<p class="MsoBodyTextIndent" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: normal;"><span style="font-family: Tahoma, 'sans-serif';">It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. </span><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast;">CTOW/Renewal/FGS/2021/16985966 dated 06/11/2021, valid upto 30/06/2022 and under the Air Act, 1981 vide no. CTOA/Renewal/FGS/2021/16985961 dated 06/11/2021, valid upto 30/06/2022 for the Bars, Angles, Rounds, Joist & Square @ 88 MTD ERW Pipes @ 85 MTD.</span></p>
<p class="MsoBodyTextIndent" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: normal;"><span style="font-family: Tahoma, 'sans-serif';"> Now, the industry has applied for obtaining varied consent to operate under the Water Act, 1974 and Air Act, 1981 with requisite documents under <strong>Green</strong> category as it has shifted from coal to PNG operating unit. </span></p>
<p class="MsoBodyTextIndent" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: normal;"><span style="font-family: Tahoma, 'sans-serif';">The previous consent fee was adequate upto 31/07/2022. </span><span style="font-family: Tahoma, 'sans-serif';">The industry has now deposited of Rs. 47040/- vide UTR. No. N211222057708973 dated 30/07/2022 under Water Act, 1974 and Rs. 47040/- vide UTR no. N211222057754693 dated 30/07/2022 </span><span style="font-family: 'Tahoma','sans-serif';">under the Air Act, 1981 and against the un-depreciated fixed assets of Rs. 450.48 Lacs as on 31/07/2022 CA Certificate dated 19/09/2022 which is adequate upto <strong>30/11/2027 </strong>and after deducting penalty charges 25% Rs.140 is lying pending with the Board, as per Board’s Office Order dated 29/10/2018 </span></p>
<p class="MsoBodyTextIndent" style="margin-left: 0in; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: normal;"><span style="font-family: 'Tahoma','sans-serif';">There is an increase in the cost of fixed assets about Rs. 65 lakhs, which mainly attributes towards addition in plant & machinery, accordingly, the industry has deposited NOC regularization fee of Rs.2900/- vide UTR no. N211222057754182 dated 30/07/2022, which is adequate. </span></p>
<p class="MsoBodyTextIndent" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: normal;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast;"> </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';"> It is intimated that Hon’ble NGT while considering the issue of Polluting activities in Mandi Gobindgarh in the matter of OA no. 924/2019 titled as Neeraj Goyal Vs State of Punjab vide order dated 01-10-2020 has directed as under: </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: normal;"><strong><em><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">“In the context of directions to shift rolling mills from coal to PNG we direct the State PCB to ensure that if such shifting does not take place, the non-compliant units be closed till compliance. This should apply not only to rolling mills but also to other similarly placed industries operating on coal. Wherever there is non compliance, the State PCB may take coercive measures, including closure, recovery of compensations and initiating prosecution, following due process of laws.” </span></em></strong></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: normal;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">Accordingly, Punjab Pollution Control Board has issued directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 to all the industrial units (not only Rolling Mills) operating on coal as fuel in Mandi Gobindgarh as under: </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: normal;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">“That all the industrial units in Mandi Gobindgarh operating on coal as fuel in any form shall shift from coal to PNG on or before 31-12-2020.” The Board has later extended the date upto 31/03/2022.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: normal;"><span style="font-family: Tahoma, 'sans-serif';">The industry was visited by the undersigned on 13/12/2022 and contacted Sh. Vinod, Partner at site. During visit, it was observed as under: </span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: 70.9pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: normal; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: Tahoma, 'sans-serif';">The industry has shifted its fuel from Coal to PNG but was not in operation due to power cut in area. It has installed instrumentation panel to control gas supply and flow rate.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 70.9pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: normal; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: Tahoma, 'sans-serif';">The industry has disconnected/ removed the motors from the coal pulverizer and has also dismantled the coal feeding pipe into the furnace. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 70.9pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: normal; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: Tahoma, 'sans-serif';">The industry has installed ERW pipe plant.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 70.9pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: normal; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: Tahoma, 'sans-serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: Tahoma, 'sans-serif';">The industry has provided septic tanks for treatment of domestic effluent.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 70.9pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: normal; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: Tahoma, 'sans-serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: Tahoma, 'sans-serif';">The industry has planted plants in its premises but was advised to plant more trees, wherever space is available.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-left: 70.9pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: normal; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: Tahoma, 'sans-serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: Tahoma, 'sans-serif';">The movement area within the unit was found paved in front side and the industry was advised to pave the movement area completely upto the back side of the unit completely.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph;"><strong><span style="font-family: 'Tahoma','sans-serif';"> MoEF&CC has issued notification no. S.O. 3250(E) on 20.07.2022, which is reproduced as under:</span></strong></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph;"><em><span style="font-family: 'Tahoma','sans-serif';">"Whereas, the Hon’ble National Green Tribunal vide its order, dated the 12th February, 2020, in Original Application No. 55/2019 (WZ), (Gajubha Jesar Jadeja vs Union of India &Ors.), has inter alia observed that Cold Rolled Stainless Steel Manufacturing Industries require prior environment clearance but, having regard to the fact that there were a large number of such mills operating on the strength of Consent to Establish (CTE) and Consent to Operate (CTO), the Hon’ble Tribunal has held that opportunity should be provided to such units to fall within the Environment Clearance regime by granting a period of at least one year to operate for the purpose.</span></em></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph;"><em><span style="font-family: 'Tahoma','sans-serif';">And whereas, the Central Government, keeping in view the impact caused due to the Covid19 pandemic has taken a considered decision in line with the above said order of the Hon’ble National Green Tribunal, so as to provide a window period for such re-rolling or cold rolling units to obtain prior Environmental Clearance.</span></em></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><em><span style="font-family: 'Tahoma','sans-serif';">And whereas, the Central Government is of the view that steel re-rolling operations fall under the purview of the secondary metallurgical processing industry and require Environment Clearance as per item 3(a), relating to Metallurgical Industries (Ferrous and Non-ferrous), of the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide notification number S.O. 1533 (E), dated the 14th September, 2006, mandating the requirement of prior environmental clearance for the projects covered in its Schedule (hereinafter referred to as the said notification), wherein all non–toxic secondary metallurgical processing units with capacities greater than 5000 tonnes/annum (TPA) fall under category B.</span></em></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph;"><em><span style="font-family: 'Tahoma','sans-serif';">Now, therefore, in exercise of the powers conferred by section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby directs that all the standalone re-rolling units or cold rolling units, which are in existence and in operation as on the date of this notification, with valid Consent to Establish (CTE) and Consent to Operate (CTO) from the concerned State Pollution Control Board or the Union territory Pollution Control Committee, as the case may be, shall apply online for grantof Terms of Reference (ToR) followed by Environment Clearance and the said units shall be granted Standard Terms of Reference as per item 3(a) of the said notification and shall be exempted from the requirement of public consultation:</span></em></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph;"><em><span style="font-family: 'Tahoma','sans-serif';">Provided that the application for the grant of ToR shall be made within a period of one year from the date of this notification. </span></em></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><em><span style="font-family: 'Tahoma','sans-serif';">2. This notification shall come in to force from the date of its publication in the Official Gazette. "</span></em></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; margin: 12.0pt -.9pt 12.0pt 0in;"><span style="font-family: 'Tahoma','sans-serif';">The Competent Authority of the Board vide letter no. 2503 dated 01/09/2022 after considering the matter, has decided as under:-</span></p>
<p class="MsoListParagraph" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; mso-pagination: none; mso-list: l2 level1 lfo2; text-autospace: none; margin: 12.0pt -.9pt .0001pt 1.0in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">a.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">While granting renewal/extension of 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, a special condition may be imposed that the industry shall be bound to apply online for grant of Terms of Reference (TOR) followed by Environment Clearance from the competent authorities, within one year from the date of issue of this notification i.e. well before 19.7.2023.</span></p>
<p class="MsoListParagraph" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; mso-pagination: none; mso-list: l2 level1 lfo2; text-autospace: none; margin: 0in -.9pt 12.0pt 1.0in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">b.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">Environmental Engineer, Regional Office, Fatehgarh Sahib/ SGR be directed to convey the aforesaid notification to all the re-rolling/cold rolling units to apply online for grant of Terms of Reference (ToR) followed by Environment Clearance and submit compliance at Regional Office.</span></p>
<p class="MsoListParagraph" style="text-align: justify; text-justify: inter-ideograph; mso-pagination: none; text-autospace: none; margin: 0in -.9pt 12.0pt 1.0in;"><span style="font-family: 'Tahoma','sans-serif';"> </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; margin: 12.0pt -.9pt 12.0pt 0in;"><span style="font-family: 'Tahoma','sans-serif';">And, Regional Office has been directed to grant 'consent to operate' in such cases <strong>upto 19.07.2023.</strong></span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: normal; margin: 12.0pt -.9pt 10.0pt 0in;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">The Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoNormal" style="margin-left: 4.5pt; text-align: justify; text-justify: inter-ideograph; text-indent: -4.5pt; line-height: normal;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';"> <strong>The Board shall continue to grant consent to</strong> <strong>establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries</strong>.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; margin: 12.0pt -.9pt 12.0pt 0in;"><span style="font-family: 'Tahoma','sans-serif'; color: red;"> </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; margin: 12.0pt -.9pt 12.0pt 0in;"><span style="font-family: 'Tahoma','sans-serif';">In view of above, if approved, it recommended that varied </span><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">consent to operate may be granted to the industry upto 19/07/2023 under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 with suitable and special conditions as under:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: 1.0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.5in; line-height: normal; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;">a)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Calibri;">The industry shall be bound to obtain Environmental Clearance for the project as per MoEF&CC notification no. S.O. 3250(E) dated 20.07.2022 </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 1.0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.5in; line-height: normal; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;">b)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Calibri;">The industry shall be bound to apply online for grant of Terms of Reference (ToR) within followed by Environment Clearance within one year from the date of issue of MoEF&CC notification no. S.O. 3250(E) dated 20.07.2022.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 1.0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.5in; line-height: normal; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;">c)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Calibri;">The industry shall provide additional plantation where ever spaces is available. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 1.0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.5in; line-height: normal; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;">d)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">T</span><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Calibri;">he industry is advised to obtain necessary clearance for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA).</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 1.0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.5in; line-height: normal; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;">e)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Calibri;">The industry shall stabilized/ pave the entire vehicular movement area within industry, to suppress the dust emissions within one month and submit compliance.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 1.0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.5in; line-height: normal; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;">f)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Calibri;">The industry shall obtain NOC of the Board, if it changes any of its product/capacity of the plant.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 1.0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.5in; line-height: normal; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;">g)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Calibri;">The industry shall not change/modernize its manufacturing process and shall not increase its production capacity.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 1.0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.5in; line-height: normal; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;">h)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Calibri;">The industry shall install sensor/Hooting system to sensitize the labor/worker as and when there will be nay leakage of gas occurs.</span></p>
