<p class="MsoBodyTextIndent3" style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/LDH3/2022/17940064 dated 30.06.2022, valid upto 29.12.2022 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH3/2022/17940364 dated 05.07.2022, valid upto 29.12.2022 with conditions mentioned therein. </span></p>
<p class="MsoBodyTextIndent3" style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Earlier, the industry was visited by officer of the Board on 15.04.2022 and observations some violations. </span></p>
<p class="MsoBodyTextIndent3" style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Accordingly, notice u/s 33-A of Water Act, 1974 as amended in 1988 alongwith show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 was issued to the industry with an opportunity of personal hearing before Chairman of the Board on 10.06.2022, wherein it was decided that:- </span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo4; margin: 0in 0in .0001pt .5in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">The industry shall construct pucca proper distribution network for the shifting of domestic effluent being generated from labour quarters to STP installed in the factory premises, within 7 days.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo4; margin: 0in 0in .0001pt .5in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">The industry shall deposit Environmental Compensation of Rs. 5.0 Lac in lieu of the violations earlier made by the industry, in the office of Environmental Engineer, Regional Office-3, Ludhiana, within 7 days.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo4; margin: 0in 0in .0001pt .5in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">Meantime, consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 be granted to the industry for short period i.e. six months and further consent may be extended after verification by Regional Office-3 Ludhiana.</span></p>

<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%; background: white; margin: 0in 0in .0001pt -.5in;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">Now, the industry has applied for </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 through OCMMS. The industry has deposited Rs. 65,400/-vide UTR. No. AXSK220310019740 dated 31.01.2022 as Consent fee under the Water Act, 1974 & Rs. 43,600/-vide UTR. No. AXSK220310020158 dated 31.01.2022 under the Air Act, 1981. The Consent fee deposited by the industry is adequate for period upto 20.05.2026 under the both acts. The industry has also deposited Rs. 1100/- vide UTR No. 375736736 dated 02.12.2022 as NOC regularization fee for increase in value of gross fixed assets. The industry has deposited Environmental Compensation of Rs. 5.00 lac in this office.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%; margin: 0in 0in .0001pt -.5in;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry was visited by AEE of this office on 08.12.2022 and it was observed as under:</span></p>

Nickel plating plant (one manual and one automatic). The industry has made an agreement @ 20,000 liter/month with CETP operator for lifting of trade effluent. </span></p>

The record was checked and observed that the industry has consumed fresh water @ 114.51 KL from 01.09.2022 to 08.12.2022. Previous balance stored as on 01.09.2022 was 2000 litres as per record. Total effluent got lifted by the CETP operator in the said period is 111.59 KL. During visit, about 3000 litres was found stored in the storage tank. Considering evaporation losses, the water auditing of the industry indicates that the industry is regularly lifting its trade effluent to CETP operator.</span></p>

<p class="MsoListParagraph" style="mso-add-space: auto; text-align: justify; text-indent: 53.45pt; line-height: 150%; margin: 0in 0in .0001pt -35.45pt;"><span style="font-family: 'Tahoma','sans-serif';">Thus, the industry is now complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.</span></p>
