Also, electric connection of the industry was restored upto that period.</span></p>

As per orders of the Hon’ble NGT, a team was constituted. The industry was visited by said team comprising of Er. Atul Kaushal, AEE, Punjab Pollution Control Board, Er. Taranjit Arora (SDE, PWD (B&R), Sh. Dalvir Singh, Assistant Scientific Officer, Punjab Pollution Control Board on 30.08.2022 at around 03.00 pm and the report was as under :-</span></p>

But, with operation of the industry it increases from 68.7 dB(A) to 70.8 dB(A), when all the gates and internal doors of the industry were closed and all the preventive measures i.e. insulation/thermocol sheet were in place. The noise level increases from 68.7 dB(A) to 79.2 dB(A), when all the gates and internal doors were opened.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; mso-fareast-language: EN-IN; mso-bidi-language: PA;">The above results show that the industry was not complying with the provisions of the Air Act, 1981 as well as conditions imposed in consent to operate granted to it under Air Act, 1981.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; mso-fareast-language: EN-IN; mso-bidi-language: PA;">Due to above violations, following actions were taken against the indsutry:</span></p>

<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; mso-fareast-language: EN-IN; mso-bidi-language: PA;">Thereafter, the industry filed an application before Hon'ble NGT challenging the orders of disconnection issued by PPCB and Hon'ble NGT vide its order dated 23.11.2022 has granted interim relief to the industry. The operating paragraphs of the detailed orders issued by Hon'ble NGT are as under :-</span></p>

Further, respondents no. 1 and 2 have not filed copy of the consent granted to the project proponent to show as to what was the prescribed standard for noise which the project proponent is required to comply.</span></em></strong></p>

In the facts and circumstances of the case, it will be appropriate that no immediate recourse is made to issuance of order for closure of units in the area without due deliberation of the questions involved. Therefore, it will be just and proper that the closure and electricity disconnection orders issued in respect of the unit of project proponent is kept in abeyance till decisions of the questions involved in the present application. Accordingly, till further orders to the contrary closure and electricity disconnection orders issued in respect of the unit of the project proponent shall remain in abeyance.</span></em></strong></p>
