CTOW/Renewal/RPN/2018/7561117 dated 14/05/2018 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/RPN/2018/7560992 dated 14/05/2018, both of which were expired on 30/09/2022 for Sand, Bajri, boulder, Gataka @10000CFT/day subject to the suitable conditions mentioned therein.<span style="mso-tab-count: 1;"> </span> </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">Thereafter, the unit was issued show cause notice for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. 224 dated 01.02.2022 with an opportunity of personal hearing on 14.02.2022, wherein, it was decided as under:</span></p>

<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">Now, the industry has applied for obtaining renewal of 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for operation of screening-cum-washing plant @ 10,000 CFT/Day. In reply to the clarification, the unit has submitted an undertaking, wherein, it has mentioned that the unit has wrongly filled the application form and as attached the undertaking the unit is only a screening-cum-washing plant for obtaining consent to operate for operation of screening plant. Further, the applicant has requested to grant consent to operate for screening-cum-washing plant. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">The unit has submitted undertaking regarding code of practice and regarding legal mining, raw material slips from mining site Bhallan, Rupnagar, compliance of previous consent, and consent fee. The unit has submitted the CA certificate wherein the value of fixed assets of the industry as on 16.09.2022 is of Rs. 28.02 Lakhs with the value of plant and machinery of Rs. 22.45 lakhs. Further, as per record file, the fee deposited by the industry under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 was adequate upto 30.06.2023 as per circular dated 18.07.2013. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">Now, the unit has deposited Rs. 14,500/- vide UTR No. SBIN122319552604 dated 15.11.2022 under the Water Act, 1974 and Rs. 14,500/- vide UTR No. SBIN122319551302 dated 15.11.2022, under the Air Act, 1981. As such, the fee deposited by the industry under the Water Act, 1974 and the Air Act, 1981 is adequate upto 30.09.2028 after adjusting penalty @ 10% as per circular dated 29.10.2018.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="Default" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; color: windowtext; mso-font-width: 110%; mso-bidi-language: AR-SA;">Further, it is pertinent to mention here that the Executive Engineer, Deptt. of Irrigation-Cum-Mining, Rupnagar has informed through e-mail dated 20.10.2022 that there are 03 no. gravel mining sites operational in District Rupnagar i.e. Bhallan, Kotbala & Aaspur and Bari Haveli for obtaining raw material. The unit has submitted the slips of obtaining raw material from the approved mining site of District Rupnagar i.e. Bhallan de-silting site during verified by the Department of Mining. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">The unit was visited by the AEE of this office on 30.11.2022 and Sh. Pardeep Singh, Munshi was contacted. During visit, it was observed as under:</span></p>

<p class="MsoBodyText" style="text-indent: 67.0pt; line-height: 155%; margin: 5.95pt 0cm 6.0pt 5.0pt;"><span style="font-family: 'Bookman Old Style','serif'; mso-font-width: 110%;">In view of the above facts, may if approved, the show cause notice may be dropped and short term consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be renewed upto 30.09.2023, subject to the suitable conditions as mentioned in the previous consents granted to the unit and additional conditions as under:</span></p>

No correspondence is received in this regard yet.</span></p>
