<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">It was brought out that the industry was granted 'consent to establish'(NOC) under the provisions of the Water Act, 1974 & Air Act, 1981 for production of Carbonated Juice @ 30,000 Liter/day & Mineral water @ 10,000 liter/day.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry obtained consents to operate under the provisions of the Water Act, 1974 & Air Act, 1981 dated 27.07.2022 (valid upto 30.09.2025) for production of Carbonated Juice @ 4,000 Liter/day.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry has applied for obtaining 'consent to establish' (for expansion) <span style="mso-spacerun: yes;"> </span>under the provisions of the Water Act, 1974 & Air Act, 1981 for the production of Carbonated Juice @ 21,000 Liter/day and Crockery @ 195 Kg/day. <span style="mso-tab-count: 3;"> </span><span style="mso-tab-count: 2;"> </span></span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">From the perusal of the documents submitted by the industry it was observed as under:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry has not submitted any latest certificate from the concerned authority regarding distance of the industry from the Municipal Council limits/ phirni of village/ designated residential area /residential area comprising of 15 pucca houses.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">CLU has been obtained for land area of 08 Kanals falling in the revenue estate of village Gobindpura, Distt. Bathinda for Carbonated Juice & drinks, however now the industry has also proposed to manufacture crockery.</span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">'Consent to establish'/operate has been granted to the industry for its operation in 08 kanals land area and now registered deed of another 04 kanal land area in the name of the partner of the industry is attached with the application, however no reference of this additional land area is mentioned in the application form.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>In view of above, the industry has been issued show cause notice for refusal of 'consent to establish' (for expansion) under the provisions of Water Act, 1974 & Air Act, 1981 with an opportunity of personal hearing on 05.12.2022.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">During hearing, Sh. Gurdeep Singh, Partner of the industry submitted written reply which has been taken on record. He stated that:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: 150%; mso-list: l2 level1 lfo2; margin: 0in 0in .0001pt 22.5pt;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry has obtained NOC for production of Carbonated Juice @ 40,000 Liter/day, however consent to operate was obtained for production of Carbonated Juice @ 4,000 Liter/day. The current production capacity of Carbonated Juice is 30,000 Liter/day.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: 150%; mso-list: l2 level1 lfo2; margin: 0in 0in .0001pt 22.5pt;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The new unit regarding production of crockery (bottles/glasses) will be operated within the same premises i.e. 08 kanals and there is no addition of any land area. </span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: 150%; mso-list: l2 level1 lfo2; margin: 0in 0in .0001pt 22.5pt;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry has already obtained change of land use for industrial purpose (carbonated Juice & drinks) from the Department of Town & Country Planning and the production of crockery (bottles/glasses) is of similar nature and does not require separate CLU as there is no<span style="mso-spacerun: yes;"> </span>increase in the land area. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; background: white;"><span style="mso-tab-count: 2;"> </span>After hearing the representative of the industry as well as officer of the Board, it has been decided that:-</span></p>
<p style="text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: 150%; mso-list: l0 level1 lfo3; margin: 0in 0in .0001pt 22.5pt;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA; mso-bidi-font-style: italic;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; background: white; mso-bidi-language: PA; mso-bidi-font-style: italic;">The application submitted by the industry for obtaining consent to establish (for expansion) under the provisions of the Water Act, 1974 & Air Act, 1981 be returned and advised to resubmit the same along with the requisite documents in accordance with the observations of the Board.</span></p>
