It is submitted that the industry is a brick kiln unit, which falls under orange category and is a small scale unit. The industry was earlier granted consents to operate vide nos. CTOW/Varied/FZL/2020/14119560 and CTOA/Varied/FZL/2020/14119637 dated 16/11/2020 under the Water Act, 1974 and the Air Act, 1981, respectively for operation of a brick kiln for production of bricks & tiles @ 30000 nos./day, subject to suitable conditions mentioned therein, valid upto 30/09/2025 each.                        A complaint was received against the kiln due to not complying with the conditions of consents granted to it.                        To verify the compliance status the brick kiln, the kiln was visited by AEE of this office on 15.05.2021 and it was observed as under:– 1.     The brick kiln was in operation with induced draft technology and crushed coal as fuel was being used in the kiln. However, the kiln has stored waste of Guar crop for use in the kiln as fuel. 2.     The kiln has earlier provided along its boundary wall out of which, the plantation along the two side of the boundary wall was found destroyed. 3.     The kiln has provided septic tank for treatment of domestic effluent of labour quarters with provisions of discharge onto land for plantation, but the kiln has not provided treatment facility for treatment of domestic effluent of office building, same was being discharged into soakage pit.                        As, the kiln has failed to comply with the conditions of consents granted to it under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. Accordingly, show cause notice for revocation and cancellation of consent to operate granted under the Water Act, 1974 and the Air Act, 1981 were issued to the kiln vide this office letter no. 1818 dated 21/05/2021, however, the kiln has failed to submit any reply to the show cause notice issued to it.                        The kiln was again visited by AEE of this office on 30/11/2021 and same status as observed during visit to the kiln on 15.05.2021 by this office.                        As the kiln was violating the conditions of consent to operate granted to it under the provisions of the Water Act, 1974 and the Air Act, 1981. Also, the kiln has failed to submit any compliance w.r.t. show cause notice issued to it.                        Therefore, consents to operate granted to the brick kiln under the provisions of Water Act, 1974 and the Air Act, 1981 were revoked and cancelled vide this officeletter no. 3949 and 3948 dated 02/12/2021, respectively.                        As, the brick kiln is violating the provisions of Water Act, 1974 and Air Act, 1981. Therefore, notices to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 were issued vide Board’s letter no. 218 and 221 dated 11.01.2022, respectively.                        Thereafter, the brick kiln had applied for obtaining renewal consent to operate under the Water Act, 1974 and the Air Act, 1981 for its operation with induced draft technology with zig-zag firing to manufacture bricks and tiles @ 30,000 nos./day.                        Details of the case are as under:- §  The brick kiln had submitted feasibility/technical report along with completion drawing bearing no. 19/473 from M/s Team Energy System authorized licensee of M/s Central Building Research Institute, Roorkee regarding induced draft zig-zag technology to be adopted by the kiln and Completion certificate dated 29.12.2020 via drawing no. 19/473 issued by M/s CSIR-CBRI, Roorkee. §  The brick kiln had submittedlease deed executed on dated 01.08.2021 which states that Sh. Krishan Kumar S/o Sh. Bishna Ram, R/o Village Dharampura, Tehsil Abohar and Sh. Binderpal Goyal S/o Sh. Roshan Lal, R/o Abohar are entered in the business of the partnership to operate a brick kiln unit namely M/s B.M.K. BKO, Village Dharampura, Tehsil Abohar. §  The brick kiln had submitted partnership deed dated 01.08.2001 which states that Sh. Krishan Lal S/o Sh. Bishna Ram, R/o Village Dharampura, Tehsil Abohar, Distt. Fazilka and Sh. Binderpal Goyal S/o Sh. Roshan Lal, R/o Abohar, Tehsil Abohar, Distt. Fazilkahave decided to enter into partnership to carry out business of brick kiln under the name & style of M/s B.M.K. BKO, Village Dharampura, Tehsil Abohar, Distt. Fazilka. §  The brick kiln had submitted CA certificate of dated 07.03.2022 showing value of gross fixed assets of the industry as Rs. 15.96 lac (value of land on lease for 10 years as Rs. 250000/- and value of building and machinery as Rs. 1346076/-) as on 31.03.2021. §  The brick kiln had already deposited Rs. 13,000/- vide UTR/Ref. no. AXSK202880015344 dated 14.10.2020 and now deposited Rs. 10,800/- vide UTR/Ref. no. AXSK220700000979 dated 11.03.2022 under the Water Act, 1974, which was adequate for period upto 31.03.2031 against the value of gross fixed assets of Rs. 15.96 lac under orange category. §  The brick kilnhad already depositedRs. 21,600/- vide UTR/Ref. no.  PSIBN21230070150 dated 18.08.2021 and now deposited Rs. 10,800/- vide UTR/Ref. no.     AXSK220700001215 dated 11.03.2022 under the Air Act, 1981, which was adequate for a period upto 31.03.2031 against the value of gross fixed assets of Rs. 15.96 lac under orange category.                        To verify the facts and process the application, the brick kiln was visited by undersigned (AEE) on 28.03.2022 and it was observed as under:– 1.          The brick kiln was in operation with induced draft zig-zag technology. Bricks are lying in a Zig-Zag way. No unauthorized fuel was found lying at kiln site. However, the kiln has stored waste of Guar crop for use in the kiln as fuel. The representative of kiln has assured to lift the same within a week. 2.          The brick kiln has upgraded its kiln into induced draft zig-zag technology. AVFD fan has been provided with the chimney and the length of the brick kiln (central island was less than 245 feet as required by the Board. 3.          The brick kiln has provided adequate sampling facilities with kiln stack to facilitate emission sampling. 4.          The kiln has stabilized the periphery road/movement area with brick bats/keri. 5.          The brick kiln has now planted sapling along its boundary on all sides of the boundary. 6.          The brick kiln has now provided septic tank for the treatment of domestic effluent from labour quarter & office block and same is being discharge onto sapling along the boundary. The soakage pit earlier provided was founded plugged. 7.          The brick kiln has complied with the code of practice prescribed by the Govt./Board for such type of units as well as with the provisions of the Water Act, 1974 and the Air Act, 1981.                        Thereafter, the industry was again visited by undersigned on 20.04.2022 and observed that the Guar crop waste was still lying in the premises of the brick kiln to be used as fuel. Since, the brick kiln has failed to comply with the provisions of the Water Act, 1974 and the Air Act, 1981 by using agro waste / biomass residue i.e. Guar crop waste in loose form instead of crushed coal as fuel in its induced draft zig-zag technology based kiln. Accordingly, show cause notice before refusal of consents to operate granted under the Water Act, 1974 and the Air Act, 1981 was issued to the kiln vide letter no. 2438 dated 24.05.2022. The kiln has submitted its reply to show cause notice issued to it, which was not satisfactory.                        Accordingly, it has decided by the Competent Authority to refuse the applications of the brick kiln for obtaining consents to operate applied by it under the Water Act, 1974 and the Air Act, 1981. Therefore, consents to operate under the Water Act, 1974 and Air Act, 1981 were refused to the industry vide nos.    CTOW/Renewal/FZL/2022/18182965 & CTOA/Renewal/FZL/2022/18182941 dated 20/07/2022.                        Now, the brick kiln has applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 for its operation with induced draft technology with zig-zag firing to manufacture bricks and tiles @ 30,000 nos./day. §  The brick kiln has submitted CA certificate of dated 14.11.2022 showing value of gross fixed assets of the industry as Rs. 15.96 lac (value of land on lease for 10 years as Rs. 250000/- and value of building and machinery as Rs. 1346076/-) as on 31.03.2022. The revised adequacy of CTO fee will be 30.09.2030 (50 % penalty fee imposed) §  The brick kiln has submitted a letter stating that we will only use crushed coal or only authorized fuel like paddy straw pellets as fuel. We will comply with every norm and conditions fixed by the department for running brick kiln and request to grant the consent to operate under the Water Act, 1974 and the Air Act, 1981.                        To verify the facts and process the application, the brick kiln was visited by undersigned (AEE) on 08.12.2022 and it was observed as under:– 1.    The brick kiln was not yet comes into operation. The brick kiln is ready to start its operation with induced draft zig-zag technology. Bricks are lying in a Zig-Zag way. The kiln has not stored waste of Guar crop for use in the kiln as fuel, only coal was stored at site for operation. 2.    The brick kiln has upgraded its kiln into induced draft zig-zag technology. AVFD fan has been provided with the chimney and the length of the brick kiln (central island was less than 245 feet as required by the Board. 3.    The brick kiln has provided adequate sampling facilities with kiln stack to facilitate emission sampling. 4.    The kiln has stabilized the periphery road/movement area with brick bats/keri. 5.    The brick kiln has made plantation along its boundary. 6.    The brick kiln has provided septic tank for the treatment of domestic effluent from labour quarter & office block and same is being discharge onto plantation. The soakage pit earlier provided was founded plugged.                        The brick kiln has complied with the code of practice prescribed by the Govt./Board for such type of units as well as with the provisions of the Water Act, 1974 and the Air Act, 1981.                        Keeping in view of above, it is recommended that regular consent to operate under the Water Act, 1974 and Air Act, 1981 may be granted to the brick kiln for production of bricks & tiles @ 30,000 nos./day using induced draft zig-zag technology for a period of 30.09.2030, respectively, with suitable conditions.
