amritpal Singh.</span></p>
<p><span lang="EN-US">5. </span><span lang="EN-US">The industry has deposited Rs 50,000/- in this office as first installation of EC imposed to the industry.</span></p>
<p><span lang="EN-US">The industry was visited by undersigned on 05/12/2022 and observed as under:</span></p>
<p><span lang="EN-US">a) </span><span lang="EN-US">The industry was not in operation for any activity and electric connection of the industry was found disconnected.</span></p>
<p><span lang="EN-US">b) </span><span lang="EN-US">The industry has now removed carry bag manufacturing machinery / dyes form its premises and has installed 03 no. extruder machines for manufacturing of industrial packaging material.</span></p>
<p><span lang="EN-US">c) </span><span lang="EN-US">The industry has provided septic tank for treatment of domestic effluent with provision of outlet onto land for plantation along the boundary.</span></p>
<p><span lang="EN-US">In view of the above, the industry is suitable to operate at the mentioned location, RO has therefore recommended that:</span></p>
<p><span lang="EN-US">i) </span><span lang="EN-US">Consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry upto 06 months subject to the suitable conditions and special conditions as under:</span></p>
<p><span lang="EN-US">a. </span><span lang="EN-US">The industry shall deposit the remaining installments of Environmental Compensation to this office.</span></p>
<p><span lang="EN-US">b. </span><span lang="EN-US">The industry shall never indulge in manufacturing, storing and packing of plastic carry bags/single use bags.</span></p>
<p><span lang="EN-US">ii) </span><span lang="EN-US">Directions may be issued to Punjab State Power Corporation Ltd. Authorities to restore the electric connection of the industry for 06 months period.</span></p>
<p><span lang="EN-US">In view of above, it is recommended that</span><span lang="EN-US">:</span></p>
<p><span lang="EN-US">i) </span><span lang="EN-US">Consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry temporarily upto 06 months subject to the suitable conditions and special conditions as under:</span></p>
<p><span lang="EN-US">a. </span><span lang="EN-US">The industry shall deposit the remaining installments of Environmental Compensation Rs. 1,50,000/- upto 31/01/2023.</span></p>
<p><span lang="EN-US">b. </span><span lang="EN-US">The industry shall never indulge in manufacturing, storing and packing of plastic carry bags/single use bags.</span></p>
<p> </p>
<p><span lang="EN-US">ii) </span><span lang="EN-US">Directions may be issued to Punjab State Power Corporation Ltd. Authorities to temporarily restore the electric connection of the industry for 06 months period.</span></p>
