<p>RO has reported that earlier, the Board has issued directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 & u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 to the subject cited unit to restore the electric connection temporary for six months. Directions issued by the Board is reproduced as under:- “That the authorities concerned shall restore the electric connection of the industry temporary for six months i.e. upto 31/12/2021 with the immediate effect”. Consent to operate under Water (Prevention& control of Pollution) Act, 1974 & Air (Prevention & control of Pollution) Act, 1981 were granted for the operation of Hot Mix Plant vide online reference no. CTOW/Renewal/GRP/2021/15883333 & CTOA/Renewal/GRP/2021/15883319 dated 01/07/2021 respectively for six months upto 31/12/2021. The Hot Mix Plant was visited on 03/08/2021 and was observed that the HMP was not in operation during visit. The HMP was not provided sampling arrangements with stack of the HMP. Notice for violation under the provisions of the Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 vide this office letter no. 2047 dated 17/08/2021 was issued to the HMP with advise to comply with the provisions of said acts within time but the HMP was failed to submit any reply. It is further, intimated that the period of temporary restoration of electric connection for six months was already been lapsed. Accordingly, the Sub-Divisional Officer, PSPCL, kahnuwan was requested vide this office letter no. 462 dated 09/03/2022 regarding not to restore the electric connection of the industry as per above directions issued but the Authorities are failed to submit compliance of above issued directions. The Consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 granted to the HMP temporarily for six months were expired on 31/12/2021. It is further intimated that the unit was visited by the Officer of this office on 13/06/2022 and was observed that the HMP was in operation. The HMP is violating the provisions of Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974. The Sub-Divisional Officer, PSPCL, kahnuwan as well as Executive Engineer, PSPCL, Qadian was requested vide this office letter no. 462-63 dated 09/03/2022 regarding not to restore the electric connection of the industry as per above directions issued but the Authorities were failed to submit compliance of above issued directions. The Sub-Divisional Officer, PSPCL, kahnuwan as well as Executive Engineer, PSPCL, Qadian was again requested vide this office letter no. 1567-68 dated 05/07/2022 to submit compliance of the above directions issued by the Board but the Authorities are failed to submit compliance of above issued directions till date. As the PSPCL, Authorities were failed to submit any compliance of the directions issued by the Board and HMP was operating without obtaining consents of the Board and was violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. It was recommended to Zonal Office, Amritsar to issue fresh directions u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 and 33-A of Water (Prevention & Control of Pollution) Act, 1974 to PSPCL Authorities not to restore the electric connection of the HMP without prior permissions of the Board and for sealing of plant & machinery of the HMP. The Zonal Office, Amritsar vide letter no. 3490-93 dated 26/10/2022 has issued directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and 31-A of the Air (Prevention & Control of Pollution) Act, 1981 to PSPCL Authorities not to restore the electric connection of the HMP without prior permissions of the Board and for sealing of plant & machinery of the HMP. Accordingly, in compliance of the directions issued, the plant & machinery and DG set installed by the HMP were sealed in the presence of Sh. Simranjit Singh, Partner (photographs attached) and report of the same was sent to Zonal Office, Amritsar through e-note. Now the HMP has applied for obtaining renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 for the operation of Hot Mix Plant through OCMMS in a totally paperless manner by uploading necessary documents as PDF under orange category. The industry has already deposited Rs. 31,900/- vide UTR No. AXSK210990012491 dated 09/04/2021 under Water Act, 1974 & Rs. 29,500/- vide UTR No. AXSK210990012322 dated 09/04/2021 as consent to operate fee under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 including Rs. 500/- as Form Downloading fee against total gross value of fixed assets worth Rs. 42,60,000/- as on 30/09/2022 and same are adequate upto 30/09/2025 under both Acts.</p>
<p>The industry was visited by AEE of this office on 05/12/2022 and observed as under:- 1. The plant was not in operation during visit and seals were found intact. 2. The industry has provided wet scrubber as APCD to control the emissions being generated from the rotary mixer and a tank has been provided for recirculation of scrubbing liquid. The industry has now provided an adequate stack height with the APCD and sample collection facility has also been provided. 3. The industry has installed two bitumen heaters in which furnace oil @ 65 ltr/day/heater issued as fuel and each heater is attached with the stack of adequate height above the ground level. The heigh to the said stack is in accordance with the consumption of fuel. 4. The industry has installed a DG set of capacity 160KVA, which is equipped with canopy.</p>
<p>RO has recommended that:- </p>
<p>1. The consent to operate under Water (Prevention& control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted to the HMP for six months period with suitable conditions along with special condition that the HMP shall develop adequate green belt in three rows around the boundary of the HMP. 2. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be issued to the PSPCL Authorities for restore electric connection of the HMP temporary for six months period. 3. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be issued for de-sealing plant & machinery of the HMP temporary for six months period. </p>
<p>- In view of above, it is recommended as under:-</p>
<p>1. The consent to operate under Water (Prevention& control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted to the HMP for six months period with suitable conditions along with special condition that</p>
<p>a) The HMP shall develop adequate green belt in three rows around the boundary of the HMP.</p>
<p>b) The HMP shall comply with Code of Practice framed by the Board for such type of industries.</p>
<p>c) The HMP shall got analyzed air emission samples as per policy of the Board for permanent restoration of electric connection and de-sealing of plant of machinery.</p>
<p>2. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be issued to the PSPCL Authorities for restore electric connection of the HMP temporary for six months period and for de-sealing plant & machinery of the HMP temporary for six months period.</p>
