<p style="text-align: justify;"> It is submitted that earlier, a complaint has been received from higher authorities of the Board regarding the production of plastic carry bags.</p>
<p style="text-align: justify;"> To verify the facts of the complaint, the industry was visited by undersigned on 24.05.2022 and it was observed as under:-</p>
<p style="text-align: justify;">1.<span style="white-space: pre;"> </span>The industry is operated by Sh. Harmanjit Singh S/o Sh. Gurmel Singh and the industry has engaged in the production of plastic carry bags, battery cages by using recycling of waste plastic and injection moulding process.</p>
<p style="text-align: justify;">2.<span style="white-space: pre;"> </span>The industry was found manufacturing plastic carry bags from recycled plastic granules. During the arrival, the industry has stopped the manufacturing of carry bags.</p>
<p style="text-align: justify;">3.<span style="white-space: pre;"> </span>The representative of the industry informed that the industry is operating injection moulding and recycling unit from last 2-3 years and started the production of carry bags recently. However, the representative of the industry has failed to intimate about exact date of commissioning of carry bag manufacturing unit.</p>
<p style="text-align: justify;">4.<span style="white-space: pre;"> </span>The industry has installed one injection molding machine, one extruder machine and two plastic carry bag manufacturing machines, within its premises. The injection moulding machine installed by the industry was found in operation and no APCD was provided, as the process was not a closed one. The industry has not installed APCD with extruder section and emissions being discharged without any treatment. Pictures clicked during visit are attached.</p>
<p style="text-align: justify;">5.<span style="white-space: pre;"> </span>The domestic effluent of the industry was found discharged in a soakage pit.</p>
<p style="text-align: justify;">6.<span style="white-space: pre;"> </span>The representative of the industry failed to submit any documentary proof regarding establishment of the industry and suitability of the site.</p>
<p style="text-align: justify;">7.<span style="white-space: pre;"> </span>The industry has been established without obtaining NOC of the Board and running its unit without consent to operate of the Board under Water Act, 1974 and the Air Act, 1981 and authorization under the Plastic Waste Management Rules, 2016. </p>
<p style="text-align: justify;"> In view of above, the industry has been issued notice u/s 33-A of the Water Act, 1974 and u/s 31-A of Air Act, 1981 with an opportunity of personal hearing on 23.06.2022.</p>
<p style="text-align: justify;"> During hearing, Prop. of the industry stated that he has no knowledge to the effect that the manufacturing of plastic carry bags is not permissible and now has stopped manufacturing plastic carry bags. He assured in writing that plastic carry bags will not be manufactured in future and the machine in this regard shall be removed from the premises.</p>
<p style="text-align: justify;"> During hearing, Prop. of the industry has been apprised that as per the State Govt. notifications no. 5/18/2016-41g4/692717/1 dated 18.02.2016 issued by the Department of Local Government and no. S.O.438/P.A.9/1994/S-30/2016 dated 29.03.2016 issued by the Department of Rural Development & Panchayats, the manufacturing, stocking, distribution, recycling, selling or use of plastic carry bags has been completely prohibited in the State of Punjab w.e.f. 01.04.2016.</p>
<p style="text-align: justify;"> After hearing Prop. of the industry and officer of the Board, the Chief Environmental Engineer (B) of the Board has decided that:</p>
<p style="text-align: justify;">1.<span style="white-space: pre;"> </span>The industry shall remove the plastic carry bag manufacturing machine from its premises within one week and inform this office as well as Regional Office, Faridkot of the Board, accordingly.</p>
<p style="text-align: justify;">2.<span style="white-space: pre;"> </span>The industry shall apply within one week for obtaining 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 alongwith requisite fee & documents including document pertaining to suitability of the site.</p>
<p style="text-align: justify;">3.<span style="white-space: pre;"> </span>Regional Office, Faridkot shall immediately carryout the survey of the area in question to identify the other units operating in the vicinity and submit complete report including their pollution control as well as consent status, within 15 days.</p>
<p style="text-align: justify;"> The proceedings of the personal hearing was conveyed to the industry vide Board’s letter no. 3074 dated 27.06.2022 for compliance.</p>
<p style="text-align: justify;"> Now, to check the compliance of decisions, the industry was visited by AEE of this office on 11.07.2022 and during visit, it was observed as under:-</p>
<p style="text-align: justify;">1.<span style="white-space: pre;"> </span>The unit was not in operation for production of carry bags, during visit. However, the unit has not removed the plastic carry bag manufacturing machine from its premises.</p>
<p style="text-align: justify;">2.<span style="white-space: pre;"> </span>The unit is carrying out painting in open.</p>
<p style="text-align: justify;">3.<span style="white-space: pre;"> </span>No APCD has been installed to control emissions from one extruder machine.</p>
<p style="text-align: justify;">4.<span style="white-space: pre;"> </span>The domestic effluent of the industry was being discharged into soakage pit.</p>
<p style="text-align: justify;">5.<span style="white-space: pre;"> </span>The industry has failed to apply for obtaining 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 alongwith requisite fee & documents including document pertaining to suitability of the site, till date.</p>
<p style="text-align: justify;"> As, the industry has failed to comply with the decisions of the personal hearing taken by the Chief Environmental Engineer (B) on 23.06.2022 and found deliberately violating the provisions of the Water Act, 1974 and the Air Act, 1981.</p>
<p style="text-align: justify;"> Accordingly, directions u/s 33-A under the Water Act, 1974 and 31-A of the Air Act, 1981 were issued to the industry vide Board’s letter no. 4055 & 4057 dated 23.08.2022 alongwith disconnection of electric connection of the industry vide Board’s letter no. 4051-54 dated 23.08.2022. Also, this office has written a letter to the PSPCL authority to disconnect the electric connection and submit compliance to this office vide letter no. 5015-16 dated 06.09.2022. But, no compliance has been received. Thereafter, the PSPCL authorities were again requested vide this office letter no. 1730-31 dated 14.11.2022, but no response has been received till date. </p>
<p style="text-align: justify;"> Thereafter, the industry has applied for obtaining fresh of consents to operate under the Water Act, 1974 & the Air Act, 1981 to manufacture Fiber Toys @ 600 nos./day by using Plastic Dana @ 0.2 MTD as raw material under orange category, </p>
<p style="text-align: justify;"> To verify the facts, the site of the industry was visited by AEE of this office on 29.11.2022 and it was observed as under:- </p>
<p style="text-align: justify;">1.<span style="white-space: pre;"> </span>The unit was not in operation, during visit and electric connection was lying intact.</p>
<p style="text-align: justify;">2.<span style="white-space: pre;"> </span>The unit has not removed the plastic carry bag manufacturing machine from its premises.</p>
<p style="text-align: justify;">3.<span style="white-space: pre;"> </span>The industry has installed one injection molding machine and one extruder machine, within its premises. The industry has not installed APCD with extruder section.</p>
<p style="text-align: justify;">4.<span style="white-space: pre;"> </span>The domestic effluent of the industry was being discharged into septic tank.</p>
<p style="text-align: justify;">5.<span style="white-space: pre;"> </span>No D.G set was installed by the industry within its premises.</p>
<p style="text-align: justify;">6.<span style="white-space: pre;"> </span>The industry is complying with the conditions of the consents granted under the Water Act, 1974 and the Air Act, 1981.</p>
<p style="text-align: justify;"> But the same was returned due to incomplete documents. </p>
<p style="text-align: justify;"> Now, the industry has again applied for obtaining fresh of consents to operate under the Water Act, 1974 & the Air Act, 1981 to manufacture Fiber Toys@ 600 nos./dayby using Plastic Dana @ 0.2 MTD as raw material under green category with requisite documents along with consent to operate fees.</p>
<p style="text-align: justify;"> The industry has deposited consent fees amounting Rs. 12500/- vide R. No. 553632899 dated 19.11.2022 as water consent fee under the Water Act, 1974 and Rs. 14300/- (including Rs. 1800/- as NOC fee) vide R. No. 553632899 dated 19.11.2022 as air consent fee under the Air Act, 1981, which is adequate upto 31.12.2024 against fixed assets of Rs. 12.11 lacs as on 01.09.2022 mentioned in CA certificate dated 01.09.2022. </p>
<p style="text-align: justify;"> The industry has submitted electricity bill dated 11.04.2022 as a proof of date of commissioning of the unit i.e. 03.01.2022.</p>
<p style="text-align: justify;"> Sh. Harmaneet Singh Gill has submitted GST registration certificate issued by Excise and Taxation Officer-cum-Sate Tax Officer, Ward No. 4, Ferozepur on dated 30.07.2021 as a proof of Proprietor of the firm namely M/s Gill Traders. </p>
<p style="text-align: justify;"> The industry has also submitted Registry of land executed on 29.01.2020, in which Sh. Harish Kumar S/o Sh. Satish Kumar has sold his land measuring area 2 Kanal 5 Marle to Sh. Harmaneet Singh, owner of firm, for Rs. 150000/- situated at Village Kotla, Tehsil and Distt. Ferozepur. The industry has also submitted Jamabandi of land.</p>
<p style="text-align: justify;"> The industry has submitted report issued by SDM, Ferozepur vide his office letter no. ਸਡਕ-4/1804/m dated 26.10.2022, stating that land measuring area 2 kanal 5 marla, which is 45/160 part of khasra no. 8m/2(8-0) situated in the revenue of Village Kotla, Tehsil & District Ferozepur owner of Sh. Harmaneet Singh S/o Gurmail Singh. The area is situated 100 mtr outside from Village Phirni/ LalLakir and no any Zoo, Govt. approved residential area, religious place, historical place, educational instituted, wild life sanctuary, protect monument place is not falls in this area.</p>
<p style="text-align: justify;"> The industry has submitted report issued by DTP, Ferozepur vide his office letter memo no. 1276 dated 06.12.2022, which is reproduced as under:-</p>
<p style="text-align: justify;">“ਸਾਈਟ ਨੋਟੀਫਾਈਡ ਲੋਕਲ ਪਲੈਨਿੰਗ ਏਰੀਆ ਤਲਵੰਡੀ ਭਾਈ-ਘੱਲ ਖੁਰਦ ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਜਿਸਦਾ ਮਾਸਟਰ ਪਲੈਨ ਹਾਲ ਦੀ ਘੜੀ ਨੋਟੀਫਾਈਡ ਨਹੀਂ ਹੈ, ਭਾਵ ਹਾਲ ਦੀ ਘੜੀ ਇਸ ਏਰੀਆ ਦਾ ਕੋਈ ਜ਼ੋਨ ਨਿਰਧਾਰਤ ਨਹੀਂ ਹੈ। ਸਾਈਟ ਵਿੱਚ ਮੌਕੇ ਤੇ ਬਿਲਡਿੰਗ ਬਣੀ ਹੋਈ ਹੈ ਅਤੇ ਉਦਯੋਗਿਕ ਇਕਾਈ ਚੱਲ ਰਹੀ ਹੈ। ਸਾਈਟ ਦਾ ਦੋ ਤਿਹਾਈ ਤੋਂ ਵੱਧ ਹਿੱਸਾ ਨੈਸ਼ਨਲ ਹਾਈਵੇ-54 (ਬਠਿੰਡਾ-ਅੰਮ੍ਰਿਤਸਰ) ਦੇ 200 ਮੀਟਰ ਦੇ ਘੇਰੇ ਅੰਦਰ ਆਉਂਦਾ ਹੋਣ ਕਾਰਨ ਮਾਸਟਰ ਪੈਲਨ ਤਲਵੰਡੀ ਭਾਈ-ਘੱਲ ਖੁਰਦ ਤਿਆਰ ਕਰਨ ਸਮੇਂ ਸਾਈਟ ਦੇ ਮਿਕਸ ਲੈਂਡਯੂਜ਼ ਜ਼ੋਨ ਵਿੱਚ ਆਉਣ ਦੀ ਸੰਭਾਵਨਾ ਹੈ। ਕਿਉਂਜੋ ਸਾਈਟ ਤਲਵੰਡੀ ਭਾਈ ਨਗਰ ਕੋਂਸਲ ਦੀ ਹਦੂਦ ਦੇ 2 ਕਿਲੋਮੀਟਰ ਦੇ ਘੇਰੇ ਅੰਦਰ ਪੈਂਦੀ ਹੈ, ਇਸ ਲਈ ਮਕਾਨ ਉਸਾਰੀ ਅਤੇ ਸ਼ਹਿਰੀ ਵਿਕਾਸ ਵਿਭਾਗ (ਹਾਊਸਿੰਗ-2 ਬਰਾਂਚ), ਪੰਜਾਬ ਸਰਕਾਰ ਵੱਲੋਂ ਜਾਰੀ ਨੋਟੀਫਿਕੇਸ਼ਨ ਨੰ: PS/PSHUD 206, ਮਿਤੀ 12-11-2021 ਅਨੁਸਾਰ ਸਾਈਟ ਵਿੱਚ ਕੇਵਲ ਗਰੀਨ ਕੈਟਾਗਿਰੀ ਉਦਯੋਗਿਕ ਯੂਨਿਟ ਆਗਿਆਯੋਗ ਹਨ, ਬਸ਼ਰਤੇ ਕਿ ਉਕਤ ਨੋਟੀਫਿਕੇਸ਼ਨ ਦੀਆਂ ਹੋਰ ਗਾਈਡਲਾਈਨਾਂ ਦੀ ਪ੍ਰਤੀਪੂਰਤੀ ਕਰਦੀ ਹੋਵੇ ਅਤੇ ਸਾਈਟ ਨੂੰ 4 ਕਰਮ ਚੋੜੇ ਰੈਵੀਨਿਊ ਰਸਤੇ ਤੋਂ ਪਹੁੰਚ ਪ੍ਰਾਪਤ ਹੋਵੇ।</p>
<p style="text-align: justify;"> ਇਸ ਪੱਤਰ ਦਾ ਭਾਵ ਇਹ ਨਹੀਂ ਹੈ ਕਿ ਸਾਈਟ ਪ੍ਰਵਾਨਗੀ ਦੀਆਂ ਸ਼ਰਤਾਂ ਦੀ ਪੂਰਤੀ ਕਰਦੀ ਹੈ। ਸਾਈਟ ਦੀ ਮਾਲਕੀ ਸਬੰਧੀ ਨਿਰੋਲ ਜਿੰਮੇਵਾਰੀ ਪ੍ਰਾਰਥੀ ਦੀ ਹੋਵੇਗੀ। ਇਸ ਪੱਤਰ ਨੂੰ ਸੀ.ਐਲ.ਯੂ./ਬਿਲਡਿੰਗ ਪਲੈਨ ਦੀ ਪ੍ਰਵਾਨਗੀ ਨਾ ਸਮਝਿਆ ਜਾਵੇ।”</p>
<p style="text-align: justify;"> Sh. Harmaneet Singh Gill, Proprietor has submitted an undertaking which is reproduced as under:-</p>
<p style="text-align: justify;">1.<span style="white-space: pre;"> </span>That I am Proprietor of firm namely M/s Gill Traders situated at Village Kotla, Tehsil & District Ferozepur.</p>
<p style="text-align: justify;">2.<span style="white-space: pre;"> </span>That I shall use fresh plastic dana for manufacturing fiber toys and not use recycled plastic dana in above firm. </p>
<p style="text-align: justify;">3.<span style="white-space: pre;"> </span>That the injection molding machine installed in the above firm is not generating any air emissions.</p>
<p style="text-align: justify;">4.<span style="white-space: pre;"> </span>That I don’t operate extruder machine lying in the above firm.</p>
<p style="text-align: justify;">5.<span style="white-space: pre;"> </span>That I have provided septic tank for treatment of domestic effluent generated by the above firm and have closed soakage pit.</p>
<p style="text-align: justify;">6.<span style="white-space: pre;"> </span>That I shall always abide all rules of Govt. of Punjab/ Punjab Pollution Control Board.</p>
<p style="text-align: justify;"> To verify the facts, the site of the industry was visited by undersigned on 09.12.2022 and it was observed as under:- </p>
<p style="text-align: justify;">1.<span style="white-space: pre;"> </span>The unit was not in operation, during visit and electric connection was found disconnected.</p>
<p style="text-align: justify;">2.<span style="white-space: pre;"> </span>The unit has removed the plastic carry bag manufacturing machine from its premises.</p>
<p style="text-align: justify;">3.<span style="white-space: pre;"> </span>The industry has installed one injection molding machine with closed process.</p>
<p style="text-align: justify;">4.<span style="white-space: pre;"> </span>The industry has disconnected the connections of extruder section.</p>
<p style="text-align: justify;">5.<span style="white-space: pre;"> </span>The domestic effluent of the industry was being discharged into septic tank, with further discharge to sapling provided. Soakage pit was plugged.</p>
<p style="text-align: justify;">6.<span style="white-space: pre;"> </span>No D.G set was installed by the industry within its premises.</p>
<p style="text-align: justify;">7.<span style="white-space: pre;"> </span>The industry has now provided arrangement of brush painting inside shed.</p>
<p style="text-align: justify;">8.<span style="white-space: pre;"> </span>There is no MC limit, lal lakir/phirni and residential area within 100 mtr from the site of the industry.</p>
<p style="text-align: justify;">9.<span style="white-space: pre;"> </span>The industry is complying with the conditions of the consents granted under the Water Act, 1974 and the Air Act, 1981.</p>
<p style="text-align: justify;"> </p>
<p style="text-align: justify;">In view of above, it is recommended as under:-</p>
<p style="text-align: justify;">1.<span style="white-space: pre;"> </span>Consent to operate may be granted for six months under the Water Act, 1974 and the Air Act, 1981 for manufacturing Fiber Toys @ 600 nos./day by using Plastic Dana @ 0.2 MTD as raw material under orange category with suitable conditions as per policy of the Board and special condition that:</p>
<p style="text-align: justify;">A.<span style="white-space: pre;"> </span>The industry will be bound to provide APCD with injection molding machine, in case emissions are observed.</p>
<p style="text-align: justify;">B.<span style="white-space: pre;"> </span>The industry shall remove extruder lying in its premises.</p>
<p style="text-align: justify;">C.<span style="white-space: pre;"> </span>The industry shall not carry out spray painting within its premises</p>
<p style="text-align: justify;">2.<span style="white-space: pre;"> </span>Necessary directions may be issued to the PSPCL authorities for temporary restoration of electric connection of the industry for a period of six months, please.</p>
