<p>R/sir, the Senior Law Officer has given the legal opinion in the subject cited matter (copy enclosed). In the said opinion, the SLO has recommended as under: - </p>
<p>"After considering all the facts and circumstances of the case, notification issued by the PPCB, Core Committee decision, draft notification of MoEF and CC, It is observed that the HMP is being set up purely on temporary basis. Prevailing Conditions confrom that the State Highway is 200 mt away from the Site of the Project. The draft notification of the MoEF will be confirmed after 60 days from the date of issue on 4-11-2022 i.e. in the second day (week) of January 2023. The project is of National and State Importance and is in the Larger Public Interest which will create Infrastructure and usher new era of development and economic activity in the State. The Department of Town and country Planning has given permission. </p>
<p>Moreover, the temporary project will be dismantled after the completion of the construction of the road. I do not find any reason to decline NOC on provisional basis to the project of great importance. However. suitable conditions may be imposed to avoid any environmental Pollution. An undertaking may be obtained from the Building Company that in case any Complaint of pollution is received against the operation of the HMP, then the source of pollution has to be relocated at the Safe distance.</p>
<p>Opined accordingly. In the first instance permission for one year with suitable conditions may be given; after obtaining the undertaking."</p>
