<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">It is intimated that earlier a complaint was received telephonically from CEE, Ludhiana regarding the manufacturing of mineral water in banned single use plastic cups by the subject cited industry.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';"><span style="mso-tab-count: 2;"> </span>In order to verify the above complaint and as per the directions of the Competent Authority, the subject cited industry was visited by the officer of this office on 01.09.2022 and during visit it was observed that :-</span></p>

<li class="MsoNormal" style="text-align: justify; mso-list: l1 level1 lfo3;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">The industry was not in operation during the visit.</span></li>
<li class="MsoNormal" style="text-align: justify; mso-list: l1 level1 lfo3;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">The industry is engaged in mineral water manufacturing, bottling, packing etc. </span></li>
<li class="MsoNormal" style="text-align: justify; mso-list: l1 level1 lfo3;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">The industry has also provided a section to manufacture carbonated beverage (Soda)</span></li>
<li class="MsoNormal" style="text-align: justify; mso-list: l1 level1 lfo3;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">The industry has installed 1 no. RO system/machine. The industry has not made any provisions for handling RO reject and the same is discharged onto land for stagnation. </span></li>
<li class="MsoNormal" style="text-align: justify; mso-list: l1 level1 lfo3;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">The industry is manufacturing mineral water in banned single use plastic cups under the brand name of “Aqua Flux”</span></li>

<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';"><span style="mso-tab-count: 1;"> </span>As such, the industry was engaged in the business of banned single use plastic and had deliberately restricted the entry of the officers of the Board during the visit </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="mso-tab-count: 1;"> </span><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">Accordingly, the directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 were issued vide <span style="color: black; mso-themecolor: text1;">letter no. 4905-06 dated 21.10.2022 for </span>closure of unit and the PSPCL authority have also been directed to disconnect electric connection of the industry. The electric connection of the industry has been disconnected vide TDCO no. 3016/93 dated 01.12.2022</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="mso-tab-count: 1;"> </span><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">Now, the industry has applied for fresh consent to operate under Water Act, 1974 alongwith requisite documents and with a request to restore the electric supply of the industry. The industry has submitted written undertaking stating that the industry has completely dismantled the machinery for manufacturing of glasses and shall be manufacturing only bottled water in its premises from now onwards.</span></p>
<p class="MsoNormal"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';"><span style="mso-tab-count: 1;"> </span>The site of industry was visited by the AEE of this office on 10.12.2022 and it was observed as under :-</span></p>

The electric connection of the industry has been disconnected vide TDCO no. 30/1693 dated 01.12.2022.</span></p>

RO system/machine. The industry has submitted in writing that it shall partially use the RO reject for toilets and partially onto land for plantation. <span style="mso-spacerun: yes;"> </span></span></p>

<p class="MsoNormal" style="text-align: justify; line-height: normal; margin: 0in 0in .0001pt .5in;"><span style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif';"> </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: normal;"><span style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif';"><span style="mso-tab-count: 1;"> </span>Keeping in view of above, it is recommended that :-</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: normal; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif';">Directions u/s 33-A of Water Act, 1974 may be issued for temporary restoration of electric supply to the industry for three months with special conditions that<span style="mso-spacerun: yes;"> </span>the industry shall submit certificate of land use classification from competent authority within 15 days.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: normal; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif';">Environmental Compensation of suitable amount be imposed on the industry or a bank guarantee of suitable amount be obtained from the industry as an assurance to comply with pollution control norms as deemed fit by the competent authority. </span></p>
<p class="MsoListParagraphCxSpLast" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: normal; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif';">Consent to operate under Water Act, 1974 & Air Act, 1981 may be granted to the industry for three months with special condition that the industry shall get the RO reject sample analyzed from Board’s Lab within one<span style="mso-spacerun: yes;"> </span>month to ascertain as to whether the RO reject is fit to be discharged onto land for irrigation or not.</span></p>
