Discussed. The industry is a small scale rolling mill and was granted consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/FGS/2017/6718838 dated 17/11/2017 and under the Air Act, 1981 vide no. CTOA/Fresh/FGS/2017/6718841 dated 17/11/2017 both valid upto 30/09/2022 for the manufacturing of Flat, Angles, Rounds, Squares etc. @ 25 T/day under Orange category. Now the industry has shifted its fuel to PNG. It has added land in year 2017-19 and upgradation of rolling mill with new stands, shearing machine cooling bed etc leading to higher efficiency and increased capacity. Further, it has also increased its production capacity 5 times without even obtaining 'consent to establish' (NOC) from the Board. The industry has submitted copy of registration deeds of newly purchased land of area 4 Kanal 7 Marle 1 1/2 Sarsahi on 26.10.2017 and 2 Kanal 1 Marla, 5 Kanal 6 Marle, 3 Kanal 4 Marle on 20.11.2018 and it has submitted an undertaking that the said land will not used for industrial purpose, as it has neither obtained CLU nor it has submitted land use classification certificate. The industry has included said laid in the boundary wall.  So, this office is of the opinion that the industry may be issued SCN before refusal of CTO under the Water Act, 1974 and Air Act, 1981 along with an opportunity of personal hearing before the SEE, Zonal Office-2, Patiala.
