It is submitted that the industry was earlier granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. PTA/92-93/F-70 dated 27/08/1992, valid upto 30/06/1993 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. SGR/A/92-93/F-6 dated 25/08/1992, valid upto 23/08/1993 for the manufacturing of Tin containers @ 27000 no./month by using raw material Tin Plate raw material. Further, the industry was issued show cause notice under Water Act, 1974 and Air Act, 1981 vide this office letter no. 4538 dated 30/09/2011 for not obtaining renewal of consent to operate under the  provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981. Now, the industry has applied for varied consent to operate for manufacturing of Tin containers @ 20000 nos./day by using raw material Tin @ 26 MTD by using as raw material on triple shift basis. The industry has submitted a letter wherein it is stated that that the industry is running its unit in three shifts, due to which its production capacity has been increased to manufacture Tin containers @ 20000 nos./day by using raw material Tin @ 26 MTD by using as raw material. The industry has further informed that the unit is running since 1987 and over the period of time, its machinery had been became old and obsolete and require to update / replace from time to time. Due to this, there is increase in the value of fixed assets. Further, due to upgradation plant & machinery, the production capacity of the unit had been enhanced. The industry has also submitted copy of letter issued vide no. 2094 dated 09.12.2020 by MC, Sangrur regarding classification of land in which it is mentioned that the site of the industry falls inside the residential zone of the Master Plan of Sangrur. It is worth to mention here the master plan of Sangrur has already been notified in year 2010 and the industry had enhanced the production capacity of the unit by operating its unit in three shifts prior to the notification of master plan of Sangrur. Further, as per the Board’s office order no. 21 dated 08/06/2018, the existing industrial units/other establishments, which were established before the notification of the master plan of the respective cities shall be allowed consents/extension under the provisions of Water (Prevention & Control of Pollution) Act, 1974, Air Act, 1981 and authorization under the provisions of Hazardous Waste Management Rules, 2016 for a period of 15 years from the date of the notification of master plan after taking the concrete documentary proof regarding the date of commissioning of such units. No separate approval from local bodies/other authorities is required to be obtained. In this regard, the industry has submitted a request letter w.r.t. the date of expansion made by it in its premises and same is as under: 1. That the unit is in operation since 1987. 2. That there is no increase in the land of the unit. 3. That prior to unit was operated only for single shift and thereafter, unit was started operating in three shifts, due to which production capacity had been increased. 4. That during those days, old machinery was replaced with new one due to which production capacity had been increased. 5. That this unit is of green category. 6. That the master plan of Sangrur had been notified in year, 2011. The industry has deposited Rs. 120000/- (Rs. 88000/- water consent fee + Rs. 42000/- water penalty fee + Rs. 500/- application form fee) vide UTR no. 637687998 dated 30/11/2022 under the Water Act, 1974 and Rs. 120000/- (Rs. 88000/- air consent fee + Rs. 42000/- air penalty fee + Rs. 8400/- NOC regularization fee) vide UTR no. 588462685 dated 30/11/2022, against the value of gross fixed assets of Rs. 225.78 lacs as on 29/11/2022. The industry was visited by undersigned on 14/12/2022 and it was observed as under:- 1.         The unit was not in operation due to electricity fault. However, it was seen that the industry has provided 01 no. bottom cutter, 01 no. body cutter, 01 no. side seam, 01 no. X-Pander, 01 no. flenzer, 01 no. seamer, 01 no. bottom press, 01 no. rubber solution, 01 no. hole press, 01 no. chapka press, 01 no. kunda welding and 01 no. kunda check machine for manufacturing of Tin containers of different sizes by using Tin plate as raw material in its existing premises. 2.         The industry has not added any new land for enhanced capacity. However, there is increase in capacity due to operation of the unit in three shifts instead of single shift. 3.         The industry is not using any fuel in its premises except HSD oil in its DG set. 4.         The industry is not generating any trade effluent from its process. 5.         The domestic effluent is being generated and discharged onto land for plantation after passing through septic tank.  The industry has submitted a request letter and stated that unit is requirement of water for tin leakage testing purposes only, which is around 0.9 KLD and testing water is re-circulated for again testing Tin. 6.         The industry has installed DG set of capacity 100 KVA equipped with canopy and adequate stack height. 7.         The site of the industry is suitable as per the prevailing policy of the Board dated 30.04.2021 and Board’s circular 21 dated 08.06.2018 for grant of varied consent to operate to the industry under the Water Act, 1974 & the Air Act, 1981 for 15 years from the date of notification of master plan. Keeping in the view of above, it is recommended that varied consent to operate under Water Act, 1974 may be granted to the industry for manufacturing of Tin containers @ 20000 nos./day by using Tin plate @ 26 T/day as raw material  valid upto 31.12.2026, with suitable conditions as per policy of the Board and following additional conditions:- 1.    The industry shall not carry out any expansion in its premises under any circumstance without obtaining prior permission from the Board. 2.    The industry shall not generate and discharge any kind of trade effluent, only domestic effluent shall be discharged onto land for plantation after treatment through septic tank. 3.    The Board shall revoke / cancel the consent to operate granted to the industry under the Water Act, 1974 & the Air Act, 1981, if at any stage, the contents of the affidavit submitted by the industry found wrong. 4.    The industry shall not use any fuel in its premises except HSD oil in the DG set without obtaining prior permission of the Board. 5.    The industry shall be bound to comply with the provisions of the notified master plan of Sangrur in true letter & spirit and shall shift its unit to designated area after obtaining NOC from the PPCB as per the guidelines of the department of Town & Country Planning or Local Bodies, whichever is applicable.
