The industry was afforded an opportunity of personal hearing u/s 33-A of the Water Act, 1974 & u/s 31-A of the Air Act, 1981 alongwith show cause notice before refusal of consents to operate under the Water Act, 1974 & Air Act, 1981 before the CEE(B) on 17.11.2022, wherein it was decided that the Regional Office shall immediately shall visit the industry to verify the submission/compliances made by the industry and thereafter submit afresh report alongwith recommendations within one week for disposal of pending consent applications. The Regional Office vide note dated 12.12.2022 has reported as under:-     1.    <span lang="EN-IN" style="font-size: 10.5pt; font-family: Verdana, 'sans-serif'; color: #0d0d0d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"> The industry was not in operation and was under maintenance.   2.    <span lang="EN-IN" style="font-size: 10.5pt; font-family: Verdana, 'sans-serif'; color: #0d0d0d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The industry has installed alkali wet scrubber as APCD but without any alkali dosing arrangements.    3.    <span lang="EN-IN" style="font-size: 10.5pt; font-family: Verdana, 'sans-serif'; color: #0d0d0d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">No gas/liquid fuel was observed inside the industry and instead large quantity of wood was stored inside the industrial premises.    4.    <span lang="EN-IN" style="font-size: 10.5pt; font-family: Verdana, 'sans-serif'; color: #0d0d0d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The industry has provided underground room type storage for the carbon with facility to fill the bags through screw however they was not operation-able as carbon has been filled in bags manually.     5.    <span lang="EN-IN" style="font-size: 10.5pt; font-family: Verdana, 'sans-serif'; color: #0d0d0d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"> The industry has provided flare near to the processing shed.    6.    <span lang="EN-IN" style="font-size: 10.5pt; font-family: Verdana, 'sans-serif'; color: #0d0d0d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">No CO meter has been installed but a handy CO meter was there with the industry. Temperature and pressure gauges installed are analogue and digital.    7.    <span lang="EN-IN" style="font-size: 10.5pt; font-family: Verdana, 'sans-serif'; color: #0d0d0d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The industry has not installed septic tank for the treatment of domestic effluent.     8.    <span lang="EN-IN" style="font-size: 10.5pt; font-family: Verdana, 'sans-serif'; color: #0d0d0d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">Housekeeping was found to be poor inside the plant premises.     9.    <span lang="EN-IN" style="font-size: 10.5pt; font-family: Verdana, 'sans-serif'; color: #0d0d0d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The plantation develop along the boundary of the industry is inadequate.    10. <span lang="EN-IN" style="font-size: 10.5pt; font-family: Verdana, 'sans-serif'; color: #0d0d0d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The industry failed to produce any record regarding the wastewater generated from the oil water separator and also no provision has been provided mix the same with the carbon powder.    11. <span lang="EN-IN" style="font-size: 10.5pt; font-family: Verdana, 'sans-serif'; color: #0d0d0d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The industry failed to produce any record regarding procurement of raw material and no record submitted w.r.t. generation, transportation and disposal of carbon black.   12. <span lang="EN-IN" style="font-size: 10.5pt; font-family: Verdana, 'sans-serif'; color: #0d0d0d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The industry has not submitted any certificate issued by the concerned department w.r.t. the safety measures adopted by it as per the policy dated 15.10.2013 of the Govt. of Punjab. In view of above, if approved, consent to operate applied by the industry under the Water Act, 1974 & Air Act, 1981 be refused and directions u/s 33-A of the Water Act, 1974 & u/s 31-A of the Air Act, 1981 may be issued to the industry for its closure.
