<p class="MsoBodyTextIndent" style="margin-left: 0in; text-align: justify; text-indent: 1in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">It is submitted that the industry was granted 'consent to establish' (NOC) under the Water Act, 1974 </span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/FGS/2022/18326415 dated 13/05/2022 valid upto 21/04/2023, for the manufacturing of</span><span lang="EN-US"> </span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Seamless pipe & Tubes (Cold) @48Metric Tonnes/Day Seamless pipe & Tubes (Hot) @72 Metric Tonnes/Day</span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">.</span></p>
<p class="MsoNormal" style="margin-top: 12pt; text-align: justify; text-indent: 1in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Now, the industry has applied for obtaining fresh 'consent to operate' under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with requisite documents. The industry has earlier deposit consent fee of Rs. 54000/- vide UTR No. SBIN422300229808 dated 27/10/2022 as Water consent fee and Rs. 54000/- vide UTR No. SBIN422300229690 dated 27/10/2022 as Air consent fee against the un-depreciated fixed assets of Rs. 1474.71 Lacs as on 30/11/2022 as per CA certificate dated 12/12/2022, which is adequate <strong>upto </strong><strong>29/02/2024</strong> under the both Acts as per Board's Office Order dated 29/10/2018 after deducting penalty charges 10 %.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Accordingly, the site was visited by the undersigned <strong>on 15/12/2022</strong> and following observations were observed:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin: 0in 0in 0.0001pt 0.25in; text-align: justify; text-indent: -0.25in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry was in operation during visit. It has commissioned its unit in the month of Nov, 2022.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 12pt 0in 0.0001pt 0.25in; text-align: justify; text-indent: -0.25in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry is engaged in manufacturing Seamless pipe & Tubes (Cold) @ 48 Metric Tonnes/Day.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 12pt 0in 0.0001pt 0.25in; text-align: justify; text-indent: -0.25in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Manufacturing process of the industry is as under:</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.25in; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Raw Material (Seamless pipe) – Drawing bench – Surface treatment / Pickling – Annealing – Straightner – Cutting – Ready</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 12pt 0in 0.0001pt 0.25in; text-align: justify; text-indent: -0.25in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';"> The industry has installed 1 no. Annealing furnace of capacity @ 3 TPH and 1 no. Thermic Fluid heater of capacity @ 5 lac Kcal/hour.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 12pt 0in 0.0001pt 0.25in; text-align: justify; text-indent: -0.25in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry is using PNG as fuel in both furnaces. Hence, no Air Pollution Control Device is required and only stack of adequate height is being provided with each furnace.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 12pt 0in 0.0001pt 0.25in; text-align: justify; text-indent: -0.25in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry is carrying out surface treatment process i.e. pickling and phosphating. The spent trade effluent is being lifted to CETP, Chanalon as per the agreement made on 08/12/2022.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-left: 0.25in; text-align: justify; text-indent: -0.25in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">There is generation of domestic effluent, which is being utilized onto land for plantation after passing through septic tanks.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The variation in project cost and actual invested cost as on 30.11.2022 is attached in PDF file.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in;"> </p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">It is intimated that </span><strong><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">MoEF&CC has issued notification no. S.O. 3250(E) on 20.07.2022</span></strong><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">, which is reproduced as under:</span></p>
<p class="MsoNormal" style="margin: 12pt 0in 0.0001pt; text-align: justify;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">"Whereas, the Hon’ble National Green Tribunal vide its order, dated the 12th February, 2020, in Original Application No. 55/2019 (WZ), (Gajubha Jesar Jadeja vs Union of India &Ors.), has inter alia observed that Cold Rolled Stainless Steel Manufacturing Industries require prior environment clearance but, having regard to the fact that there were a large number of such mills operating on the strength of Consent to Establish (CTE) and Consent to Operate (CTO), the Hon’ble Tribunal has held that opportunity should be provided to such units to fall within the Environment Clearance regime by granting a period of at least one year to operate for the purpose.</span></em></p>
<p class="MsoNormal" style="margin: 12pt 0in 0.0001pt; text-align: justify;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">And whereas, the Central Government, keeping in view the impact caused due to the Covid19 pandemic has taken a considered decision in line with the above said order of the Hon’ble National Green Tribunal, so as to provide a window period for such re-rolling or cold rolling units to obtain prior Environmental Clearance.</span></em></p>
<p class="MsoNormal" style="margin: 12pt 0in 0.0001pt; text-align: justify;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">And whereas, the Central Government is of the view that steel re-rolling operations fall under the purview of the secondary metallurgical processing industry and require Environment Clearance as per item 3(a), relating to Metallurgical Industries (Ferrous and Non-ferrous), of the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide notification number S.O. 1533 (E), dated the 14th September, 2006, mandating the requirement of prior environmental clearance for the projects covered in its Schedule (hereinafter referred to as the said notification), wherein all non–toxic secondary metallurgical processing units with capacities greater than 5000 tonnes/annum (TPA) fall under category B.</span></em></p>
<p class="MsoNormal" style="margin: 12pt 0in 0.0001pt; text-align: justify;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Now, therefore, in exercise of the powers conferred by section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby directs that all the standalone re-rolling units or cold rolling units, which are in existence and in operation as on the date of this notification, with valid Consent to Establish (CTE) and Consent to Operate (CTO) from the concerned State Pollution Control Board or the Union territory Pollution Control Committee, as the case may be, shall apply online for grantof Terms of Reference (ToR) followed by Environment Clearance and the said units shall be granted Standard Terms of Reference as per item 3(a) of the said notification and shall be exempted from the requirement of public consultation:</span></em></p>
<p class="MsoNormal" style="text-align: justify;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Provided that the application for the grant of ToR shall be made within a period of one year from the date of this notification.</span></em></p>
<p class="MsoNormal" style="text-align: justify;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">2. This notification shall come in to force from the date of its publication in the Official Gazette. "</span></em></p>
<p class="MsoNormal" style="margin-top: 12pt; text-align: justify; text-indent: 1in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Further, it has also obtained letter from DTP, Fatehgarh Sahib vide memo no. 1238 –DTP(FGS)/NG-62 dated 07/09/2021, which is reproduced as below:</span></p>
<p class="MsoListParagraph" style="margin: 12pt 0in 10pt 9pt; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">"</span><span lang="PA" style="font-family: Raavi, 'sans-serif';">ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਅਤੇ ਹਵਾਲੇ ਤਹਿਤ ਪੱਤਰ ਦੇ ਸਬੰਧ ਵਿੱਚ ਦੱਸਿਆ ਜਾਂਦਾ ਹੈ ਕਿ ਆਪ ਦੀ ਸਾਈਟ ਪਿੰਡ ਤਲਵਾੜਾ</span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">, </span><span lang="PA" style="font-family: Raavi, 'sans-serif';">ਸਬ-ਤਹਿਸੀਲ ਗੋਬਿੰਦਗੜ੍ਹ</span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">, </span><span lang="PA" style="font-family: Raavi, 'sans-serif';">ਜਿਲ੍ਹਾ ਫਤਹਿਗੜ੍ਹ ਸਾਹਿਬ ਦੀ ਰੈਵੀਨਿਊ ਐਸਟੇਟ ਅੰਦਰ 30 ਕਨਾਲ-0 ਮਰਲਾ (3.75 ਏਕੜ) ਰਕਬੇ ਵਿੱਚ ਪੈਂਦੀ ਹੈ</span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">, </span><span lang="PA" style="font-family: Raavi, 'sans-serif';">ਸਬੰਧਿਤ ਰਕਬਾ ਨਗਰ ਕੋਂਸਲ</span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">, </span><span lang="PA" style="font-family: Raavi, 'sans-serif';">ਮੰਡੀ ਗੋਬਿੰਦਗੜ੍ਹ ਦੀ ਹਦੂਦ ਦੇ ਅੰਦਰ ਨੋਟੀਫਾਈਡ ਮਾਸਟਰ ਪਲੈਨ</span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">, </span><span lang="PA" style="font-family: Raavi, 'sans-serif';">ਗੋਬਿੰਦਗੜ੍ਹ (2010-31) ਦੀਆਂ ਤਜਵੀਜ਼ਾਂ ਅਨੁਸਾਰ ਇੰਡਸਟਰੀਅਲ ਯੂਜ਼ ਜੋਨ ਵਿੱਚ ਪੈਂਦਾ ਹੈ।</span><span lang="PA" style="font-family: 'Bookman Old Style', 'serif';"> </span><span lang="PA" style="font-family: Raavi, 'sans-serif';">ਇਹ ਪੱਤਰ ਸਿਰਫ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਸਬੰਧੀ ਹੈ</span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">, </span><span lang="PA" style="font-family: Raavi, 'sans-serif';">ਇਸ ਨੂੰ ਸਾਈਟ ਅੰਦਰ ਹੋਈ ਉਸਾਰੀ ਜਾਂ ਭਵਿੱਖ ਕੀਤੀ ਜਾਣ ਵਾਲੀ ਉਸਾਰੀ ਦੀ ਪ੍ਰਵਾਨਗੀ/ਐਨ.ਓ.ਸੀ./ਸੀ.ਐਲ.ਯੂ. ਨਾ ਸਮਝਿਆ ਜਾਵੇ ਜੀ। ਆਪ ਸਾਈਟ ਅੰਦਰ ਕੋਈ ਵੀ ਐਕਟੇਵਿਟੀ ਸ਼ੁਰੂ ਕਰਨ ਤੋਂ ਪਹਿਲਾਂ ਸਬੰਧਤ ਵਿਭਾਗ ਤੋਂ ਸੀਐਲਯੂ/ਬਿਲਡਿੰਗ ਪਲਾਨ ਪਾਸ ਕਰਵਾਉਣ ਦੇ ਪਾਬੰਦ ਹੋਵੇਗੇ।</span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">"</span></p>
<p class="MsoNormal" style="margin: 12pt -0.9pt 10pt 0in; text-align: justify; text-indent: 1in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">From the above, it is clear that the industry falls under industrial zone as per Master Plan of Mandi Gobindgarh.</span></p>
<p class="MsoNormal" style="margin: 12pt -0.9pt 10pt 0in; text-align: justify; text-indent: 1in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">It is intimated that CPCB has already issued modified directions u/s 18(1)b of the Water Act, 1974 & the Air-Act, 1981 regarding Harmonization of Classification of Industrial sectors under Red/Orange/Green/White categories vide its letter no. B 29012/ESS/CPA/2015-16/85-84 dated 7.3.2016 alongwith the "Final document on revised classification of Industrial sectors under Red, Orange, Green & White categories" which also includes the consent period for which the consents are to be granted to Red, Orange and Green category industries for 5 years, 10 years and 15 years respectively. Further, Board vide Head Office letter no. SEE(HQ-2)/2018/ 9982-10003 dated 27/08/2018 has directed to strictly follow the consent validity criteria for Red, Orange and Green category industries as mentioned in the modified directions issued by CPCB u/s 18(1)b of the Water Act, 1974 & the Air Act, 1981 i.e. consent to Red, Orange and Green category industries may be granted for 5 years, 10 years and 15 years respectively. But, in the subject cited case, the industry has deposited consent fee only <strong>upto </strong><strong>29/02/2024.</strong></span></p>
<p class="MsoNormal" style="margin: 12pt -0.9pt 10pt 0in; text-align: justify; text-indent: 1in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">It is pertinent to mentioned here that a meeting was taken by the Hon'ble Chairman with the officers of the Board on 29/01/2021 at 11:00 AM in the Committee Room, Head Office, Patiala, wherein, it was decided that Consents to operate be issued to the industries for longer duration as per protocol laid down by the Board and more emphasis shall be laid on the monitoring.</span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';"> </span></p>
<p class="MsoNormal" style="margin: 12pt -0.9pt 10pt 0in; text-align: justify; text-indent: 1in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoNormal" style="margin-left: 4.5pt; text-align: justify; text-indent: -4.5pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';"> <strong>The Board shall continue to grant consent to</strong> <strong>establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries</strong>.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Punjab Pollution Control Board, Head Office vide OM no. 383 dated 16.11.2022 has directed the seamless pipe plants for manufacturing of pipe & tubes having processes Green like reheating, rolling, piercing/manderling, drawing (elongation) etc. (using CNG/PNG/LPG as fuel to obtain Environmental Clearance (EC) from MoEF&CC/SEIAA, Punjab as mandated under the provisions laid down under the MoEF&CC Notification No. S.0. 3250(E) dated 20.07.2022 before starting any activity regarding its establishment at site. But, the subject cited unit has already established by obtaining prior 'consent to establish' (NOC).</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">In view of above, it is therefore recommended that:</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in;"><strong><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">1</span></strong><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">. The industry may be granted fresh </span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">consent to operate under the Water Act, 1974 & Air Act, 1981 <strong>upto 19/07/2023</strong><strong> </strong>to the industry with suitable conditions and special conditions that:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: 27pt; text-align: justify; text-indent: -27pt; line-height: normal;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">a)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall be bound to obtain Environmental Clearance for the project as per </span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; color: #222222;">MoEF&CC notification no. S.O. 3250(E) dated 20.07.2022</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 27pt; text-align: justify; text-indent: -27pt; line-height: normal;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">b)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; color: #222222;">The industry shall be bound to apply online for grant of Terms of Reference (ToR) within followed by Environment Clearance within one year from the date of issue of MoEF&CC notification no. S.O. 3250(E) dated 20.07.2022</span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 27pt; text-align: justify; text-indent: -27pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">c)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">T</span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">he industry is advised to obtain necessary clearance for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA).</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 27pt; text-align: justify; text-indent: -27pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">d)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry maintains it's already stabilized its vehicular movement area within industry/entry/exit points, to suppress the dust emissions.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 27pt; text-align: justify; text-indent: -27pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">e)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall obtain NOC of the Board, if it changes any of its product/capacity of the plant.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 27pt; text-align: justify; text-indent: -27pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">f)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall not change/modernize its manufacturing process and shall not increase its production capacity.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 27pt; text-align: justify; text-indent: -27pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">g)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall get its building plans approved from Competent Authority if there is any change with respect to the already approved building plans.</span></p>
