It is submitted that the subject cited unit was earlier granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/RPN/2019/11451005 dated 23/10/2019 which is valid upto 30/06/2024 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/RPN/2019/11450859 dated 23/10/2019 which is valid upto 30/06/2024 for operation of Crushing of river bed material @ 50 T/day subject to the suitable conditions mentioned therein. <p class="MsoListParagraph" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: normal; mso-pagination: none; mso-layout-grid-align: none; punctuation-wrap: simple; text-autospace: none; margin: 0cm 6.0pt 10.0pt 4.5pt;">Thereafter, the Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act 1981 was revoked/cancelled vide no. 919 dated 26.04.2022 due to the non-submission of the mining certificate as per the decision no. 02 of the personal hearing held on 31.08.2021 in light of the instructions issued by the Board vide letter no. 16536 dated 23.07.2021 for processing the CTE/CTO applications for stone crushers/screening/washing plants. Now, the unit has applied for renewal of 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 under the name of Smt. Tajinder Kaur, Owner for transferring alongwith the requisite documents. The industry has submitted the CA certificate wherein the value of fixed assets of the industry as on 05.07.2022 is of Rs. 19.16 Lakhs with the value of plant and machinery of Rs. 4.92 lakhs, undertaking regarding code of practice & legal mining and compliance report of previous consents granted to the unit. Further, the applicant has submitted notarized and self-attested copies of dissolution deed wherein it has been mentioned that Sh. Kulwinder Singh has been retired from the partnership and Smt. Tajinder Kaur has been considered as the only continuing partner/proprietor. Further, the unit has submitted the slips of obtaining raw material from M/s Changar Stone Crusher, Village Plasra, Gharuan, Tehsil Nalagarh (H.P), verified by O/o Executive Engineer-cum-District Mining , Drainage cum Mining Division, Sri Anandpur Sahib dated 10.11.2022 regarding obtaining raw material from Himachal Pradesh through check post lohand. As per record file earlier the fee deposited by the industry is adequate upto 30.06.2024. Now, the unit has deposited consent to operate fee Rs. 8400/- vide UTR no. N279222149111267 dated 04.07.2022 under the Water Act, 1974 and Rs. 8400/- vide UTR no. N185222023074726 dated 04.07.2022 under the Air Act, 1981. The fee deposited by the unit is adequate upto 30.06.2027. It is added here the unit has also submitted Rs. 7316/- vide R. No. 66/5324 dated 07.12.2022, as advance fee w.r.t the stack emission samples and has requested to conduct the sampling through the Board, which shall be conducted shortly. Further, as per circular no. 443 dated 09.08.2021, the case for renewal of NOC/Consent to operate for Red, Orange and Green category of small scale industries/projects, without inspection/physical verification of the environmental parameters at the time of submission of such applications is to be processed based on self-certification submitted by the industry to the effect that it is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981. As such, the stone crushing unit covers under orange category and was not visited to the verify the compliance before processing the current application. In view of the above facts and letter issued by the Executive Engineer, Deptt. of Irrigation-cum-Mining, Sri Anandpur Sahib and raw material mining slips, verified by their office, if approved, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be renewed for a short period upto 30.09.2023, subject to the suitable conditions as mentioned in the previous consents granted to the unit and additional conditions as under: <p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo1; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 5.65pt .0001pt 59.0pt;">1.   The Board vide letter no. 16536 dated 23.07.2021 has issued some instructions w.r.t stone crushers and vide said letter the instruction no. 2 is as under: <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: normal; mso-pagination: none; mso-list: l1 level1 lfo2; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 5.65pt .0001pt 95.0pt;">Ø  Obtain carrying capacity certificate of the area/stone crusher from Deptt. Mines & Geology, Department of Water Resources and act on basis of such certificates. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: normal; mso-pagination: none; mso-list: l1 level1 lfo2; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 5.65pt .0001pt 95.0pt;">Ø  The Executive Engineer, Water Resources-cum-Mining Department vide E-mail dated 20.10.2022 has mentioned that three number Gravel (GSB) Mining Sites are operational (i) Bhallan (ii) Kotbala & Aaspur (iii) Bari Haveli. If the crusher owner gives the source from these sites then that is a valid source. <p class="MsoListParagraph" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: normal; mso-pagination: none; mso-list: l1 level1 lfo2; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 5.65pt .0001pt 95.0pt;">Ø  Thereafter, vide e-mail dated 11.11.2022 received from Executive Engineer, Water Resources-cum-Mining Department, Rupnagar has sent a letter for Legal Source of Raw Material issued by the Principal Secretary Mines and Geology addressed to the Chairman PPCB. No correspondence is received in this regard yet. <p class="MsoListParagraph" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: normal; mso-pagination: none; mso-list: l1 level1 lfo2; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 5.65pt .0001pt 95.0pt;">Ø  Now, the unit has submitted mining slips duly verified by O/o Executive Engineer-cum-District Mining, Drainage cum Mining Division, Sri Anandpur Sahib dated 10.11.2022 regarding obtaining raw material from Himachal Pradesh through check post lohand. <p class="MsoListParagraph" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: normal; mso-pagination: none; mso-list: l1 level1 lfo2; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 5.65pt .0001pt 95.0pt;">Ø  Therefore, the consent is granted upto 30.09.2023 subject to the final decision in the matter by the PPCB. The unit shall be bound to comply with the decisions of the Board and shall be bound to submit the legal source of raw material, if necessary. <p class="MsoListParagraph" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo1; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 5.65pt .0001pt 59.0pt;">2.   This consent is granted for operation of Crushing of river bed material @ 50 T/day. <p class="MsoListParagraph" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo1; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 0cm .0001pt 59.0pt;">3.   The unit shall obtain raw material from the Govt. approved mining sites only and shall not indulge itself into any kind of illegal mining. If at any stage the unit engaged itself in illegal mining, the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 shall be revoked/cancelled without any opportunity of hearing. <p class="MsoListParagraph" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo1; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 0cm .0001pt 59.0pt;">4.   The industry will comply with the guidelines/code of practice issued by the Govt. of Punjab, Department of Science, Technology and Environment Vide dated 17.03.1988, amended in 01.02.2006 and lastly amended vide no. 3/35/2013-STE(4)734 dated 30.07.2013 at all time. <p class="MsoListParagraph" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo1; tab-stops: 59.05pt; text-autospace: none; margin: .05pt 0cm .0001pt 59.0pt;">5.   The industry will comply with all the provisions under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. <p class="MsoListParagraph" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo1; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 0cm .0001pt 59.0pt;">6.   The stone crusher shall maintain a stock register to justify the legitimate source of mining material, its availability, usage and sale etc. <p class="MsoListParagraph" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo1; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 0cm .0001pt 59.0pt;">7.   The industry will submit half yearly return to this office duly verified by the Mining officer by 15th of July and 15th Jan of every year. <p class="MsoListParagraph" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo1; tab-stops: 59.05pt; text-autospace: none; margin: 0cm 5.65pt .0001pt 59.0pt;">8.   This consent does not bestow any ownership rights with the consent holder and further the CTO is being granted only from pollution angle and cannot be used as any legal tool/document to ascertain/confirm proprietary rights.
