CTOA/Renewal/RPN/2021/15597573 dated 28/05/2021 which is valid upto 30/09/2025 for </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Screening cum Washing of aggregates @ 3000 CFT /day</span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">. <span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-font-weight: bold;">Thereafter, the Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act 1981 was revoked/cancelled vide no. 1094 dated 27.04.2021 due to the non-submission of the mining certificate as per the decision no. 02 of the personal hearing held on 31.08.2021 in light of the instructions issued by the Board vide letter no. 16536 dated 23.07.2021 for processing the CTE/CTO applications for stone crushers/screening/washing plants.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%;">Now, the unit has applied for obtaining renewal of 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 in the name of Sh. Nirmaljeet Singh/Proprietor (with change of proprietor ship documents i.e. ikrarnama/Sale deed) alongwith partnership deed of the previous partners executed on 21.06.2019, undertaking regarding code of practice and regarding legal mining, compliance of previous consent and consent fee. </span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 76.5pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Further, the unit has submitted the slips of obtaining raw material from <br />Rampur (H.P), verified by O/o Executive Engineer-cum-District Mining, Drainage cum Mining Division, Sri Anandpur Sahib dated 08.11.2022, 14.11.2022 and 16.11.2022 regarding obtaining raw material from Himachal Pradesh through check post lohand.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 76.5pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">The industry has submitted CA certificate wherein the value of fixed assets of the industry as on 31.03.2022 is of Rs. 12.01 lakhs. As per the record file earlier, the fee deposited by the unit is adequate upto 30.09.2028 under both the Acts. Now the fee already pending with the board is adequate upto 30.09.2027 after adjusting penalty @ 100%.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Further, as per circular no. 443 dated 09.08.2021, the case for renewal of NOC/Consent to operate for Red, Orange and Green category of small scale industries/projects, without inspection/physical verification of the environmental parameters at the time of submission of such applications is to be processed based on self-certification submitted by the industry to the effect that it is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981. As such, the stone crushing cum screening washing unit covers under orange category and was not visited to the verify the compliance before processing the current application.</span></p>
<p class="MsoBodyText" style="text-indent: 67.0pt; line-height: 150%; margin: 5.95pt 5.7pt 6.0pt 5.0pt;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Tahoma;">In view of the above facts and letter issued by the Executive Engineer, Deptt. of Irrigation-cum-Mining, Sri Anandpur Sahib and raw material mining slips, verified by their office, if approved, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be renewed for a short period upto 30.09.2023, subject to the suitable conditions and additional conditions as under:</span></p>
