<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> It is submitted that the consents to operate under the Water Act, 1974 and Air Act, 1981 were granted to the industry vide nos. O16FZLCTOW3971539 & O16FZLCTOA3971581 dated 10/05/2016, expired on 30/09/2020 for the operation of marriage palace for carrying out 70 functions per year, subject to certain conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> Thereafter, the marriage palace has failed to get the consents renewed and is operating without valid consents to operate of the Board. Accordingly, show cause notice for violation of the provisions of Water Act, 1974 & Air Act, 1981 was issued to the marriage palace vide Board's letter no. 2516 dated 12.07.2021, but the marriage palace neither applied for consents to operate under the provisions of Water Act, 1974 & Air Act, 1981 nor submitted any reply to the show cause notice issued to it. </span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> The marriage palace was visited by officer of the Board on 04.03.2022 and it was observed as under:- </span></p>
<p class="MsoListParagraph" style="margin-left: 0in; text-align: justify; text-indent: 0in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The palace has capacity of 500 persons to carryout functions in hall and lawn. No function was being carried out at the time of visit. </span></p>
<p class="MsoListParagraph" style="margin-left: 0in; text-align: justify; text-indent: 0in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The palace has constructed septic tanks along with Oil & grease trap for treatment of effluent arising from arising from kitchen section during function as well as domestic effluent generated during function goes. The palace has made provisions for discharge into soakage pit. </span></p>
<p class="MsoListParagraph" style="margin-left: 0in; text-align: justify; text-indent: 0in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The palace has not provided composite pit within its premise and mix solid waste was lying in the form of heap in palace. </span></p>
<p class="MsoListParagraph" style="margin-left: 0in; text-align: justify; text-indent: 0in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The palace has installed D.G. set of capacity 250 KVA with canopy and stack of adequate height has also been provided with the D.G. set. </span></p>
<p class="MsoListParagraph" style="margin-left: 0in; text-align: justify; text-indent: 0in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">During visit, the representative of the palace was advised to apply for consent to operate of the Board under the Water Act, 1974 and the Air Act, 1981. But, till date the palace has failed to apply for the same.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> But the palace has failed to comply and the marriage palace has violated the provisions of the Water Act, 1974 & Air Act, 1981 and is operating without valid consents of the Board. As such, SCN for violation of the provisions of the Water Act, 1974 and the Air Act, 1981 was issued vide Zonal Office letter no. 1778 dated 07.04.2022 alongwith an opportunity of personal hearing was given before the Senior Environmental Engineer on 20.04.2022. The palace has been informed regarding personal hearing. However, neither the representative of the marriage palace attended the said hearing and nor submitted any reply has been received from the marriage palace. </span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> Thereafter, the industry has applied for obtaining renewal consents to operate under the Water Act, 1974 and the Air Act, 1981 from the Board through online system on 20.07.2022 alongwith requisite documents under Orange category for the operation of marriage palace for carrying out 70 functions per year and has deposited consent fees amounting Rs. 33,600/- vide UTR No. N189222030706415 dated 08.07.2022 as consent to operate fee under the Water Act, 1974 and Rs. 33,600/- vide UTR No. N189222030699376 dated 08.07.2022 as consent to operate fee under the Air Act, 1981 , which is adequate upto 30.09.2024 under both Acts against fixed assets of Rs. 83.78 lacs as on 31.03.2022, as mentioned in CA certificate dated 03.07.2022. </span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> During processing the case, the marriage palace was issued SCN along with an opportunity to file written reply within 10 days, vide Zonal Office letter no. 3790 dated 01.08.2022. In reponse, the industry has submitted reply to the SCN and informed that they are making the compliances of short comings mentioned in the show cause notice and requested for a period of 15 days for completion.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> The Competent Authority has observed that marriage palace has been given opportunities since April, 2022 to remove the incompletions pointed out by the Board. However, the marriage palace neither submitted any reply of show cause notices issued to it nor attended hearings afforded by the Board and now, the marriage palace has simply stated that it is in the process of removing incompletions and requested for giving 15 days time without giving any details of compliances made by it so far. </span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> Accordingly, it has decided by the Competent Authority to refuse the applications of the marriage palace for obtaining renewal of consent to operate applied by it under the Water Act, 1974 and the Air Act, 1981. Therefore, consents to operate under the Water Act, 1974 and Air Act, 1981 were refused to the industry vide nos. CTOW/Renewal/FZL/2022/19382103 & CTOA/Renewal/FZL/2022/19376388 dated 26/08/2022.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> Now, the industry has again applied for obtaining renewal consents to operate under the Water Act, 1974 and the Air Act, 1981 from the Board through online system on 04.12.2022 alongwith requisite documents under Orange category for the operation of marriage palace for capacity of 500 persons per function. </span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> To verify the facts, the site of the industry was visited by undersigned on 03.11.2022 and it was observed as under:- </span></p>

<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: 0in; line-height: 150%; mso-list: l1 level1 lfo2; margin: 0in 0in 10.0pt 0in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The marriage palace has provided suction hood over the cooking operations at Kitchen section to arrest the exhaust emissions with outlet of the hood through a stack above roof level.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-left: 0in; mso-add-space: auto; text-align: justify; text-indent: 0in; line-height: 150%; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The marriage palace has installed a board at its entry regarding timings of DJ sets i.e. till 10 PM in accordance with the Noise Pollution (Regulation & Control Rules), 2000.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> The palace is complying with the conditions of consents granted to it under the Water Act, 1974 & the Air Act, 1981.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> Keeping in view of above, it is recommended that regular consents to operate under the Water Act, 1974 & Air Act, 1981 may be granted to the palace for a period up to 30.09.2024 for the operation of marriage palace for capacity of 500 persons per function, subject to the suitable conditions as per the policy of the Board, please.</span></p>
