<p class="TableParagraph" style="margin-right: 4.0pt; text-align: justify; text-indent: 66.55pt;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; letter-spacing: .4pt; mso-font-width: 115%;">It is submitted that the establishment is a rice sheller was earlier granted consent to operate under the Water Act, 1974 Vide no. CTOW/Renewal/SGR/2021/14579899 dated 18/01/2021, valid up to 30/09/2022 for manufacturing of Raw Rice/Parboiled @ 2 TPH by processing paddy @ 3 TPH as raw material, with certain conditions mentioned therein.</span></p>
<p class="TableParagraph" style="margin-right: 4.0pt; text-align: justify; text-indent: 66.55pt;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; letter-spacing: .4pt; mso-font-width: 115%;">Now, the industry has applied for renewal of consent to operate under the Water Act, 1974.</span></p>
<p class="TableParagraph" style="margin-right: 4.0pt; text-align: justify; text-indent: 66.55pt;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; letter-spacing: .4pt; mso-font-width: 115%;">The industry has submitted compliance report of the conditions of the consent earlier granted to it under the Water Act, 1974 and the Air Act, 1981, latest CA certificate. The industry has already deposited consent fee of Rs. 44100/- deposited through online vide UTR No. SBIN520268820862 dated 24/09/2020 and Rs. 840/- deposited through online vide UTR No. 894756953 dated 05/12/2022 as penalty fee under the Water (Prevention and Control of Pollution) Act, 1974. As per Board's office order issued vide no. 524 dated 29/01/2018, the fee is adequate upto 30.09.2025 against fixed assets of Rs. 194.15 lacs as on 01.12.2022 as per CA certificate dated 02/12/2022. </span></p>
<p class="TableParagraph" style="margin-right: 4.0pt; text-align: justify; text-indent: 66.55pt;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; letter-spacing: .4pt; mso-font-width: 115%;">The industry has submitted that it had not run saila plant last year and thus, no sampling was carried out.</span></p>
<p class="TableParagraph" style="margin-right: 4.0pt; text-align: justify; text-indent: 66.55pt;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; letter-spacing: .4pt; mso-font-width: 115%;">During last visit by the then AEE of this office on 02/12/2020, the industry was found complying the water as well as air consent conditions.</span></p>
<p class="TableParagraph" style="margin-right: 4.0pt; text-align: justify; text-indent: 66.55pt;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; letter-spacing: .4pt; mso-font-width: 115%;">The industry has also submitted undertaking regarding updation of APCD from time to time, in future when and required by PPCB or Punjab Govt. As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for five years, ten years & 15 years respectively. The Board vide its letter no. 9982-1003 dated 27.03.2018 has requested this office to strictly follow consent validity criteria as mentioned in the modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="TableParagraph" style="margin-right: 4.0pt; text-align: justify; text-indent: 66.55pt;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; letter-spacing: .4pt; mso-font-width: 115%;">It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. Further, it is intimated that there is no change in the underappreciated value of the fixed assets.</span></p>
<p class="TableParagraph" style="margin-right: 4.0pt; text-align: justify; text-indent: 66.55pt;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; letter-spacing: .4pt; mso-font-width: 115%;">No complaint is pending against the industry. The industry was found complying with consent conditions during last visit and consents were granted thereafter.</span></p>
<p class="TableParagraph" style="margin-right: 4.0pt; text-align: justify; text-indent: 66.55pt;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; letter-spacing: .4pt; mso-font-width: 115%;">Thus, the industry is complying with the conditions imposed in the previous consents.</span></p>
<p><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Cambria; mso-bidi-font-family: Cambria; letter-spacing: .4pt; mso-font-width: 115%; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;">In view of above, it is recommended that the consent to operate granted under Water (Prevention & Control of Pollution) Act, 1974 may be renewed to the industry upto 30.09.2023 for the production of Raw Rice/Parboiled @ 2 TPH by processing paddy @ 3 TPH as raw material, subject to the suitable conditions as per the policy of the Board and special condition that the industry shall maintain its ETP and shall carried out its sampling, within the period of one month from the date of operation of its saila plant and submit the report in this office, immediately. </span></p> |
