CTOW/Renewal/SAS/2019/9317332 dated 24.06.2019 which was valid upto 30.06.2019 and under the Air (Prevention &amp; Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2019/9317310 dated 24.06.2019 which was valid upto 30.06.2019 for a hotel having 56 hotel room and 3 banquet halls subject to certain terms and conditions mentioned therein.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The site of the project proponent was earlier visited by AEE of this office on 26.10.2021. During the visit, it was observed as under:</span></p> <p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The industry is a hotel-cum-resort.</span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The industry has installed STP at the backside near the boundary wall, however, the same was lying in defunct condition.</span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The industry is not maintaining any record regarding the operation and maintenance of STP.</span></p> <p class="MsoListParagraphCxSpLast" style="text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">During the visit, the effluent samples were collected. As per the analysis report, the concentration of effluent samples were beyond the prescribed limits of the Board.</span></p> <p class="MsoListParagraph" style="text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The industry was bye-passing the untreated effluent from the collection tank with the help of flexible pipe into the drain.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The project proponent was issued show cause notice alongwith opportunity of personal hearing before the Senior Environmental Engineer (ZP-I) of the Board.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">Thereafter, the project proponent has given personal hearing before Senior Environmental Engineer (ZP-I) of the Board wherein it was decided as under:</span></p> <p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The industry shall operate its ETP regularly and efficiently so as to achieve the prescribed standards.</span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The industry will not discharge its treated / untreated effluent into drain directly or indirectly, under any circumstances.</span></p> <p class="MsoListParagraphCxSpLast" style="text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The Environmental Engineer, Regional Office, SAS Nagar shall visit to monitor the treatment facility, to verify the mode of disposal and to verify the compliance, give comments / recommendations with respect to the industry statement / claim of the industry as well as decisions taken during meeting held on 24.09.2021 w.r.t. marriage palaces &amp; resorts, issued by the Board&rsquo;s its letter no. 22641-46 dated 14.10.2021 and shall process the application for obtaining consents to operate on merits.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">Thereafter, the project proponent applied for obtaining renewal of consent to operate under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 for a hotel having 56 hotel room and 3 banquet halls through OCMMS.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The site of the project was re-visited on 23.03.2022. During the visit, it was observed as under:</span></p> <p class="Default" style="margin-left: 0.5in; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-size: 11pt; line-height: 22px; font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 11pt; line-height: 22px; font-family: Tahoma, 'sans-serif';">The hotel has 88 rooms out of which as of now, only 56 rooms are operational. The hotel has one hall of capacity of 500 persons and 6 party hall for performing functions for 150-200 persons.</span></p> <p class="Default" style="margin-left: 0.5in; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-size: 11pt; line-height: 22px; font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 11pt; line-height: 22px; font-family: Tahoma, 'sans-serif';">The hotel has provided an STP, to treat the wastewater generated from various sections in the hotel and the same was in operation. During the visit, the effluent samples were collected and sent to Head Office, Patiala laboratory for analysis. As per the analysis report received vide Head Office letter endst. no. 7506-08 dated 07.04.2022, the conc. of the parameters were within the prescribed limits of the Board as tabulated below:</span></p> <p class="Default" style="margin-left: 0.5in; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-size: 11pt; line-height: 22px; font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 11pt; line-height: 22px; font-family: Tahoma, 'sans-serif';">The hotel has provided water meter at the outlet and energy meter with the STP. However, the hotel is maintaining record</span></p> <p class="Default" style="margin-left: 0.5in; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-size: 11pt; line-height: 22px; font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 11pt; line-height: 22px; font-family: Tahoma, 'sans-serif';">The hotel has provided 1 no. DG set of capacity of 320 KVA provided with canopy and stacks of adequate height.</span></p> <p class="Default" style="margin-left: 0.5in; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-size: 11pt; line-height: 22px; font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 11pt; line-height: 22px; font-family: Tahoma, 'sans-serif';">The above resort is partially complying with the decisions of the meeting held by the worthy Chairman of the Board on 24.09.2021 with the Punjab Marriage Palace and Resorts Association. The resort needs to treat / process the food waste in organic waste converter or through any other scientific way allowed under Solid Waste Management Rules, 2016 and the treated compost or vermin compost by product shall be used as manure or for other useful purpose.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-size: 2pt; line-height: 4px; font-family: Tahoma, 'sans-serif';">&nbsp;</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">Thereafter, consent to operate applied by the project proponent under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 was refused vide Board&rsquo;s letter no. CTOW/Renewal/SAS/2022/17930348 dated 18.05.2022 and Air (Prevention &amp; Control of Pollution) Act, 1981 was refused vide Board&rsquo;s letter no. CTOA/Renewal/SAS/2022/17930363 dated 18.05.2022 due to various observations mentioned therein.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The project proponent had earlier deposited and Rs. 72000/- vide R. No. 72082446 dated 24.11.2021 under Air (Prevention &amp; Control of Pollution) Act, 1981, Rs. 3000/- vide R. No. 936871579 dated 02.01.2022 as NOC regularization fee. Rs. 72000/- vide R. No. 552988262 dated 25.11.2021 deposited under Water (Prevention &amp; Control of Pollution) Act, 1974 is being considered as consent fee under Air (Prevention &amp; Control of Pollution) Act, 1981. The fee deposited by the project proponent is adequate upto 30.09.2022 against the total cost of the project Rs. 15.24 crores as per latest CA certificate submitted by the project proponent as on 31.03.2021 after considering Rs. 72000/- vide R. No. 552988262 dated 25.11.2021 deposited under Water (Prevention &amp; Control of Pollution) Act, 1974 as consent fee under Air (Prevention &amp; Control of Pollution) Act, 1981. Now, the project proponent has deposited Rs. 48000/- vide R. No. 186468552 dated 18.08.2022 under Air (Prevention &amp; Control of Pollution) Act, 1981. The consent fee deposited under Air (Prevention &amp; Control of Pollution) Act, 1981 is valid upto 30.09.2023 after adjusting the 100 % of one year fee / penalty from the existing fee deposited.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The project proponent had earlier deposited Water Consent Fee: Rs. 73,800/- vide R. no. 561840572 dated 12.03.2019. The fee deposited was adequate upto 31.03.2023. The project proponent has now deposited Rs. 48000/- vide R. No. 951284125 dated 18.08.2022 and Rs. 3600/- vide R. No. 564348437 dated 22.11.2022 under Water (Prevention &amp; Control of Pollution) Act, 1974 and same is adjusted against the 200% of one year fee against the balanced penalty / fee as per Board&rsquo;s office order dated 29.10.2018. The project proponent needs to submit the balanced penalty i.e. 200% of one year fee (Rs. 48000/-) i.e. for the period 2021-2022 and 2022-2023.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The site of the project was visited on 09.12.2022.
