CTOW/Renewal/FZR/2021/16715989 and CTOA/Renewal/FZR/2021/16715960 dated 30.09.2021 for operation of hot mix plant for production of premix @ 50 TPH valid upto 29.03.2022 each, subject to the suitable conditions mentioned therein and following special conditions:- </span></p>

<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;" role="presentation"><span style="font-size: 11pt; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">The hot mix plant shall submit prior schedule of its operation to the Board, so that re-sampling of the stack emissions can be carried out.</span></p>

<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;" role="presentation"><span style="font-size: 11pt; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">The industry will obtain the permission from the DTP regarding its operation beyond 14.01.2022 at its own level and submit the same to the Board.</span></p>

<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;"><span style="font-size: 11pt; font-family: Tahoma, sans-serif; background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"> </span><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">But the hot mix plant failed to submit any compliance of the consent conditions.</span></p>
<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;"><span style="font-size: 11pt; font-family: Tahoma, sans-serif; background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"> </span><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">The hot mix plant was visited by AEE of this office on 2.6.2021 and collected emissions sample from the stack of air pollution control device installed to control emissions from hot mix plant. As per analysis report, conc. of SPM was 232 mg/Nm</span><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"><span style="font-size: 0.6em; vertical-align: super;">3</span></span><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"> against permissible limit of 150 mg/Nm</span><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"><span style="font-size: 0.6em; vertical-align: super;">3</span></span><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">. Consequent to the non-achievement of emissions standards, the industry stated that air pollution control device has been set right / rectified and requested for re-sampling.</span></p>
<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;"><span style="font-size: 11pt; font-family: Tahoma, sans-serif; background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"> </span><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">The site of hot mix plant was visited by officer of the Board on 21.01.2022 and found not in operation. During visit, representative of the hot mix plant informed the visiting officer of the Board that the hot mix plant will be restarted in the fourth week January or first week of February 2022 and will be informed to the Board, accordingly for carrying out stack emissions sampling. But no intimation was received from the industry in this regard. Therefore, the hot mix plant was again visited by AEE of this office</span><span style="font-size: 11pt; font-family: Tahoma, sans-serif; background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"> </span><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">(undersigned) alongwith ASO of the Board on 10.05.2022 and during visit, it was observed as under:-</span></p>

<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;" role="presentation"><span style="font-size: 11pt; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">The hot mix plant has installed dust collector followed by wet scrubber as APCD to contain the dust emissions from the rotary drum.</span></p>

<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;" role="presentation"><span style="font-size: 11pt; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">The hot mix plant has not provided separate energy meter with the APCD.</span></p>

<li dir="ltr" style="list-style-type: decimal; font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre; margin-left: -18pt;" aria-level="1">
<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;" role="presentation"><span style="font-size: 11pt; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">One no. emission sample was collected from the stack of this APCD. As per analysis report of Board's Air Lab, the conc. of particulate matter was found to be 132 mg/Nm3, which is within permissible standard of 150 mg/Nm3 as prescribed by the Board for such type of units.</span></p>

<li dir="ltr" style="list-style-type: decimal; font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre; margin-left: -18pt;" aria-level="1">
<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;" role="presentation"><span style="font-size: 11pt; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">During visit, the representative of the industry was advised to apply for consent to operate of the Board under the Water Act, 1974 and the Air Act, 1981. But, till date the industry has failed to apply for the same.</span></p>

<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;"><span style="font-size: 11pt; font-family: Tahoma, sans-serif; background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"> </span><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">As the industry is being operated without obtaining valid consent to operate under the Water Act, 1974 and the Air Act, 1981 and is deliberately violating the provisions of the Water Act, 1974 & the Air Act, 1981.</span></p>
<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;"><span style="font-size: 11pt; font-family: Tahoma, sans-serif; background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"> </span><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">The hot mix plant was issued show cause notice with an opportunity of personal hearing on 20.6.2022 before the SEE. But neither any representative of the industry attended the hearing nor submitted any reply in the matter.</span></p>
<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;"><span style="font-size: 11pt; font-family: Tahoma, sans-serif; background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"> </span><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">The hot mix plant was afforded another opportunity of personal hearing on 8.7.2022 before the SEE and again neither any representative of the industry attended the hearing nor submitted any reply in the matter.</span></p>
<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;"><span style="font-size: 11pt; font-family: Tahoma, sans-serif; background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"> </span><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">In view of above, the industry has been issued notice u/s 33-A of the Water Act, 1974 & u/s 31-A of the Air Act, 1981 vide letter no. 3526 & 3528 dated 15.7.2022 with an opportunity of personal hearing on 28.07.2022 before the Chief Environmental Engineer (B) of the Board.</span></p>
<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;"><span style="font-size: 11pt; font-family: Tahoma, sans-serif; background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"> </span><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">The hearing was attended by Sh. Happy Arora, Prop. of the industry and requested to give some time for submission of consent applications.</span></p>
<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;"><span style="font-size: 11pt; font-family: Tahoma, sans-serif; background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"> </span><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">During hearing, it has been observed by the Chief Environmental Engineer (B) that:</span></p>

<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;" role="presentation"><span style="font-size: 11pt; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">The industry has operated the hot mix plant without having valid consents under the Water Act, 1974 & the Air Act, 1981 as consents earlier granted were valid upto 29.3.2022.</span></p>
</li>
<li dir="ltr" style="list-style-type: lower-roman; font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre; margin-left: -18pt;" aria-level="1">
<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;" role="presentation"><span style="font-size: 11pt; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">The validity of NOC granted by DTP, Ferozepur vide letter no. 182 dated 15.1.2019 was valid upto 14.1.2022 and failed to get further NOC from the Deptt. of Town & Country Planning in spite of condition stipulated by the Board while granting consents on 30.9.2021.</span></p>

<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;"><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">After considering the material facts on file, it has been decided the Chief Environmental Engineer (B) that:</span></p>
<ol style="margin-top: 0; margin-bottom: 0; padding-inline-start: 48.0px;">
<li dir="ltr" style="list-style-type: lower-alpha; font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre; margin-left: -18pt;" aria-level="2">
<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;" role="presentation"><span style="font-size: 11pt; background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">Directions u/s 33-A of the Water Act, 1974 & u/s 31-A of the Air Act, 1981 be issued to the effect that the hot mix plant shall not be operated without obtaining valid 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 as well as further NOC from the Deptt. of Town & Country Planning.</span></p>

<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt;" role="presentation"><span style="font-size: 11pt; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">RO to ensure the compliance of decision no. (a) above and recommend action against the industry in case of any violation(s) is observed.</span></p>

<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; background-color: #ffffff; margin-top: 0.0pt; margin-bottom: 0.0pt; padding: 14.0pt 0.0pt 0.0pt 0.0pt;"><span style="font-size: 11pt; font-family: Tahoma, sans-serif; background-color: transparent; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"> The proceedings of the hearing dated 28.7.2022 were conveying to the indsutry for compliance vide Zonal Office letter no. 3904 dated 08.08.2022.</span></p>
<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; margin-top: 0.0pt; margin-bottom: 0.0pt;"><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"> Now the industry has applied for renewal of consent to operate under the Water Act, 1974 and the Air Act, 1981. The HMP has submitted CA certificate dated 01.12.2022 regarding value of gross fixed assets of the industry of Rs. 50.45 lakhs. The industry has already deposited Rs. 14,000/- each vide R. No. 000107757065 and 000107757173 dated 26.08.2021 under the Water Act, 1974 and the Air Act, 1981, respectively, and now deposited Rs. 5,400/- each vide R. No. 469347885 and 989174176 dated 13.12.2022 under the Water Act, 1974 and the Air Act, 1981,respectively, which is adequate upto 30.09.2027 under both Acts. </span></p>
<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; margin-top: 0.0pt; margin-bottom: 0.0pt;"><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"> The industry has submitted that they have established the unit after obtaining the permission of the DTP. That they are bound to obtain clearance from DTP office at their own level and the Board is not responsible for such clearance. </span></p>
<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; margin-top: 0.0pt; margin-bottom: 0.0pt;"><span style="font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;"> To check compliance, the hot mix Plant was again visited by AEE of this office (undersigned) on 12.12.2022 and it was observed as under: </span></p>

<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; margin-top: 0.0pt; margin-bottom: 0.0pt;" role="presentation"><span style="font-size: 11pt; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">The Hot Mix Plant has installed dust collector followed by wet scrubber with water re-circulation system as air pollution control device to contain the emissions from rotary drum, which was in line/operation-able condition. </span></p>

<li dir="ltr" style="list-style-type: decimal; font-size: 11pt; font-family: Tahoma, sans-serif; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre; margin-left: -18pt;" aria-level="1">
<p dir="ltr" style="line-height: 1.7999999999999998; text-align: justify; margin-top: 0.0pt; margin-bottom: 0.0pt;" role="presentation"><span style="font-size: 11pt; font-variant-numeric: normal; font-variant-east-asian: normal; vertical-align: baseline; white-space: pre-wrap;">The Hot Mix Plant has provided stack of adequate height above ground level with the APCD along-with adequate sampling facility to facilitate the emission sampling. </span></p>

The reading of same was 12 KWH.</span></p>
