<p class="TableParagraph" style="margin-left: 0in; text-indent: 1in; line-height: 150%; text-align: justify;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">It is submitted that industry was granted fresh consents to operate for manufacturing of Ferrous Sulphate @ 5 T/day by using Iron dust @ 2 T/day, Sulphuric acid @ 2 T/day and Water @ 1 T/day, as raw material, under orange category under the Water Act, 1974 and the Air Act, 1981 vide nos. CTOW/Fresh/FZL/2022/18360581 dated 10.05.2022 and CTOA/Fresh/FZL/2022/18359409 dated 10.05.2022 respectively both valid upto 09.11.2022 with certain conditions mentioned therein and electric connection was restored for a period upto 09.11.2022, with certain conditions mentioned therein alongwith following special conditions:-</span></p>
<p class="TableParagraph" style="margin-left: 0in; text-indent: 0in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry will not procure any Hazardous waste as raw material. </span></p>
<p class="TableParagraph" style="margin-left: 0in; text-indent: 0in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry shall comply with the zoning regulations / by-laws of Master Plan, Abohar.</span></p>
<p class="TableParagraph" style="margin-left: 0in; line-height: 150%; text-align: justify;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> The industry was visited by undersigned alongwith ASO of the Board on 10.11.2022 and during visit, it was observed that the industry was not in operation for the manufacturing of ferrous sulphate by using iron scrap & sulphuric acid. The representative of the industry submitted that the industry will be commissioned in a month. No raw material/ product was found at the stie of industry. Electric connection of the industry was found intact. During visit, the industry was advised to apply for consent to operate of the Board under the Water Act, 1974 and the Air Act, 1981. The PSPCL Authorities were requested vide this office letter no. 6780-81 dated 15.11.2022 to disconnect the electric supply to the unit. </span></p>
<p class="TableParagraph" style="margin: 4.5pt 0in 0.0001pt; line-height: 150%; text-align: justify;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> Now, the industry has applied for obtaining renewal consents to operate of the Board under the Water Act, 1974 and the Air Act, 1981 on 22.11.2022 for manufacturing of Ferrous Sulphate @ 5 T/day by using Iron scrap @ 2 T/day, Sulphuric acid @ 2 T/day and Water @ 1 T/day, as raw material, under orange category alongwith requisite documents and adequate consent fees under both Acts.</span></p>
<p class="TableParagraph" style="margin: 4.5pt 0in 0.0001pt; line-height: 150%; text-align: justify;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Detail of the case is as under:-</span></p>
<p class="TableParagraph" style="margin-left: 0in; text-indent: 0in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry has submitted CA certificate of dated 31.10.2022, which shows the un-depreciated value of fixed assets of the industry as on 31.10.2022 of amounting Rs. 12.38 lacs (including plant & machinery value as Rs. 10.38 lacs). Accordingly, the industry has already deposited consent fees of amounting Rs. 7000/- vide R. No. 76/1474 dated 10.02.2000 and Rs. 46,000/- vide UTR/Ref. No. AXSK220950015680dated 05.04.2022 under the Water Act, 1974 and Rs. 7000/-vide R. No. 751474 dated 10.02.2000 and Rs. 46,000/- vide UTR/Ref. No. AXSK220950015728dated 05.04.2022 under the Air Act, 1981, which is adequate upto 30.09.2026 under both Acts</span></p>
<p class="TableParagraph" style="margin-left: 0in; text-indent: 0in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">lease deed executed on 19.02.2010 between M/s Sardar Chem Fert Industries through its partner Jagat Periwal, Abohar (lessor) and M/s Sardar Agro Industries, Abohar through its proprietor Sh. Sahil Periwal (lessee) which states that lesser has agreed to lease out its Fertilized Factory situated at village Burj Muhar, Fazilka Road, Abohar to the lessee for the period 19.02.2010 to 28.02.2020 on lease for amounting of Rs. 108000/- per annual under certain terms and conditions mentioned therein. On 28.02.2020, both the parties extended the lease period for 3 years i.e. w.e.f. 28.02.2020 to 28.02.2023 with mutual understanding and the remaining terms and conditions will be same of lease deed dated 19.02.2020.</span></p>
<p class="TableParagraph" style="margin: 4.5pt 0in 0.0001pt; line-height: 150%; text-align: justify;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> To verify the facts and process the application, the industry was visited on 08.12.2022 by undersigned and during visit, it was observed as under: </span></p>
<p class="MsoListParagraphCxSpFirst" style="margin: 0in 0in 10pt; text-indent: 0in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry was not in operation for manufacturing of Ferrous Sulphate due to disconnection of electric connection. Industry has now stored raw material at the site. No Hazardous waste was also procured by the industry</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 10pt; text-indent: 0in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry has provided hood over reactor and alkali water scrubber has been installed as APCD with stack of adequate height.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 10pt; text-indent: 0in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry has provided 4 mud tank for drying of mud from filter press and during the visit, no mud was found stored in the industrial premises. The representative of the industry informed that the mud is being utilized by farmers in agricultural fields.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 10pt; text-indent: 0in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry has provided recirculation arrangements for re-circulating entire process waster back into reactor.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin: 0in 0in 10pt; text-indent: 0in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">For the treatment of domestic effluent of the industry, the industry has provided septic tank and with provisions to discharge onto plantation along boundary. During visit, no labour was residing in quarter. </span></p>
<p class="MsoNormal" style="margin-left: 0in; line-height: 150%; text-align: justify;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> As such the industry is now complying with the provision of the Water Act, 1974 and Air Act, 1981.</span></p>

<p class="MsoNormal" style="margin-left: 0in; line-height: 150%; text-align: justify;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> Keeping in view of above, it is recommended for grant of consents to operate to the industry under the Water Act, 1974 and Air Act, 1981 for a period of six months and directions u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 for further temporary restoration of electric connection for six months with specific condition that the industry shall submit extended lease deed before the expiry of previous lease deed failing which consent to operate granted will be revoked/cancelled without any opportunity.</span></p> |
